Unfortunately, this is not the final final version of the new rules and regulations. Many details are missing, such as income needed to be eligible for a rentista visa and the exact procedures for changing from temporary to permanent resident. |

I'd love to know my situation now!
Don't pay taxes in Mexico, because my income comes from a Barbados registered company. How am I going to justify that to immigration? |

I have an expiring FM2 (t�cnico), and I qualify now for the permanent visa, having completed my FM2 time. But I still need to prove income for that. I haven't earned any income in Mexico this year, so I guess I'll just present declarations in zeros. That'll be the last time I go to immigration, so I think that should do the trick. |

Good luck with that, Phil. If you have to prove Mexican income, how on earth can declarations in zeros meet that requirement? |

Maybe I didn't word that right! In the past, when I've renewed, they wanted to see the last tax declaration. I've submitted in zeros before without question. |

And silly me, I've actually been paying Mexican taxes all these years, so I wouldn't have problems getting my FM3 renewed. Maybe the fact that you have a Mexican wife lets you break the rules with impunity. |

The rule that says you need to show proof you have recently paid taxes on your Mexican income when you go in to renew your visa. |

Yes Isla, I DO resent that comment!
My income has been variable for the last few years, and the only other occasion that I submitted a declaration in zeros to Immigration was when the requirements read "Your last tax declaration", and that month I had no Mexican income (and a declaration in zeros is a valid declaration). That they accepted it shows I did the right thing. I am now not earning ANY income from any Mexican company. Granted, I should talk to immigration about my situation, but "Breaking rules with impunity", I am most definitely not!

I apologize for the language I used, Phil. However, I have always needed to submit proof I had recently paid taxes on my Mexican income when applying for a renewal of my FM3. I don't see how submitting proof that you hadn't paid taxes fulfills that requirement, but if INM allowed you to do that, then obviously you did nothing wrong. I myself would be very nervous about doing what you did, but that's just me. |

As far as I know, the requirement is not "proof that you have paid taxes", but that you have declared you taxes, whether there was income or not.

If that's the case, then I understand how filing that you paid no taxes in a particular month wasn't a problem for you. But I would never try doing it myself. Hopefully, with the new rules going into effect soon, at least before I have to visit INM next May, I will soon become a permanent resident and not have to worry any more about filing monthly tax declarations ! |
