Hey everyone,

So I have a position and I'm sitting in HK waiting on my visa... It's a lot more expensive than we planned for and we're quickly running out of money so I need to get some odds and ends jobs for hubby and me while we wait. I obviously would prefer tutoring, but anything will suffice right now... any ideas on how to go about getting something fast? i posted on CL....

Unless you are a permanent resident or have a dependent visa, taking on any work (paid or unpaid) outside the remit of your working visa is illegal. Although honestly speaking the chances of getting caught are low, the punishment if caught is quite severe. Is it worth it?

You might investigate online tutoring options. While it may be illegal to take on paid work while sitting in HK without a visa, I would think that it's not a problem to take on paid work in a different country and do it online from HK.

Sorry but I think that's also illegal. From the government website:

In general, unless a person has the right of abode or right to land in the HKSAR, he/she requires an entry visa/permit to work, study, establish or join in any business, take up residence or to stay in the HKSAR as a visitor longer than the allowed visa free period.

Conditions of Stay

A successful applicant entering the HKSAR as a visitor shall be subject to the following conditions of stay that:

1. he/she shall not take up any employment whether paid or unpaid;
2. he/she shall not establish or join in any business; and
3. he/she shall not become a student at a school, university or other educational institution.

Sure, that would be a solution. Pop back to the US to work for a while until your HK work visa comes through.

I would interpret that as only applying to HK employers. But, then again, I'm not a lawyer, so I could be wrong. Are there documented instances where someone has been deported or fined for working online for a U.S. employer while visiting HK? If so, that seems like a very draconian law.

I often do paid work for my U.S. employer while on extended visits with my wife's family in Latin America. While local employment is strictly prohibited while on a tourist visa, there doesn't seem to be any problem with me doing work for my U.S. employer while spending my vacation dollars locally. It seems like--in this day and age--that it would be common place for many international travelers to be engaged in paid work via the internet while on the road.

If the purpose of laws such as those above is to prevent foreigners from taking away employment from locals, why would the government be concerned about folks whose foreign employment (which does not impact the local job market) are actually putting additional money INTO the local economy?

Thousands of people are convicted of breaching their conditions of stay every year. There is a substantial fine plus up to 2 years in prison. Along with the subsequent criminal record which would be attached to your ID, it's not something to take lightly.

Having said that, I'm also not sure whether 'working for an online company' would breach the conditions of your stay. Given the seriousness of the punishment, it might be worthwhile to do a bit more research first. Perhaps starting a thread over on Geoexpat might result in some useful information.

Wow! Pretty stiff penalties. I agree. More research is definitely in order.

Well hopefully I'll be ok and not need anything. I just got notification my accreditation is ready to pick up and I think that's the last thing they need for my visa, so hopefully by the end of the month~

Well I had some new year miracles and I picked up both my accreditation and visa today! Both were done early!
