I'm a Brit as most of you know.....I'm moving to Poz again and can't remember what I have to do to a register myself as living there permanently and b-get a polish address registered to my driving licence. Oh and what are the tax residency or rather non-residency rules...180 days or 90 like the UK?

Just had a quick chat with the wife - it is 183 days or if you have your 'centre of life' here then it's immediately.

As regards registering yourself to live here permanently, here is the info I found a while back. Can't remember the link so apologies for pasting wholesale.

**I think this is for permanent residency (10 years)**

Permit to settle on the territory of the Republic of Poland.
The leaflet only contains the list of the required documents.
Detailed information regarding the receipt of the permit is to be found:
� in the Act of 13 June 2003 on Foreigners (i.e. Journal of Laws of 2006 No. 234, item 1694, as amended)
� on the website: www.mazowieckie.pl
Documents:
� 4 copies of the application for the permit to settle filled out in compliance with the instruction
� 4 up-to-date, colour undestroyed photographs, dimensions: 4.5 cm x 3.5 cm, taken in the last 6 months on a single light background with good focus and clearly showing the eyes and face from the top of the head to the top of the shoulders, so as the face occupy 70-80% of the photographs; photographs presenting a person without head covering and dark glasses, looking straight ahead with eyes open and natural expression of the face and mouth closed, face can not be covered with hair (providing additional photo will definitely facilitate the proceedings)
� Valid travel document (3 photocopies)
� Documents confirming the required uninterrupted stay in Poland
� Certificate about the fulfillment of tax liabilities towards the State Treasury
� Current confirmation of registration for temporary residence
� Legal title to occupy the apartment in which the applicant stays or intends to stay in case he/she applies for the permit to settle based on Article 64 clause 1 point 3 (i.e. directly before submitting the application uninterrupted stay on the territory of the Republic of Poland for the period of not less than 10 years on the basis of the permit for tolerated stay pursuant to Article 97 clause 1 point 1 or 1a or clause 2 of the Act dated 13 June 2003 on the provision of protection to aliens on the territory of the Republic of Poland or for the period of 5 years in connection with obtaining the refugee status or supplemental protection)
Additionally the following shall be enclosed:
in case of the minor being a child of the alien who has a permit to settle, born on the territory of the Republic of Poland:
� Copy of birth certificate,
� Copy of the decision on granting permit to settle or residence card of the statutory representative
in case of the child of Polish citizen being under his/her parental authority:
� Copy of birth certificate
� Copy of personal identity card of the statutory representative
in case of marriage to a Polish citizen:
� Current copy of marriage certificate
� Photocopy of the personal identity card of the spouse
� In case of joint children � copies of birth certificates
Important:
� Permit to settle shall be issued for indefinite time
� The application shall be submitted during legal stay on the territory of the Republic of Poland
� The application for permit to settle submitted by the alien who:
o stays on the territory of the Republic of Poland illegally
o stays on the territory of the Republic of Poland based on the residence permit for a fixed period under Article 53a. clause 2 of the Act on aliens
o was detained, put in a guarded facility, in the arrest for the purpose of deportation, with respect to whom preventive measure has been applied in the form of prohibition to leave the country or who was deprived of freedom in the result of the enforcement of decisions issued based on respective law (Article 110 of the Act on aliens)
o stays based on Schengen visa which authorizes to enter the territory of the Republic of Poland for the purpose referred to in Article 26 clause 1 point 26
o stays abroad
shall be left unexamined
� The case starts to run from the moment when the set of documents is submitted
� Documents shall be prepared in Polish, and translation of original documents shall be made by sworn translator or consul
� Originals of the submitted documents should be presented
� The application shall be filled out in Polish, in legible manner, in capital letters
� Power of attorney: alien may be represented by attorney in fact appointed on the basis of written power of attorney. The party when appointing attorneys in fact shall nominate one of them as appropriate for receiving notifications and shall notify the authority which is in charge of the proceedings thereof; when traveling abroad, the party shall appoint the attorney in fact for receiving notifications in Poland; in the event such obligations are not met, the communication shall be deemed to have been delivered at the existing address
� Alien who received the permit to settle shall be issued with residence card valid for 10 years
� Alien shall collect residence card in person
Conditions of receiving the permit:
Permit to settle shall be granted to an alien who:
1. is a minor child of an alien, having permit to settle, born on the territory of the Republic of Poland
2. has been married to a Polish citizen for at least 3 years and who directly prior to the submission of the application has stayed uninterruptedly on the territory of the Republic of Poland for at least 2 years based on the residence permit for a fixed period
3. directly before submitting the application has stayed uninterruptedly on the territory of the Republic of Poland for not less than 10 years based on the permit for tolerated stay granted under Article 97 clause 1 point 1 or 1a or clause 2 of the Act of 13 June 2003 on the provision of protection to aliens on the territory of the Republic of Poland or for the period of 5 years in connection with obtaining the refugee status or supplemental protection
4. is a child of Polish citizen and remains under his/her parental authority
Uninterrupted stay:
� Stay on the territory of the Republic of Poland shall be deemed uninterrupted if none of the interruptions in the stay was longer than 6 months and if it has not exceeded in aggregate 10 months unless the interruption was caused by:
1. performance of professional duties or employment outside of the territory of the Republic of Poland, based on contract concluded with the employer whose registered office is located on the territory of the Republic of Poland
2. accompanying the spouse who performs professional duties or who works in conditions referred to in point 1
3. health treatment of the alien
� The period of stay of the alien who stays on the territory of the Republic of Poland in connection with receiving the refugee status or the permit for tolerated stay granted in connection with the examination of the application for granting the refugee status shall also include the period of stay during the proceedings for granting the refugee status even if the alien was placed during such time in the guarded facility or arrest for the purpose of deportation.

NOTE:
In the course of the administrative proceedings pending, the alien may be called to personally appear in order to clarify material circumstances necessary to make a decision and an obligation may be imposed on the alien to submit other documents which shall enable the administrative authority to accurately clarify the case and make a decision taking into account both the social interest as well as the legitimate interest of the party.
Applicable fees:
THE FEE SHALL BE PAID upon the submission of the application:

Additionally the following shall be enclosed:

� Documents confirming stable and regular source of income sufficient to cover the costs of living for the applicant and family members supported by him/her
� Documents confirming health insurance taken up
� Documents confirming the amount of the costs of residence
� Confirmation of registration for temporary residence
� Legal title to occupy the apartment in which the applicant stays or intends to stay
The agreement on the lending for use of the apartment shall not be deemed to constitute legal title to the apartment unless the lender is the foreigner�s descendant, ascendant or spouse, parents of the spouse or the brothers or sisters of the foreigner.
Conditions of receiving the permit:
Residence permit for the long-term resident of the EC shall be granted to an alien who has stayed on the territory of the Republic of Poland directly before the submission of the application, legally and uninterruptedly, for at least 5 years and who has:
1. stable and regular source of income sufficient to cover the costs of living of himself/herself and the family members supported by him/her
2. health insurance within the meaning of the regulations on common health insurance or confirmation that the insurer will cover the costs of health treatment on the territory of the Republic of Poland
Important:
� Residence permit for the long-term resident of the EC shall be granted for indefinite time
� The application shall be submitted during legal stay on the territory of the Republic of Poland
� The application for the permit submitted by the alien who:
1. stays on the territory of the Republic of Poland in order to study or receive vocational training
2. has the permit for tolerated stay, asylum, refugee status granted in the Republic of Poland or benefiting from supplemental or temporary protection
3. applies for the refugee status or for asylum
4. is an �au pair� or seasonal employee, or is delegated by the service provider in order to provide transnational services or service provider who provided transnational services
5. was detained, put in a guarded facility, in the arrest for the purpose of deportation, with respect to whom preventive measure has been applied in the form of prohibition to leave the country or who was deprived of freedom in the result of the enforcement of decisions issued based on respective law of the Republic of Poland or benefiting from temporary protection
6. stays illegally on the territory of the Republic of Poland
7. stays on the territory of the Republic of Poland on the basis of Schengen visa authorizing to only enter the territory of the Republic of Poland for the purpose referred to in Article 26 clause 1 point 26
8. stays on the territory of the Republic of Poland on the basis of the residence permit for a fixed period under Article 53 clause 1 point 5 or 7 pursuant to Article 53a clause 1 point 1 lit. a
9. stays abroad

shall be left unexamined

2. as an �au pair� or seasonal employee, or delegated by the service provider in order to provide transnational services or service provider who provided transnational services
3. on the basis of Schengen visa authorizing to only enter the territory of the Republic of Poland for the purpose referred to in Article 26 clause 1 point 26, stay visa issued in order to commence or continue studies or residence permit for a defined period of time granted on the basis of Article 53 clause 1 point 5 or 7 or Article 53a clause 1 point 1 a) or clause 2 of the Act on aliens
4. as the head, member of the personnel of diplomatic mission, manager of consular office and member of the consular personnel of foreign state and other equivalent of such persons based on law, treaties or generally agreed international practice
� 5 year period of stay shall include half of the period of stay of the alien based on the visa granted in connection with studies or vocational training or the residence permit for a fixed period granted in connection with circumstances referred to in Article 53 clause 1 point 16 (commencement or continuation of regular higher studies or regular PhD studies) or Article 53a clause 1 point 1 lit. b (commencement or continuation of vocational training).

Note:
In the course of the administrative proceedings pending, the alien may be called to personally appear in order to clarify material circumstances necessary to make a decision and an obligation may be imposed on the alien to submit other documents which shall enable the administrative authority to accurately clarify the case and make a decision taking into account both the social interest as well as the legitimate interest of the party.
� The costs of residence include the amount of fixed charges related with the use of the occupied apartment calculated per number of persons living in such an apartment, and moreover, the fees and charges for the supply of power, gas, water, sewage discharge, waste and liquid waste discharge.

Need a hand sharter? I'll help you out here if you've got any issues. Anyway, it's a doddle these days...

Go to the Urzad Miasta and get yourself a zameldowanie. A contract from the landlord flat/house that you rent or your notorial deed from the property you own will do the job. It will be valid for 3 months in the first place.

Go to the urzad wojewodzki and follow the second set of instructions that Simon posted - that will get you a nice A5 piece of paper confirming your residency as an EU citizen. This paper is "without limits" (contrary to what even the Polish authorities seem to think).

Go back to the Urzad Miasta and they'll de-register you and then re-register you for 5 years to the address that you've got. They'll give you a PESEL number too at the same time if you don't have one - though I suppose you should do?

Driving licence - you can exchange it at the Urzad Miasta in Winogrady, close to Piotr i Pawel. This can't be done until you get the 5 year zameldowanie, as they will ask for it. Usefully, if you have no medical conditions, Polish driving licences are valid until your 70th birthday, no need to update the photo.

Any problems here, give me a shout - the worst problem I think these days is the often intolerable wait in the same queue as non-EU citizens Sad
