|
|
Very easy and quick question: Do we get paid for public holidays?
I'm having a dispute about overtime with my boss. He's claiming that since he doesn't pay red days, I didn't work over my allocated hours for the month.
I've been in Korea for a while, and this doesn't sound right.
Can anyone clear this up? |

Yes. No deduction from salary is supposed to be made.
We aren't paid EXTRA if that's what you mean.
But could you give a little more clarification as I am somewhat confused as to what public holidays have to do with OT.
Were you working on that day or not? |

Sure. Including the two red days for December (which I didn't work), my monthly hours would be 132.5. Overtime is anything over 120 hours a month.
My boss is saying that since I didn't work the two red days, I only worked 119.5 hours. Thus, no overtime.
Is this correct? |

Yes that is correct. Red days are paid holidays...but only in the sense that you should not get any deductions from your regular salary for not working those days.
Let me guess...the boss loaded you up with extra classes during the days you DID work then used the 2 red days as an excuse for not paying you OT right? This is a favorite trick of many hakwons...but it's legal as technically you didn't work OT for the month...just not very nice that's all. |

So how many hours did you actually work? Not just adding in rough times for the red days where you did not work.
This is a touch confusing. |
