I received my criminal background check back in June, but I never ended up getting an apostille stamp on it. Instead of staying in Korea I ended up moving to China for several months. I am now planning on going back to Korea in March. I know that past six months criminal background checks are no longer valid, but I have heard that there are exceptions. I haven't lived in the U.S. since 2008 so there is no way that my record could have changed. I am wondering if anyone has had any success with using an older criminal background check. I am aware that my chances are not good, so please refrain from giving me nightmare immigration stories. I will get my fingerprints redone when I visit home at the end of the month, but I really don't want to wait around til April. Also, if anyone has any advice on speeding up the process, I would love to hear it. Is there anyway to expedite a criminal background check? I apologize if this is a repeat question. |

You have "0" chance to use the expired (old) one for a new visa application. It will be rejected without prejudice (strictly based on the date of issue) by immigration and again by the MOE (you will need 2 of them now).
If you want to expedite the process then look at one of the myriad of companies who do just that (for a substantial fee of several hundred dollars).
You can scan back through here or just google for the names and web addresses.
You will also need 2 certified true copies of your degree made and have an apostille affixed to them as well as the CBC.

So don't take my word for it. (I don't know shite about Korean immigration policies).
Apply away but don't bitch that you weren't told.
Kimmi is not going to change their policy to suit you and I don't know of any cases of old CBCs being accepted by K-immi for new visa applications since the changes came into effect back in 2010.
You aren't on an E2 and weren't extending an E2 prior to Dec. 2010 so you missed the (now expired) grandfather clause.
