DING DING DANG CHILDREN'S ENGLISH SCHOOL
EMPLOYMENT AGREEMENT FOR INSTRUCTOR
ONE-YEAR CONTRACT

This EMPLOYMENT AGREEMENT has been made this _____________________ by and between Ding Ding Dang English Inc.; organized and existing under the laws of the Republic of Korea, and having its principal office at 119/201 1090-6 Susung -4ga Daegu city, R.O. Korea 706-777 (hereinafter referred to as "Employer"); and ________a citizen of ____________, whose domicile is at _______________________________________; (hereinafter referred to as "Employee").

WITNESS

WHEREAS Employee has been selected and approved by Employer to teach the English language, Employer and Employee, in consideration of the mutual promises and covenants contained herein, agree as follows:

1. EMPLOYMENT OF EMPLOYEE

1.1 Employer hereby employs Employee to teach the English language in the form and manner and under the terms and conditions set forth here in this Agreement.

1.2 Employee hereby accepts employment from Employer to teach the English language in the form and manner and under the term and conditions set forth here in this Agreement.

2. PLACE OF EMPLOYMENT

2.1 Employee shall be employed to teach the English language at ______ Ding Ding Dang, Inc. (Hereinafter referred to as "Place of Employment").

3. DUTIES OF EMPLOYEE

3.1 During the term of this Agreement, Employee shall accept, follow, and strictly comply with the instructions, supervision, training, and discipline of the Academic Director and shall carry out such assignments as the Academic Director directs. These duties shall include instruction in any and all phases of the instructional program, administrative duties related to Employee's classroom duties, attendance at scheduled staff meetings and workshops, and any other relevant duties as may be assigned by the Academic Director. The Academic Director is responsible for establishing standards of performance relative to the Employee and is empowered to take all reasonable steps necessary to ensure those standards are met.

3.2 Unless otherwise approved by the Academic Director, normal work duties during the term of this Agreement shall refer to the following:

3.2.1. The standard monthly working hours during this period will consist of up to 110 hours of classroom contact except the remaining required hours consisting of in-office duties including basic preparation of teaching. The in-office hour during the employment may vary with discretion of academic director for orientation, training and adaptation to the new working environment purposes without overtime pay paid to the employee. Normal work duties shall include 110 hours(40 mins or 50 mins each class) per month and one and half hours of in-office working each day. (*1hr=60min)

3.2.2. In the event Employee's classroom contact is less than 110 hours in a month, the Academic Director may extend Employee's in-office time.
3.2.3. Overtime pay is granted at the rate of 21,000~23,000 won per hour only when classroom teaching time exceed 110 hours per month.


4. COMPENSATION AND OTHER TREATMENT OF EMPLOYEE

4.1 SALARY: Employer shall pay Employee as compensation for all services a total aggregate monthly of salary 2,000,000won for each month of the contract period with Employer. This salary will be paid on the 10th day of each month, beginning one month (30-31 days) after Employee begins normal work duties. The Korean income tax will be deducted monthly from the gross salary. The total monthly deduction will be 44,730won. These amounts are subject to change in accordance with changes to Korean government tax policy..

4.2.1 PAID VACATION AND PAID SICK LEAVE: Employee will receive ten(10)days paid off in total :six (6) paid vacation days during the contract year and four(4) paid school vacation(summer and winter, fixed). Unused vacation days will not be bought from Employee. Employee must have approval from Academic Director before vacation days can be taken. In addition, Employee may take up to three (3) days of paid sick leave. Unused sick leave may not be taken as vacation leave, but will be bought from Employee.
If more than three (3) days of sick leave is taken by Employee, pay will be deducted from salary per number of excess sick leave days taken.

4.2.2 SEVERANCE PAYMENT: Upon successful completion of the one-year contract, one-month�s salary will be paid to Employee.

4.3 EMERGENCY LEAVE: Employee shall be eligible to receive a maximum of fourteen (14) days of unpaid emergency leave to be taken only in the event of death or serious illness in Employee's Immediate Family. The Employee�s Immediate Family, for the purpose of this contract, includes only parents, siblings, a spouse, and children. Such emergency leave shall be granted at the sole discretion of Employer after close consultation with the Academic Director. Employee shall bear the cost of transportation in the event of the need for emergency leave. Any request by Employee for an extension of the 14 days provided by Employer will be subject to an individual review and approval by the Academic Director.



4.4 HOUSING: Employer shall select and provide either a single furnished efficiency house or a double furnished house to be shared by two employees. Each employee will have a private bedroom. Furnishings will include a TV, VCR, air conditioning, a kitchen table and chairs, a two-burner gas range, a refrigerator, dinner placements, cooking and eating utensils, a bed, a wardrobe and drawers, a sofa, a telephone, curtains for the living room, a washing machine, western toilet and a shower.
Employer shall make selection of the apartment in consultation with the Academic Director. Employee shall pay the cost of utilities and telephone charges for the accommodation provided. In the cases of shared apartments, both Employees shall equally share these expenses. Employee shall pay the cost for repairs and/or damages of provided furnishings. At the time of leaving, employee should keep ₩300,000won as a deposit for the cost of utilities and telephone charges remained. After 2 month, the rest of money will be reimbursed to the employee�s account.

4.5.1 TRANSPORTATION: Employee shall purchase an economy class round-trip ticket from the point of hire for passage on a regularly scheduled airline to Korea. The maximum cost will be $1,000(₩1,300,000). Employer will reimburse Employee for the airplane ticket within one (1) month of the termination of the contract period.

4.5.2 Employer can, at the director's discretion, purchase an economy class round-trip ticket for the employee.
If the employer purchases the airfare for the employee, the airfare total will be deducted from the first three months of the employee's salary. This is institute security and the total airfare will be reimbursed to the employee before departing Korea.

4.6 VOLUNTARY RESIGNATION: In the event that Employee voluntarily resigns prior to the termination of the term of this Agreement, Employee shall not receive reimbursement for purchase of the round-trip airline ticket purchased by Employee from point of hire. The Academic Supervisor must be notified ninety (90) days prior to Employee's last working day at Place of Employment. If Employee fails to give a ninety (90) day notice of intent to voluntarily resign, he/she will forfeit the equivalent of ten (10) days salary to Employer.

4.7 HEALTH INSURANCE: Employee shall be covered by medical benefits under the Medical Insurance Company. The costs(about 220,000 won) of this coverage shall be paid half by Employer and half by Employee. Payment will be deducted from Employee's initial salary.

4.8 ORIENTATION TIME: Computation of Employee's initial pay period shall commence on the first day of training in Korea. The paid orientation days will be spent at the institute preparing for classes and learning the instructional system.

5. TERMS AND RENEWAL

5.1 The term of this Agreement shall be twelve full and consecutive teaching sessions (approximately one year) from to in Korea inclusive of the orientation, vacation leave, emergency leave, and sick leave times specified in Section 4 of this contract.
5.2 Not later than four full sessions prior to the date of termination of this Agreement, Employer and Employee shall consult together and shall agree either to an extension or termination thereof. In the event the parties agree upon a termination, this Agreement shall end as of the date of termination set forth hereinabove.

6. DISMISSAL BY EMPLOYER

6.1 Employer shall have the right to dismiss Employee for clear and frequent neglect of duties under this Agreement including, but not limited to, frequent absences from the Place of Employment without approval of the Academic Director or good reason therefore or for manifest inability to perform duties under this Agreement. However, prior to any such dismissal, Employee shall be afforded at least twenty (20) working days in which to remedy the same.

6.2 Criminal or other conduct inside or outside Place of Employment that would, in the opinion of the Academic and Managing Directors, seriously jeopardize any student, staff person, or the reputation of Employer and will be cause for immediate dismissal. No warning time for remedy will be allotted in such cases.

6.3 In the event Employee is dismissed for any of the reasons set forth hereinabove or for any of the reasons set forth hereinafter, Employer shall not be obligated to pay reimbursement costs for the round trip ticket purchased by Employee from point of hire.

7. COVENANTS

7.1 Employee hereby agrees and covenants that he/she shall not undertake any teaching duties or employment with any persons or organizations other than Employer without prior written approval from Employer and the employer of the specific employment contemplated by Employee. Failure to comply with this article is cause for immediate dismissal.

7.2 Employee hereby agrees, covenants, and undertakes that at all times during the term of this Agreement and at all times subsequent to the termination of the Agreement, Employee shall not use the name of employer for personal business purposes.

7.3 Unless otherwise agreed to in writing, Employee understands and accepts that the rights to use, to sale, to distribution, or to publication of all original material produced by Employee during the course of Employee's employment, and for which the Employee is compensated as either regular pay, as overtime, or in an agree upon lump sum, remain the sole property of Employer.

8. ASSIGNMENT

Any assignment, attempted assignment, transfer, or attempted transfer of this Agreement or of the performance of duties and obligations hereunder shall immediately terminate this Agreement, unless the parties hereto expressly agree in writing otherwise.

9. NOTICES

All notices to be given under this Agreement shall be given in writing by serving the same upon the person to whom the notice is addressed personally, by registered mail at the address of such party given in this Agreement, or, for Employee once in Korea, at the residence in Korea, as notified to Employer.

10. MERGER CLAUSE

This Agreement constitutes the entire understanding between the parties hereto with respect to the subject matter hereof and supersedes all previous negotiations, commitments, and writings with respect hereto. Furthermore, this contract nullifies and voids any previous contract between the two parties.

11. INDEMNIFICATION CLAUSE

Employee shall indemnify and hold harmless Employer for any damages, which Employee may sustain, in any manner, through the misconduct or negligence of Employee.

12. WAIVER

The failure of either party hereto at any time to enforce the terms, provisions, or conditions of this Agreement shall not be construed as a waiver of the same or of the right of such party to enforce the same.

13. GOVERNING LANGUAGE

This Agreement has been drawn up and has been executed in the English language. The English language text of this Agreement shall govern and prevail over any translation thereof.

14. GOVERNING LAW

This Agreement shall be interpreted according to the internal (domestic) laws of the Republic of Korea.

15. JURISDICTION

A competent court in the Republic of Korea shall have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this Agreement.


IN WITNESS THEREOF, Ding Ding Dang Children's English and Employee, intending to be legally bound hereto have executed this Agreement of the date first hereinabove indicated.

1 hour of teaching does NOT equal 60 minutes. What this means is your 45 or 50 min class isn't 30 classes, it's between 38-42 classes a week.

VERY stressful.

Other clauses are obviously stacked against your for future dismissal in your 11th month to avoid paying bonus or airfare.

I'd never sign this peice of crap.

Might want to check the math again on that one.

That, and teaching 110 hours a month (assuming that all 110 hours are used) should not fall under "stressful". If it does, one might wish to consider a change of employment to another field.

Just exactly what reaches out and screams "Oh, we're going to get you on day 335!"? It looks generally like a standard contract for a person with no experience. It looks fine. The only thing really different is that they won't pay back for the airline ticket until the contact is complete. Hardly a surprise that some schools do that. At least they offer to pay the airfare back. Japan, it's you pay your own way there and they'll buy you a ticket home for most places.

Plus the teacher gets to choose the apartment. A fine idea. All while paying 2M and having a lighter schedule than most starting contracts.


While we're on the subject of math, let's pretend that they do screw the guy over at the end of month eleven.

Person A works at another school for 12 months, 2M for 120 hours, and gets his bonus. (18,055 an hour overall including a bonus per teaching hour)
Person B works here for 11 months, 2M for 110 hours, and gets screwed over on month 11. (18,181 an hour per teaching hour)

Assuming he does get screwed over, he's already making per hour what he would get at another job where he didn't get screwed over. He's already a winner before the game even starts.

Gord's right. I wish I had the same things in my contract that this one offers, and I've been here 2 years. Shocked

But you might want to check out the Job Information Journal as well as the black and greylists for past refernces to the school.

I think I recall that name being mentioned in a less than favorable light on numerous occasions.

On second thought, 1 hour = 60 minutes (class time) = beware
If you are teaching 40 min classes, this could mean that you would end up teaching 3 classes for every 2 hours of paid class time.

Let's compare: I teach 6 - 50 min classes a day and get paid for 6 hours.
You would possibly teach 8 or 9 - 40 min classes a day?

Yikes Shocked Shocked Just say no.

Yes 110 hours a month sounds easy, but when you figure in all the unpaid time and the "partial hours", it doesn't look so good.


I would advise that you keep looking. There are much better jobs out there.

dang. I had a huge post with comments and went to post it and it vanished. Sad I'll have to do it again some other time, but the general idea was that I wouldn't sign this contract. Sorry--no time to re-write, but don't jump into this quite yet!
