Ok so I have searched around a fair amount and while I have seen some information here and there I have yet to see any document detailing exactly what an E-2 visa means, with all of the rules, (which change sometimes also as I understand).
I am in Korea and near the end of a contract and my visa will expire July 10. I am just trying to get a feel for how things work at the end of a visa.
From what I understand I can extend the visa with a bunch of documents and a fee and stuff. I have seen this http://forums.eslcafe.com/korea/viewtopic.php?t=3189
What about if I want to go back to my home country and simply finish now and then perhaps come back a little later? Is an entirely new visa needed at that point?
I know there are some overstaying fees and penalties. In my case my visa ends July 10 so do I have to leave that day? Is there any grace period or buffer? My alien registration card ends a week later. I have been told that the ARC date is the one that matters but I don't want to incur some kind of overstaying penalty.
I just wish there was a document that laid out what all the rules are for the visa, and specifically at the end of one. Thanks. |

Numbers are mine for clarity.
1) This is to extend a work visa - not to extend for tourism purposes.
If you want to extend for tourism purposes at the end of your sojourn you simply need your passport, ARC and ticket. You will be extended until your date of departure (a maximum of 30 days after the end date on your ARC).
2) Yes, a new visa would be needed.
3) Is this the date on the visa in your passport or the date on your ARC.
The date on your visa is essentially meaningless AFTER you get your ARC.
Your ARC end date is the important one.
You MUST leave the country BEFORE midnight on the end date indicated on your ARC.
There is NO GRACE PERIOD.
An overstay (of even a few hours) WILL complicate any future plans to return on a work visa and cause you delays and penalties when leaving.
4) There is - it is on the immigration website and the rules for end of visa are the same for ALL classes of visa. Leave by the end of your ARC or pay the penalties for overstay.

Thanks that's exactly what I was looking for. You know of where a link to that document is? I wasn't able to find anything all laid out in a PDF or something.
Ok yeah it looks like my E-2 working visa ends July 9 (I said July 10) but my ARC ends July 17. I don't think I knew that the ARC date is the important one.
Well anyway great info, cheers. Now I understand what I'm dealing w/ for the end of the visa. |

Actually one more little thing for clarity if you or someone else want to help. So you're saying I can stay 30 days longer for fun basically so in my case the ARC ends July 17 so that would be Aug 16? Simply on the strength of a scheduled flight?
So that makes it sound like there is a grace period then. Simply buy a ticket and you have a 1 month grace period to leave?
Why doesn't everyone do that then? Why would anyone ever have an overstay penalty? Just get on a computer and schedule an Eticket. |

not a grace period... You actually have to get the extension... not just overstay.
You MUST get an extension to your sojourn BEFORE your ARC expires.
It is marked onto your ARC and noted in the computer system at immigration.
You can do it on line at the immigration website (with a fax or scanner) or go to your local immigration office with ticket, ARC and passport in hand.
It is free and easy to do but it must be done. |
