Terms and Conditions of Employment Agreement Full-Time Instructors
This Employment Agreement is effective by and between REDACTED (hereinafter
referred to as “Employer”) and
a citizen of
whose permanent address is
(hereinafter referred to as “Employee”).
The Employee has been selected and approved by the Employer to teach at REDACTED, the Employer and the Employee, in consideration of the mutual promises and covenants
contained herein, agree as follows;
1. TERMS OF AGREEMENT
1.1. This agreement will commence
1.2. The working visa issued by the exclusive agreement between the Employer and the Employee
becomes invalid right after termination of agreement.
1.3. This agreement may be renewed by mutual consent two months prior to its expiration. Without
new agreement between the Employer and the Employee two months before the expiration, the
Employee shall be automatically dismissed from employment when the contract expires.
1.4. If the Employee wishes to terminate the employment contract prior to the agreed date of
expiration due to his/her personal reasons which are not accepted by the Employer, he/she
has to pay a fine of the equivalent of the one way airfare which the Employer has provided as
compensation for the inconvenience which early termination causes both the students and the
1.5. Prior to such early termination, the Employee should give 60 days notice in written to the

2. DUTIES OF THE EMPLOYEE
If you teach morning kinder, basically your hours are from 9:30 a.m. to 6:30 p.m.
1) Teachers may be required to work on Saturday or Sunday for the Winter Performance. All the
teachers should attend.
2) Teachers may be required to work one day Saturday for the Graduation Trip.
2.1.During the term of this agreement, the Employee will accept, obey and comply with the
instructions, supervision, training and discipline of the Director of the Language Institute.
These duties will include instruction for regular classes, administrative duties related to the
Employee’s classes, student placement testing, attendance at scheduled instructors’ meetings
and workshops and extracurricular duties (such as Bus classes, Lunch-time table classes, Field
trip etc. would be included) as may be assigned by the Director. The Director is to set standards
of performance for the Employee and is empowered to take reasonable steps necessary for
assuring that those standards are met.
2.2. During the term of this agreement, the Employee is required to perform the work assigned to him/
her by the Director for 80 90min classes (120hours) each four- week session.
2.3. The Employee must not cancel classes arbitrarily. If cancellation of classes is unavoidable, the
Employee must consult with the Director in advance. In case of sickness, unexpected accidents,
and bereavement, the Employee has to take steps stated in 4.4. And 4.5. Of this agreement.
(If the Employee canceled the classes arbitrarily, the equivalent amount of overtime payment
(\18,000) will be taken off from the pay check for each canceled classes.)
2.4. The Employee is not allowed to work for any other organization during the term of employment.
2.5. At all times during the term of this agreement, the Employee is to perform his/her work according
to the curriculum and the teaching methods that have been established by the Employer.
2.6. The Employee understands and agrees that at all times during the term of this agreement; the
Employee is to follow all the provisions of laws and regulations of the Government of Korea and
any local government authorities thereof.
3. SALARY AND OTHER BENEFITS FOR THE EMPLOYEE
The Employee will be paid the total of 2.1 million
Korea won per month. However, the Korean income
tax as required under Korean law will be withheld each month from the Employee’s salary. The
Employee’s salary will be paid on the 10th of the each month. If this day falls on a national holiday,
Saturday, or Sunday, the salary will be paid on the previous business day. However, in the last month
of the contract term, the monthly salary is to be paid on the last business day of the month or the 10th
of the next month, which is the regular payment day.
On the condition that this contract is completely satisfied and that employment lasts for one year, a
special allowance of a month salary will be paid to the Employee by the Employer. The severance
payment which is also subject to Korean income, resident, and other taxes will be paid one month
after the completion of the contract. The employee won’t get any severance payment if the employee
doesn’t complete his/her one year contract.
Work exceeding the required amount as described in 3.2. Will be considered overtime. Overtime pay
will be calculated on an hourly basis and will be paid \18,000.
3.2. Sick Leave
Provided that the Employee submits medical certification (limited to serious illness or hospitalization)
from the hospital designated by the Employer, the Employee is allowed a maximum of 3 paid sick
days per year. In the event of a serious illness or accident, the Employee is allowed another 3 day
unpaid leaves. If the Employee is still incapable of fulfilling duties after that period, the Employee’s
contract will be regarded as terminated.
3.3. Bereavement Leave
If any of the employee’s immediate family dies during the term of the contract, the Employee may
request 7days of Bereavement Leave to attend the funeral.
The Employee will be provided with furnished housing by the employer. All fees, charges, costs,
taxes, expenses, general maintenance fee, etc. incurred in using the housing will be borne by the
employee. In case the Employee would not like housing provided, he/she may request a monthly
allowance of 300,000 won instead.
The Employer will provide a round ticket to and from Korea only when you signed this contract in the
other countries. If the employee is hired in Korea, the employer will provide, at the end of one-year
contract, one-way trip ticket to the country of permanent address.
In case, if employee can’t complete 1 year contract, the employee has to reimburse his/her plane

Holidays and vacations are assigned according to the school calendar.
The Employee is entitled to 10 days vacation – 5 in the summer and 5 in the winter. Before making
any vacation plans, the employee should consult the school’s vacation schedule first, and should

The Employee is to be covered by the medical insurance law. 50% of the insurance premium and
pension will be paid by deduction from the Employee’s salary.
4.1. The Employer has the right to dismiss the Employee for negligence of duties, misconduct, or
unwillingness or inability to meet conditions of employment as set forth in this agreement. Prior
to such dismissal, the Employee will be given 30 days notice. However, illegal activities or other
misconduct which has jeopardized any students or staff members of the Employer, or which
damages the reputation of the Employer, will be the cause for immediate dismissal without
warning or time for remedy.
4.2. The Employer has the right to dismiss the Employee for providing false information in related

This agreement was drawn up and will be executed in the Korean language, and the Korean version
of this agreement will govern and prevail over translations thereof. This agreement will be interpreted
according to the internal (domestic) laws of the Republic of Korea. The court of the Republic of Korea
will have jurisdiction in regard to any disputes or claims arising out of, or in connection with this

|So if you get fired in the 11th month you have to pay back your arrival ticket in full? That's not nice.
The contract uses the word "basically." Either it is or it isn't. They also misspelled a few words.
A 90 minute class is rough.

This EMPLOYMENT AGREEMENT has been made this between known hereafter as “the School,” having its office at 2nd Floor, Seoul, Korea (zip code: and

CLAUSE 1 (APPOINTMENT)
a. The School agrees to employ the Teacher as an instructor of the School during the period stipulated herein.
b. The Teacher agrees to accept the employment and work at full capacity for the School. c. The Teacher agrees to teach the assigned classes by the School.
CLAUSE 2 (EQUAL IDENTITIES & WORKLOAD)
a. The School and the Teacher are individuals of equal value and respectability coming together to respectfully exchange their services.
b. The Teacher agrees to work for the school between the hours of 9:30 a.m. to 6:55 p.m. Monday through Friday up to the contract requirements.

CLAUSE 3 (PERIOD OF EMPLOYMENT)

b. The Teacher agrees to discontinue his/her residence in Korea before his/her visa is expired. c. The Teacher has until 5 p.m. the second day after termination of this contract to remove

CLAUSE4 (THE TEACHER’S DUTIES)
The Teacher's responsibilities include the following:
a. Teaching the assigned classes
b. Following the advice and direction of the School.
c. Developing supplemental materials as necessary
e. Attending teachers‟ meetings, and parents-teachers‟ meetings
f. Attending the School‟s events, such as the annual performances and seminars. g. Performing other teaching related duties as assigned
h. Teaching his/her class with passion while in class, and must not take rest, or engage in behavior or talk unrelated to teaching.
i. Being punctual for the beginning and the end of the class. (A bellring indicates the end and the beginning of the class).
j. Must not have a cell phone during class, and should keep it in the same spot he/she/ wishes. k. Must not bring something hot to drink except water
l. Lunch is not provided.
CLAUSE 5 (Dress & Behaviour Code)
a. The Teacher must be properly dressed at all times.
b. Use of illegal drugs is not permissible, on or off the job and such use shall be cause for
immediate cancellation of this contract without recompense or exception.
c. Use of alcoholic beverage during work hours is not permissible. Use of alcoholic beverage
prior to work that adversely affects the teacher‟s ability to perform these stated duties and
responsibilities shall be unacceptable.
d. Smoking is not allowed on the school premises.
e. The Teacher must not smoke in sight of children, even outside places that do not belong to
f. The Teacher shall obey the laws, regulations, instructions, and ordinances of the school, and
the local and national government.
g. It is against Korean law for a foreigner to work outside of his/her contract.
h. Any conduct which interferes with or compromises the teacher‟s of another employee‟s
work performance shall be cause for immediate termination of this contract.
i. Disciplining students with physical punishment of any kind will not be tolerated and will be
cause for immediate dismissal.
k. Any conduct which could be regarded as sexual behaviour will not be permissible.
CLAUSE 6 (SALARY AND WAGE)
a. The School agrees to pay the Teacher a monthly salary of 2.1 million won paid in Korean currency.
b. Salary shall be paid on the same day each month and shall be paid Korea won. It will be the 10th of the month.
c. Teaching hours (9,400 minutes/4 weeks)that exceed the contracted hours are remunerated at 12,000 Won per 40 minutes.
d. The Teacher should provide Korea bank account number to the School. The Teacher will be paid by direct deposit.
￼Canada Public Institute (CPI)
e. On completion of the one-year contract, the teacher shall receive one month‟ salary as a severance payment.
f. The Teacher shall be paid 30.000 won per day during the orientation (9:00am – 19:10pm).
CLAUSE 7 (TAX)
Income tax and residential taxes will be deducted from the salary according to Korean tax law. Based upon the Teacher‟s salary, the income tax rate is approximately 3.3 % of his/her gross income and the residential tax rate is 10% of the income tax.
CLAUSE 8 (TRANSPORTATION)
a. The one year contract comes with a round trip airfare.
b. The School is to provide the Teacher with an economy class ticket from the nearest
international airport to Korea. Upon completion of this one-year contract, the Teacher will be provided with a return ticket to the point of original departure, international airport to his/her nearest home.
c. In case of the Teacher leaving the school before the end of the contract, the School will not pay for a return ticket.
d. If the Teacher leaves the school before completing half of this contract (6 months), the cost of the airfare to Korea must be reimbursed to the school. The price of the ticket paid by the school will be deducted from his/her last month's payment.
e. If the Teacher is hired in Korea, then the School doesn‟t provide a round trip airfare. Instead, upon completion of this one-year contract, the Teacher will be provided with a ticket to his/her home country.
f. For those teachers renewing their contracts, a one way airfare is provided from Seoul to any point of destination in his/her home country.
CLAUSE 9 (ORIENTATION PERIOD)
a. Upon arrival in Korea, the Teacher may be allowed one or two days adjustment time and preparation for school prior to the beginning of regular classes.
b. During the orientation period the Teacher should be inside the school learning about the school system. The period of the orientation will be 3 to 5 days, depending on the schedule of the School.
CLAUSE 10 (INSURANCE)
a. Medical insurance will be provided under the Medical Insurance Company. The total cost of this coverage will be born half by the School and half by the Teacher. The Teacher‟s share of this coverage will be deducted from the salary.
CLAUSE 11 (VACATION)
a. The number of vacation days will be 8 working days a year as summer and winter vacation.( 3 days for summer and the other 5 for winter vacation)

Even if the Han Gul Exclamation day(09th Oct, 2013) would fall on the national holiday next
year, that day would be one of our working days.
b. Vacation days will be scheduled by the School.

CLAUSE 12 (SICK LEAVE)
a. The Teacher will be allowed 2 days of paid sick leave during the contract period.
b. The Teacher will summit the doctor‟s note within the day after his/her absence.
c. If the Teacher is absent from school with proper notification, the amount of salary for the
day will be deducted per day from the monthly salary.
d. If the Teacher fails for submitting notification to the School, a warning letter will be issued.
CLAUSE 13 (ACCOMMODATIONS)
a. Housing is provided in the form of apartment.
b. Utility fee (including maintenance fee, water, gas, electricity, and internet) will be
deducted from his/her salary every month.
c. The Management of the Teacher‟s apartment is executed by the School, and its cost
includes actual expenses and a certain amount of management fees.
CLAUSE 14 (DISMISSAL OR VOLUNTARY RESIGNATION)
14.1 The School reserves the right to dismiss the Teacher for the following reasons:
a. Neglect of the duties stipulated in this agreement
b. Frequent absences and tardiness from work
c. Having received three warning letters
d. The inability to perform the duties stipulated in this agreement
e. Engaging in criminal conduct or in misconduct.
a. In the case that the Teacher engages in criminal offence or misconduct, or has received
more than three warning letters, the School has the right to dismiss the Teacher
immediately without giving him/her 30 days notice.
b. The School agrees to give THIRTY days notice prior to dismissal if the reason for dismissal
does not apply to the session 14.2.a.
c. If the Teacher wants to terminate the contract before its maturity, he /she may do so only if
he/she submits a EIGHTY days advance notice in writing to the School in order for the
School to have enough time to find and hire a new teacher.
d. If the Teacher complies with the section 14.2.c, and wishes to leave and go to another job,
the School agrees to give the employee a „Letter of Release‟ upon written request.
CLAUSE 15(GOVERNING LAW & JURISDICTION)
a. This Agreement is governed by the law of the Republic of Korea.
b. Photocopies of this Agreement will be considered as valid as the signed original.

Employer and employee agree as follows: Employee accepts employment from employer to teach the English
language under the terms and conditions set forth here in this agreement for a period of twelve full and consecutive
months. Employment commences from the first day of orientation ( Jun , 3rd , 2013 ) and finishes on the last
teaching day of the last teaching session covered under this agreement.
Duration of Contract : ( Jun 3rd, 2013 ~ Jun. 2nd, 2014 )
Duties of Employee
1.0 During the term of this agreement, employee will be required to prepare for, teach and carry out all required
administrative duti es connected with classes assigned by the employer. Hours spent in office preparing lessons,
photocopying materials, student placement interviews, and other work related to the Institute shall not exceed 5
hours per week. No regular schedule of work hours can be guaranteed to employee. Payment made for
assigned teaching periods is inclusive of payment for preparati on and administrati ve duties connected with those
assigned classes. Employee agrees to attend meetings and training workshops scheduled by employer. The
purpose of meetings and workshops is to inform employees of matters relati ng to employee ’ s duties and the
institute ’ s operation, or to assist in employee ’ s professional development. No payment in excess of or in addition
’ to employee s monthly salary will be made for attending meetings or workshops scheduled by employer.
1.1 The minimum teaching requirement is an average of Thirty (30) per week, fifty-minute periods per teaching hour,
such average being calculated over each month. Monday through Friday are teaching days except for scheduled
public holidays and vacation days. The teaching hours will be between 2pm and 10pm, except during the
summer and winter vacation periods.
1.2 The employer will have the authority to require employee to perform teaching duties in excess of the minimum
teaching requirement, such excess being no more than an average of two teaching periods per day. Total
teaching periods in excess of the minimum requirement is considered overtime and calculated on a monthly
1.3 At all times during the term of this agreement, employee will directly adhere to and obey all the rules and
regulations that have been, or may hereafter be established, by employer for the conduct of employee or
generally for the conduct of instructors at the place of employment.
Compensation of Employee
2.0 Transportation: Employer will provide for empl oyee an one-way economy class ticket for passage to Korea
from an interna tional airport (henceforth referred to as the “point of departure”). The point of departure will be
mutually agreed to by the employer and employee. On completion of the full contract period, employer will
provide for the employee an economy class ticket for passage from Korea to return to the point of departure. In
the event that the employee continues employment under subsequent employment agreement with employer;
the return air ticket wil l be provided at the time of completion of the subsequent contract period(s). Air tickets
provided cannot be exchanged or cash equivalents or transferred to persons other than the employee. Employer
does not agree to, and is not liable for, compensati on to employee, whether in cash or otherwise, for air tickets
that are not used by employee.
2.1 Housing : Employer wil l select and provide furnished single living accommodations for employee.
Furnishings provided by employer will i nclude: A TV and VCR, A Bed, A Refrigerator, A gas range, microwave
oven, an electric toaster, a table, wardrobe and anything that the school sees fit to provide.
2.2 Utilities: The cost of monthly housing service, all utilities, internet, cabl e TV, and telephone charges for
accommodation provided by employer will be paid by employee. It is the responsibility of the employee to pay
these costs on a regular monthly basis. In the event that employee completes this contract, is dismissal or

vol untary resignations and does not pay all outstanding monthly services, employee will be billed to their native
country and will be reported a national collection agency if charges are not paid i n a timely manner.
2.3 In the event that employee vacates employer-provided accommodation during the contract term, and the lease
for the accommodation must be canceled, employee agrees to pay any cancellation charges or other expenses,
if any, incurred by employer due to the cancell ation of the l ease of the accommodation employer originally found
2.4 Salary: Except for the period of orientation and training, employer will pay employee for the minimum teaching
requirement mentioned above the amount of 2,100,000 Won/ month of this agreement. Teaching salary will
commence from the first day of teaching. Korean income taxes (3.3%) and Korean National Pension Scheme
deductions will be withheld. Monthly salary payments will be made on or before the tenth day of the month
following the month during which the employment services were provided. Employee will be paid at the rate of
18,000 Won for each teaching period in excess of the minimum teaching requirement.
2.5 Severance Payment: Dependent upon completion of at least one full year of employment wi th employer,
employee will be given approximately one month’ s salary payment, according to Korean Labor Law. This
payment is made at the time of termination of employment, including any periods subsequent to that covered
under this agreement.
Treatment of Employee
3.0 Korean Labor Law: By law, all foreign Employees are subject to the same labor laws as Koreans; therefore,
Employer and Employee agree to follow Korean Labor Laws governing the Korean Pension (soci al security)
program and other regulations. Any event not described in this contract shall be resolved in accordance with
Korean Labor Law Standards and related regulations, or by mutual consent of both parties.
3.1 Orientation and Training : Shortly after arrival in Korea, empl oyee will be required to undertake orientation and
training before commencing teaching. The period of training and orientation will usually be two days but
employer reserves the right to reduce that period i n cases where employee arrives in Korea less than one week
before the commencement of a scheduled teaching session.
3.2 Holidays and Vacation: Employee will be entitled to observe public holidays and receive paid vacation days
during the contract term accordi ng to a yearly schedule provided by employer before the commencement of the
year to whi ch the schedule refers. There are at l east ten (10) paid vacation days in each calendar year (January -
’ December). It includes Maple College s summer Vacation.
3.3 Sick Leave: Employee is allowed a maxi mum of five (5) days of sick leave per year. Employer must be notified
at least 12 hours before sick leave is used. In the event that Employee is absent for more than three
consecutive days, employee must provide an original medical certificate after the day sick leave was taken.
Employer will not be financially responsible for reimbursing the costs of the medical certificate. Pro-rated
amounts of sick leave are provided for employment terms of less than twel ve sessions. The value of unused sick
leave remaining at the completion of this agreement term will not be paid to employee.
3.4 Medical Insurance: Employee wil l be covered by medical benefits under the Korean Medical Insurance Union, a
Government Health Organization. The costs of this coverage will be borne half by employer and half by
’ employee. The monthly premium is approximately 20,000 won of the Employee s monthly salary.
Dual Employment Prohibition
4.1 Employee, after signing the agreement and receiving a work visa, can only legally work for the Institute
designated by Employer. If Employee works for any other institutes, companies, or individuals without the
consent of Employer and Korean Immigration Office, Employee shall pay one month ’ s salary and the total cost of
hiring and replacing the Employee and any other losses ensued by his/her conduct, including losses incurred by
the Institute if they lose their license to operate the school.

Dismissal or Voluntary Resignation
5.0 Employer will have the right to dismi ss employee for unwillingness or inability to meet conditions of employment
as set out under this agreement, for conduct seriously jeopardizing any student or staff person, or for criminal

6.0 Employee hereby agrees, covenants, and undertakes that he/she will not undertake any teaching duties or
employment with any persons or organizations other than the employer. To undertake such employment is a
breach of Korean Immigration law and can have serious consequences.
6.1 The employee understands and accepts that the rights to use, sale, di stri bution, or publication of all original
material produced by the employee during the course of employee's employment, and for which the empl oyee is
compensated as either regular pay, as overtime, or i n an agreed-upon lump sum, remain the sole property of

|Hi to everyone, looking for some sturdy advice regarding this contract. The main red flag is the tax rate of 5%. According to this forum and the Korean NTS website it's high; according to the Canadian government website it's normal. I asked a current teacher at the school and this is the rate for everyone at that school. I'm willing to pay $65US more in tax if the school has a good work environment. The following contract is an employment agreement between ________________ to be referred to as the instructor and _________________ to be referred to as the institute from this point forth.
1. Job Position: English Instructor
2. Period of Employment: One year contract, extension is possible. The instructor will be employed by the institute for the following dates.
From _201 /1 / _to _201 / 10/_
3. Monthly Salary and overtime: A monthly salary of __2.2M__ won will be paid for per month (Monday through Friday).
Each teaching hour in excess of 30 teaching hours(1800 minutes) per week is considered as overtime. The overtime pay will be 25,000 won per teaching hour(60 minutes). Attendance at other related activities, staff meeting, working → what does this mean? This consitutes anything???, checking homework, and class preparation (which is mandatory) will not be considered as overtime.
If the employee doesn't complete one year contract, he should pay back the airplane tickets coming to Korea in accordance with Korean labor standard law.
*Pay day: pay day is every 11th day. Salary will be paid for the previous month on pay day. Ex) starting day; Jan. 4 → pay day; Feb. 11(for January’s working days )
*Outside classes; such lessons as company and home lessons by the school are counted as the same class hour at the school.
4. Bonus: Upon completion of this contract, the instructor will receive one month's salary as bonus. This payment will be made at the time of the completion of the contract period. If the employee does not complete 1 year contract, the employer doesn’t pay the bonus in accordance with Korean labor standard law.
5. Medical Insurance: The instructor will be covered by medical benefits under the Korean medical insurance union --> any info on this coverage?. The cost of this coverage will be split half by the instructor and half by the institute. If the instructor doesn’t want the medical insurance, the institute respects his/her opinion(In fact, a healthy person doesn’t need to join the medical system, because he/she loses much money every month.). As to pension, the instructor pays 100% if it is needed. → Isn’t it legally required to pay into this???
6. Tax: Income tax will be deducted from the salary according to the Korean tax law. (Currently 5%)
7. Airfare: A one-way ticket will be provided to the instructor in advance by the institute. Upon completion of the contract, a return ticket will be provided by the institute(If the employee gets round trip ticket, the return ticket will be kept by the school). However, if the instructor fails to complete the above contract period for any reason, the employee should pay back the air tickets coming to Korea and a return ticket will not be given to the instructor. In case the teacher doesn’t return to his country(or goes to another country for travelling) and he doesn’t need the return plane ticket, the school gives him 700,000 won instead of the return air ticket. And if he/she wants to move to a new school in Korea even after the completion of 1 year contract, a return ticket will not be given. → I feel like you should still get reimbursed for this, even if you decide to stay another year.
8. Housing: The institute will select and provide a rent-free, fully furnished(including a bed, a two-burner gas hot plate, a refrigerator, a washing machine, a TV set, telephone) single studio apartment for each instructor. The cost of monthly service, utility charges(gas, water, electricity, cable TV, telephone charges) for the accommodation provided will be paid by the instructor.
The employee must move out on the next day of the actual last teaching day.
The employee will discontinue residence in Korea under the visa status sponsored by the employer upon the completion of this contract unless both the parties agree to renew the contract.
9. Vacation: The instructor will be given 10 days' paid vacation(Sundays and Saturdays are not included in a paid vacation) while the employee is under the contract. The employee will take 5 days in summer and 5 days(including 1 national holiday in a rare case; it means 1 whole summer week, and 1 whole winter week) in winter, according to the school schedule Could my vacation days fall on a National Holiday(s) ?. The instructor should set up the vacation time according to the schedule of the school.
10. Sick leave: The employee is permitted up to two days of paid sick leave per year. Unused sick leave may not be taken as annual leave. In order to be eligible for paid sick leave, when the employee is unable to attend class because of illness, he or she shall notify the employer, with an accompanying proof of illness from a physician, at least two hours prior to the commencement of the class(The instructor must visit and go home after getting permission.) → Why can’t you bring the doctor’s note the next day of work?). If the employee fails to notify the employer with proper proof of illness, the employer has the right to deduct one day's pay for every day the employee is absent from work. Sick days and vacation days cannot be used together.
11. Duties of instructors
During the term of this agreement the employee will perform the following duties.
A.1. EFL instruction in any phase of the Institute’s program
2. Curriculum design and implementation
3. Development of educational programs and materials
4. Grading, evaluating, and counseling of students
5. Class preparation and teachers’ meeting
6. Keeping his/her classroom neat
7. Interviewing new students and evaluating their placement level
8.Attending the school contests and events and grading the students’ presentation in any case
9.Telephone English with all the members of the class once a month if requireded
B. The instructor will follow set class schedules.
1. Working hours are from 2:10 p.m. to 9:10 p.m.(mostly) or 9:55(rarely, when the instructor finishes the last class around 9:45)
# 2:10 p.m.~3:10 p.m. or 4:00 p.m.: preparation and correcting students’ homework
# 3:10 p.m. or 4:00 p.m.~ 9:10 p.m.(mostly) or 9:45 ; teaching time
# There is no limit of daily teaching hours in the working hours. ???
2. He/She will not be late(arrival time: 14:10), dismiss classes, cancel classes, stay out of the school between 14:10 and leaving time, and start classes late without the approval of the director. He/She leaves the school 20 minutes after the last class ends, finishing class-related work.
# 1st class starts at 3:10 or 4:00 p.m. every day. Last class ends at 8:55 mostly, or 9:45 sometimes, but it can be changed with school schedule changes.
3. The Employee will be required to work at the times the Employer shall direct already outlined in the contract.
4. The employee will not be allowed to leave the institute during the working the hours even if he/she has no classes.
C. The instructor will use textbooks provided by the institute and is encouraged to supplement these with other materials. All materials given to the instructor by the institute will be returned after they are no longer needed.
D. The instructor will not partake in the following activities since they may damage the reputation of the institute:
1. Conducting class while under the influence of alcohol, while smoking or while under the influence of illegal drugs.
2. Making sexual advances towards, or entering into relationships with students or employees of the institute. Using abusive language and despising.
3. Conducting any private classes or accepting any funds is not allowed without permission from the director.
4. Borrowing or lending of the funds to students or conducting any sales of items to students.
5. Teaching students , seated himself or herself on a chair or desk. → you can never be seated in front of students under any circumstances (ie, presentations) ?
E. Any damages that are the direct result of negligence on the behalf of the instructor, either at the institute or residence, will be paid for by the instructor.
F. If the instructor seeks to be released from the contract for personal reasons, the instructor will report to the institute and agrees to work until a replacement instructor is placed (approx, 10 weeks are taken). The instructor will have to reimburse the one way ticket which the instructor uses when he or she comes to Korea.
G. If the instructor fails to conduct him/herself in a professional manner, resulting in damage to the image of the institute, or fails to follow the director's order, the institute has the right to terminate this contract immediately. But if the institute has to terminate the contract due to internal problems like?, the institute will provide two weeks’ notice. And if the institute violates the contract, two weeks’ notice must be provided as well. In either case, in accordance with South Korean Labor Law, a letter of release will be given to the employee.
H. All the other details are not described here. The instructor observes the school regulations( including class preparation, checking homework, sending report cards, team meetings, school events, various system changes, etc.).
12. Dismissal, Voluntary Resignation and Liquidating Damages
1.1. The Employer will have the right to dismiss the Employee if or when:
1.1.1. The Employee repeatedly fails to perform his/her duties stated under this Agreement including but not limited to frequent absences from the place of Employment/Institute without approval of the Academic Supervisor.
1.1.2. The Employee fails to conduct himself/herself in a professional manner (as described in this contract and the school regulation)(especially gets lots of complaints from the students and their parents, and doesn’t correct diary or essay assignment), resulting in damaging the image of the Institute.
1.1.3. The Employee places any student or a staff person in jeopardy or causes significant material damage to the Employer as a result of his/her negligence or reckless behavior.
1.1.4. The Employee commits any criminal act inside or outside the place of employment/Institute. This will result in immediate dismissal with neither warning nor time for remedy being given to the Employee.
1.1.5. The Employee has already received three(3) reprimands(warnings) from the Employer of dissatisfaction with the Employee’s performance, and the Employee has not rectified the situation.
1.2. The Employee may not earlier terminate this Agreement without a good reason. If required, 75 days prior notice must be given to the Employer before termination of the contract.
1.3. In any case of dismissal or voluntary resignation, the Employer will not provide a return ticket and will not give the severance pay. In addition, if the Employee voluntarily terminates this contract before six (6) months of employment or is dismissed by the above clause 12-1.1, he/she will have to reimburse to the Employer the initial airfare and other expenses that the Employer has incurred in the process of hiring the Employee.
1.4. If the employee wishes to accept any other employment, such as private or part-time teaching, editing and so on, he/she must get the employer’s approval before doing so. Failure to comply with this rule may result in immediate dismissal.
Both parties have read the above conditions and agree to the terms in good faith and will agree to resolve any disputes in a reasonable manner through the arbitrator.

|Hello! This is my first post. This seems like an attractive offer to me, but I wanted to see if anyone here saw anything out of place in this contract, or something that might not be obvious to a new ESL teacher reviewing contracts that he/she might want to take into consideration.
Employment Agreement for Instructor
FIRST YEAR CONTRACT
This EMPLOYMENT AREEMENT has been made this 5th August 2013 between , being established under the laws of South Korea at, ____-____, F _______ Bldg, ______-dong, _____-shi, ______-do, Republic of Korea (hereinafter referred to as the (hereinafter referred to as the "employer") and , a citizen of USA , Whose Passport /ID No. is (hereinafter referred to as the "teacher")under the terms and conditions set forth below.
Both parties agree on the following terms and conditions:
CLAUSE 1 (APPOINTMENT)
a. The employer agrees to employ the teacher during the period stipulated herein.
b. The teacher agrees to accept the employment and will work in his/her full capacity for the school.
CLAUSE 2 (PERIOD OF EMPLOYMENT)
The period of the contract will be one year from 28th /Aug / 2013 –29th /Aug / 2014 .
CLAUSE 3 (THE EMPLOYER'S RESPONSIBILITIES)
a. The employer and teacher are equal individuals working together to provide quality English instruction under the terms stated in this contract.
b. The employer will honor the terms and conditions of employment for the teacher as stated within this contract.
c. The employer will guarantee the teacher a salary in consideration of the teacher's teaching hours and proper preparation for the classes.
CLAUSE 4 (THE TEACHER'S RESPONSIBILITIES AND DUTIES)
a. During the terms of this Agreement, the teacher must cooperate and comply with the instructions and disciplines of the school. Assisting the Supervisor of Director, he/she must carry out assignments as directed by the employer.
b. The teacher must be prepared adequately for the classes in advance.
c. At all times during the term of this contract, teachers must maintain a clean and neat appearance. While suits and ties are not mandatory, a professional appearance is desirable.
d. The teacher's work will include the following:
1. Teaching the English language (Target students' ages: 5-middle School)
2. Development of educational programs and materials
3. Curriculum design and implementation
4. Indoor and outdoor classroom activities for/with students
5. Level testing, grading, evaluation, and assessment of students
6. Providing students with individualized care
7. Attending teacher's meetings and workshops
8. Other related school activities
(ex. Performing and practicing the graduation teacher’s performance)
CLAUSE 5 (WORKING HOURS)
a. During the term of this Agreement, the teacher should work in cooperation with the Supervisor or Director (10AM-19PM) from Monday through Friday.
b. Teachers will be required to attend some special events throughout the year (Workshop, Graduation Ceremony, Sports Day, etc.) which may fall on a Saturday. Teachers will not receive additional compensation for these days. Except weekend farm activity which may happen one a month.
c. The teacher agrees to teach 120 teaching hours per month and to adequately prepare for classes.
* Teacher Benefit
CLAUSE 6 (SALARY AND OVERTIME RATE)
a. The employer agrees to pay the teacher salary of 2.1 Mil KRW won for 120 hours per Month and preparation for classes.
b. The payment of the salary is to be made once a month
c. Each hour exceeding the 120hours/month will be considered as overtime. The payment for the overtime will be 15,000 won per hour. Attendance at scheduled staff meetings(once every Monday morning) and teacher's training workshops, along with preparation for classes is mandatory and not considered as overtime.
d. Salary, overtime pay, and fringe benefit condition should be kept confidential.
CLAUSE 7 (TAX)
Income tax and inhabitants' taxes will be withheld in accordance with the Korean tax law.
CLAUSE 8 (PAID VACATION and HOLIDAYS)
a. The teacher will be allowed to have all national holidays off.
b. The teacher will also be allowed to have only 10days off (winter and summer) vacation, according to the Heritage school calendar, Each vacation will be one week (including weekend).
The summer vacation is usually scheduled for late July / early August and the winter vacation is usually scheduled between Christmas and New Year.
CLAUSE 9 (ACCOMMODATION)
a. The teacher will be provided single accommodation, which will be located three minutes walk from the nearest subway station.
b. The monthly rent will be paid by the employer.
c. The cost of utilities for the accommodations will be paid by the teacher.
d. For the first three months, the Employer will withhold a deposit of 200,000 won each month(600,000 Won in total), in order for the employer to pay off any damages to the apartment
resulting from the teacher’s abuse or negligence. This deposit will be returned on the condition of the teacher completing the 1 year contract
CLAUSE 10 (YEAR-END BOUNUS, SEVERANCE PAY)
Upon completion of this one-year contract, the teacher will receive one additional 1 month salary as a bonus. Income tax will be withheld from this payment.
CLAUSE 11 (TRANSPORTATION)
a. A one way ticket Korea from the teacher's home city will be provided to the teacher.
b. On completion of the full contract period, the employer will provide the teacher a ticket for passage from Seoul, Korea back to the teacher's home city. The return air ticket will be provided at the time of termination of employment.
In the event that the teacher continues employment under a subsequent employment agreement with the employer; the return air ticket will be provided at the time of completion of the subsequent contract period(s).
Air tickets provided cannot be exchanged for cash equivalents or transferred to persons other than the teacher. The employer does not agree to, and is not liable for compensation to the teacher, whether in cash or otherwise, for air tickets which are not used by the teacher.
c. If the teacher leaves the school prior to completing the one year's contract for any reason, the teacher will be responsible for paying back the cost of the original airline ticket to Korea.
CLAUSE 12 (SICK DAY & ABSENT)
a. The teacher will be allowed 3 paid sick days.
b. The teacher must provide doctor's note and contact one of the school superiors.
c. If the teacher is sick for more than 3 days or absent for any reason, he/she must
pay for their missed classes.
d. For every missed class, he/she must pay 15,000won.
e. The teacher will receive a bonus of 50,000won for every sick day that has not been used.
CLAUSE 14 (HEALTH INSURANCE)
The Employee will be covered by Korean Health Insurance plan. Acccording to the government for employees, the monthly insurance charge will be shared (50/50) by the emploter and the Employee
CLAUSE 15 (KOREAN NATIONAL PENSION)
In according to with Korean Law, all foregin workers should pay into the Korean National pension plan at a rate of 4.5% against monthly earnings.
A total-sum of the national pension will be refund to the employee by the Korean Law.
CLAUSE 16 (DISMISSAL OR VOLUNTARY RESIGNATION)
a. The employer reserves the right to dismiss the teacher from employment for the following causes:
1. Neglect or inability to perform his/her duties stipulated in this agreement
2. Frequent absences from work or lateness.
3. If the teacher arrives late 5times, he/she will receive a written warning.
3. Receiving three warning letters
4. Criminal behavior or misconduct
b. The employer agrees to give the employee 30 working days notice in the event of dismissal.
However, in the case of a teacher's criminal behavior or misconduct, he/she will be dismissed from employment immediately with no warning or notice.
c. In the event the teacher wishes to resign from his/her employment, he/she can do so by giving at least 45 working days notice to the employer.
CLAUSE 17 (GOVERNING LAW & JURISDICTION)
a. This Agreement is governed by the law of the Republic of Korea.
b. This Agreement is made final and firm unless any material modification or amendment to this Agreement is executed with the full knowledge and consent of the undersigned and incorporated into this Agreement.

Period of Employment
The institute will employ the instructor for the following dates:

1. Salary: A monthly salary of 2,300,000 KRW will be paid for assigned teaching hours (104 actual teaching hours per month) and administrative duties (lesson preparations, student evaluations, teacher meetings, and workshops) not including Korean national holidays. An hourly wage of 20,000 KRW will be paid for each additional hour exceeding the contract hours. One month’s salary will be paid at the end of the contract term as severance pay. The severance pay will be paid only when the instructor completes the contract. No part of the severance pay will be paid when the instructor doesn't complete his/her contract.
2. Pay Day: Salary will be paid monthly (from the first or starting date to the last day of the academic month excluding Korean holidays) along with other instructors by the seventh of the following month. Any errors in salary should be reported to all parties affected within a week from the day the instructor’s salary is paid.
3. Insurance: A medical insurance plan from the National Health Insurance Cooperation (http://www.nhic.or.kr/english/main.html) will be offered to the instructor. The monthly premium will be split equally between the instructor and the institute.
4. Tax: Korean income tax will be deducted from the salary according to Korean tax law (which varies between 3.3% - 5%). If income tax is overcharged, it will be reimbursed at the end of the instructor’s contract according to Korean tax law.
5. Airfare: The institute will provide the instructor with the airfare to and from _____ If the instructor fails to complete the one-year contract for any reason, the institute will not provide the instructor with the return airfare. If the instructor renews his or her contract, the instructor will be provided with the return airfare at the time of completion of the extended contract.
6. Accommodations: The institute will provide a rent-free apartment. The instructor will pay for his or her utilities, including any charges incurred during his or her contract period, and agree to leave on deposit an amount to cover any anticipated charges incurred during his or her contract sojourn. Any damages that are the direct result of negligence on the behalf of the instructor will be paid for by the instructor. However, the institute will pay for damages caused by nature or temporal deterioration.
7. Sick Days: The instructor has three paid sick days per year with a medical note from a doctor or through approval of the institute. However, if the instructor misses any classes without permission, the salary for the missing teaching hours will be deducted from the instructor's full monthly salary.
8. The instructor will set a good positive example at all times with due regard for _________ language requirements, and Korean cultural norms. The instructor will make every effort to accommodate local cultural difference.
9. The instructor will follow set class schedules and will not dismiss classes, cancel classes, or start classes late without the approval of the institute.
10. The instructor will use textbooks provided by the institute and is encouraged to supplement these with other materials. All materials given to the instructor by the institute will be returned when they are no longer needed.
11. The instructor will not conduct class while under the direct or indirect influence of alcohol, while smoking or while under the influence of illegal drugs.
12. The instructor will not make sexual advances towards or entering relationships with students and/or employees of the institute.
13. The instructor will not conduct any private classes directly or indirectly including accepting any funds without permission from the institute. (The immigration office does not permit foreign instructors to conduct private English language classes outside the respective school sponsoring their E-2 visa without specific approval from the immigration office.)
14. The instructor will not borrow or lend of funds to students or conducting any sales of items to students
15. The instructor needs to carry out all required administrative duties such as lesson preparations, student evaluations, teacher meetings, and workshops.
Dismissals or Voluntary Resignation
17. The institute has the right to terminate this contract with six-week notice for unwillingness or inability to meet the conditions of employment as set out under this contract. However, any instructor found engaging in the activities listed in section 11, 12, 13, and 14 will have his/her contract immediately terminated.
18. If the instructor seeks release from the contract for personal reasons, the instructor will give six-week advance notice to the institute and will receive 100% of the monthly salary from that time until a replacement instructor is found. The instructor agrees to work until the new instructor arrives. However, if the instructor fails to work until the new instructor arrives, he/she will receive just 80% of the monthly salary.
19. In regard to any disputes arising out of this contract, the competent court and the governing laws will be a Korean court and Korean laws.
Both parties have read the above conditions and agree to the terms in good faith, and will agree to resolve any disputes in a reasonable manner through an arbitrator.

1.0 Qualifications and Experience
Teacher warrants the academic credentials, qualifications and experience that are described in the documentation provided by the Teacher.
2.0 Term of Employment
2.1 Teacher's employment will commence on and terminate on _________________.
2.2 The contract may be renewed two months prior to its expiration date based upon the agreement of both parties. Previous reprimand notices will be voided. Otherwise, Teacher will be automatically dismissed from employment at the termination of the contract.
2.3 Employee agrees to discontinue residence in Korea, under the visa status sponsored by the employer, after termination of the contract.
3.1 The Institute agrees to pay Teacher the monthly salary of 2.1 million won based on a maximum of 170 working hours per calendar month.
3.2 All payments of salary will be in Korean won after deductions such as those
(a) required by law with regard to taxes (about 3.3%)
(b) any deductions authorized by Teacher.
3.3 Payments of salary are made by monthly installments usually on the 5th day of each month(for the previous month). However, if a payday falls on a weekend or national holiday the salary will be paid on the next work day.
3.4 Employee will be paid 30,000 won, per 60 minute class, for overtime hours that exceed the maximum of 170 hours a month. Working on weekends is considered as overtime even though the employee has worked less than 170 hours.
4.0 Duties and Responsibilities
4.1 Primarily, assuming the day to day teaching of such subjects assigned by the supervisor. Class preparation and lesson plans are to be prepared by each Teacher on a daily basis.
4.2 The employee is required to work in close association with and follow the directions of the supervisor and observe all the details outlined in the Teacher's basic guideline booklet.
4.3 If the employee is absent from their teaching duties for reasons other than a legitimate illness(doctor's note must be provided), this will not be considered a sick day and as such the employee will not be paid for that day.
4.4 One absence, without the approval of the supervisor or Director, a reprimand notice will be issued, which can be grounds for dismissal.
4.5 The Teacher must be notified of this indiscretion within 10 working days or the incident will be regarded as null and void.
4.6 Teacher may be requested to substitute or work at our other campuses.
5.0 Working Hours
5.1 The employee will be required to work each week from Monday through Friday(2:50pm-10:00pm), at times directed by the supervisor.
5.2 The employer may request the employee to perform overtime teaching duties apart from the maximum monthly requirement.
5.3 The employer does not have the right to require the employee to work more than 10 hours overtime per month unless the employee consents thereto.
5.4 The overtime hours should be pre-agreed between the employee and employer.
5.5 Employee should be aware that working hours may vary, one to two hours, depending on the timetable. Nevertheless, the employee will not exceed the standard amount of working hours per day. The employee will be notified prior to any changes.
6.1 The employer will provide a furnished single accommodation, rent free.
6.2 A bed, blanket, pillow, two burner hot plate, refrigerator, wardrobe and washing machine will be provided.
6.3 Selection of an apartment will be made by the employer.
6.4 The Teacher is responsible for utilities, management expenses and costs incurred as a result of Teacher's negligence.
7.1 The employer shall provide the employee with an economy class airline ticket(from the nearest airport to the teacher's house) to Korea and transportation from the airport to the employee's residence in Korea.
7.2 A return ticket will be issued upon completion of the contract.
7.3 If the employee leaves the Institute before expiration of the contract no return ticket will be issued.
7.4 If the employee leaves the Institute within 6 months of the starting date of the contract the employee shall reimburse the Institute the cost of the ticket, previously paid by the employer, or the cost of said ticket will be deducted from their final month's salary.
8.0 Holidays and Vacations
8.1 Employee is entitled to National Holidays and paid vacation days. A total of 10 days.
8.2 Employee may be required to work on National Holidays. In such cases another day off will be granted in lieu of the day worked.
9.0 Medical Insurance
9.1 Employee will be covered by medical benefits under the terms of the Korean Medical Insurance Plan.(KMIU)
9.2 The cost of this coverage will be paid 50% by the employer and 50% by the employee.
9.3 The employee shall pay the full amount up front and the employer shall reimburse the employee as part of their monthly salary.
9.4 Coverage commences from the date of joining KMIU. This coverage will commence approximately three to four weeks after arrival in Korea due to requirements of the Korean Immigration and Taxation departments.
9.5 A mandatory medical check-up should be done at an authorized clinic within the first month of Teacher's employment. The cost of the medical examination will be paid by the employer.
9.6 If the employee want to renew the contract, he or she should get the medical examination again and pay the cost of it.
10.0 Severance Payment
10.1 Upon completion of the contract the Institute will pay Teacher severance pay, equivalent to one month's salary.
10.2 Korean severance tax will be withheld.
10.3 In the event that the employee does not renew or extend their employment the severance payment will be made at the completion of the contract period.
11.0 Dismissal or Voluntary Resignation
11.1 Employer has the right to dismiss the employee, without a release statement, if the employee neglects their duties as outlined in this agreement.
11.2 Misconduct, seriously jeopardizing the safety of a student(s) or staff, being involved in any criminal activity are grounds for immediate dismissal without warning.
11.3 Two absence from the Institute, without documentation or approval from the supervisor, is grounds for dismissal.
11.4 Institute will terminate this contract when Teacher's performance is consistently unsatisfactory despite Teacher having been advised of the required performance standard by two reprimand notices. The second reprimand will be grounds for dismissal.
11.5 Institute may also terminate this contract when the result of the medical examination shows the Teacher is unable to perform their duties and responsibilities. (see 9.5)
11.6 In the case of dismissal or voluntary resignation neither severance payment nor a return ticket will be given.
11.7 In the event of dismissal or voluntary resignation, prior to the termination of the contract, Employer will pay all salary due to the date of termination after any outstanding bills have been deducted or paid.
12.0 Governing Law and Jurisdiction
12.1 This contract has been drawn up and executed in the English language. Therefore, the English language text of this contract will govern and prevail over any translation thereof.
12.2 This contract will be interpreted according to the internal(domestic) laws of the Republic of Korea. A competent court, in the Republic of Korea, will have jurisdiction in regard to any dispute or claim arising out of it, or in connection with this contract.

1. Job position
This contract is entered into for the position of an English Conversation Instructor.
2. Validity of Contract
This contract becomes effective upon the signing of this document by both the Instructor and the Institute. This contract supercedes any and all prior agreements, oral or written, between the parties; any future modifications to this contract must be made in writing by an officer or authorized agent of the Institute with pre-approval by the President of and executed by the signature of both parties. The Instructor's monthly salary shall commence and count from the first day of his or her teaching in accordance with the Institute's schedule.
3. Period of Employment
The Instructor will be employed by the Institute from the following dates.

The period of employment under this contract will last for one calendar year from the date of the Instructor's first day of work for the Institute unless other written contractual agreements have been entered into to amend this time period.
4. Teaching Hours
The instructor’s regular teaching hours will be between 11:00 am to 8:00 pm
On Mon, Wed, Fri / between 11:00 am to 7:00 pm on Tues, Thur. However in the case that the teacher is scheduled to start earlier or later then the teacher is required to stay for an appropriate period of time.
The class time of the institute is between from 9:30 am to 2:15 pm for Kindergarten and from 2:30 pm to 8:00 pm for elementary school students.
In the case that the instructor is required to be present for a field trip that starts at 9.30 am on a day that they usually start at and finish later, then they shall be required to stay until their regularly scheduled finishing time.
The instructor is required to be at the institute 30 minutes before your first class
to get prepared for the classes (e.g. It is 9:00am for the teacher who has a class starting at 9:30am ).
The instructor will be contracted to teach 26 hours (1hour= 60minutes) a week.
The instructor is required to serve lunch to the class and eat with them.
This time shall not be counted as teaching time in your payment.
A. Transportation: The instructor will get a return ticket to his/her country after completion of one year contract.
B. Salary: A fixed monthly salary of 2.1 million won will be paid for working fully within the monthly working hours under the condition of 26 teaching hours per week. A 15,000 won overtime pay will be granted per 40-minute class, which will then be added to the fixed monthly salary of __2.1__million won for classes taught beyond 26 hours per week. The instructor’s fixed monthly salary won’t be affected by the number of national holidays or the summer and winter vacation period.
C. Pay Day: The fixed monthly basic salary will be paid on the 10th of the following month. For example, the payment for working March will be paid on April 10. If the 10th of the month falls on either a Saturday or Sunday, the instructor will be paid on the following Monday. If the Instructor needs an advance (early payment) for urgent needs, the Institute shall allow her or him to obtain the salary in case of the pre-approval by the director of the institute.
D. Health Insurance and Pension:
Korean National Health Insurance and Pension will be provided to the teacher. The Institute and the Instructor will each pay 50% of the monthly insurance charge. (Total 4,77%)
The Institute and the Instructor shall contribute 4.5% (total 9%) to the Korean National Pension plan.
E. Sick Leave and Emergency Leave : Documented sick leave and emergency leave will be allocated to teacher total 2 days a year in case of serious injuries or contagious diseases. The medical certificate should be submitted afterwards. The teacher should provide the institute with as much advance notice as possible, at least one hour ago. Unused sick leave may not be converted into any cash payment. If it is found that the hours/days of absence reported as sick leave or emergency leave were not in fact for such purposes, related costs shall be subtracted from the following month's pay.
F. Tax : Korean income tax and resident tax will be deducted from the salary according to the Korean tax law.
G. Holidays: During all Korean national holidays (approximately 10-15 days a year), one winter vacation of four or five days, and one summer vacation of four or five days, the Instructor will be free from work. The institute will decide the final schedule of the vacation. These are all considered as paid vacations. Though some of these holidays will impact the number of teaching days and thus the number of contracted monthly teaching hours, the Instructor will not be penalized and will be paid by the fixed basic monthly salary.
H. Severance payment: The institute will give the first salary amount to the instructor only when he/she completes one year contract in full. Severance payment policy doesn't apply to the case that the Instructor works less than one year for Institute or fails to fulfill the responsibilities to the final date on the contract.
A: The Institute will provide the Instructor(s) with either a rent-free, private one-room apartment or studio. A laundry machine, refrigerator, gas range, VCR, T.V., furniture (one closet, a desk with a chair, and a bed) as well as utensils will also be provided. In case that any stuff needs to be replaced out of order, the Instructor is required to have a permission in advance of purchasing the stuff from the institute or the Institute will provide for the Instructor. In the former case, the Instructor shall provide the Institute with the receipt and the list. However, utility fees (electricity, gas, cable TV and phone bills) shall be paid by the Instructor.
B: Instructor may rent a house or an apartment for himself/herself and get 300,000 won as a housing allowance per month from the institute.
C: Instructor shall follow the other rules regarding housing (garbage disposal, paying bills, cleaning, maintenance of materials provided from the institute) on the basis of the individual case.
7. Training Period
The Instructor will be given a general orientation, which will consist of an introduction to teaching skills, materials, office equipment, schedules, Korean culture, and Seoul. Moreover, the Instructor will be allowed to observe and participate in demonstration classes. A personal trainer will be assigned to the new Instructor to help in the training process and answer any questions that may arise. During the period of the new Instructor’s training, the instructor is required to attend all training classes and workshops that will be scheduled and provided from the institute.
8. Open Door Policy
The Instructor is encouraged in all areas of his or her working relationship with the Institute to offer to the management his or her suggestion and recommendation for the improvement of the Institute and its incentive system. An "open door" policy for suggestions and any complaints or concerns will be observed by the Institute. The Instructor is expected to follow the chain of command in making such suggestions and problems known. If at any level the Instructor is dissatisfied, he or she may then proceed to the next higher level to voice his or her concern, up to the director of the Institute.
9. Instructor's Duties and Responsibilities
A. General Duties of Instructor
The Instructor's duties and responsibilities include but are not limited to the following:
a. All instructors are required to follow the directions of Program Director to
proceed necessary works for the institute.
b. Teaching Classes
The instructors shall understand the curriculum of the institute and do their best to follow the teaching schedule provided by the institute, and prepare classes with the appropriate teaching plans.
c. Maintaining Students
The instructor shall do these routines based on the institute’s year plan: Students’ Record, Level Test, Performance Report, Daily Record, and Consultant.
d. Participating Teacher’s Workshops
Workshop, Presentation, Demonstration, Teacher’s Meeting.
e. Pair Working with Korean English Teachers
The instructors shall periodically share information about their teaching contents and students that they shared with, and any necessary information with their co-teacher.
f. Assisting in the development of any of Institute's educational needs
g. Participating in activities related to any aspect of the business of the Institute (e.g., special dinners).
B. The Instructor shall strive to maintain positive work attitude and set a good example to students.
C. The Instructor is to not hide any long-term, health-related conditions to the Institute.
D. The Instructor shall follow a given class schedule and keep its beginning and ending time.
E. Though the Institute has curriculums and textbooks, supplementary materials may be bought at the Institutes expense and approval for learning enrichment.
F. Dress is expected to be casual, clean and tidy. Some events may require formal wear.
G. The Instructor agrees not to partake in the following activities:
a. Conducting class while under the influence of alcohol, tobacco, or of illegal drugs.
b. Making sexual advances towards, or entering into relationships with, students or employees of the school. Sexual harassment will not be tolerated and will result in immediate termination.
c. Engaging in any un-approved business negotiations or behalf of the Institute.
d. Borrowing or lending of funds to students; selling items to the students.
e. Instructors shall do their best to keep common-courtesy among teachers in the institute and respect each other’s culture.
H. The Instructor will be held legally and financially responsible for any property damage resulting from negligence. This includes both school and apartment property.
I. If Instructor is chronically late or absent without notification, salary deduction will incur.
J. Book Report: Teacher checks students’ book report every month. Teacher explains some guideline before they write and correct their grammar mistakes. Then the students will rewrite it.
L: Daily record: Teacher keeps a daily record for all classes.
10. Institute Property
The Instructor must return the following items when the contract terminates:
a. All things that the Institute has rented or purchased for the use of the Instructor;
b. All money loaned by the Institute to the Instructor;
c. All the items purchased and provided by the Institute for the Instructor's apartment;
d. All teaching materials and office supplies provided by the Institute;
e. Reference books owned by the Institute;
f. Any other property owned by the Institute;
11. Incentives, Pay raises, Bonuses
According to the Instructor’s work ethic, attitude, and professionalism, bonuses and pay raises may be awarded at appropriate times. The periodical evaluation on the instructors will be carried based on the institute’s evaluation criteria on the instructor’s performance.
12. Copyright/ Non-disclosure/ Non-compete Agreement
Any teaching materials produced or created by the Instructor while in the employment of the school shall be the sole property of the school.
The teaching techniques, books, and materials of the Institute are proprietary and are to be protected as intellectual and copyrighted material. During and after the contract period, these proprietary rights will be protected by the Instructor.
During this contract period, working for a competing school or for a private interest without the institute’s prior permission is strictly prohibited.
13. Termination of Contract
Termination by Instructor
The Institute recognizes that special circumstances may develop which require this contract to be amended or terminated prematurely (serious illness or death of immediate family, etc.) The Institute will endeavor to accommodate the Instructor's specific needs in such situations, evaluating these needs on a case-by-case basis. To do so, the instructor is obligated to provide any legitimate written evidence to prove the reason. Unless the instructor proves the reason, the Instructor's resignation is determined to be voluntary (unilateral and without just cause). In this case, the Instructor will be assessed up to 1 million won for the costs involved in recruiting a replacement Instructor. Furthermore, the Instructor’s salary thereafter will be reduced by 30%, and any pending bonuses will be forfeited. The amount withheld from the Instructor’s salary will be used to cover any costs related to finding a replacement and/or covering debts, unpaid utilities, phone bills, and any property damage; any remaining money will be returned the Instructor. If, however, the Instructor has worked more than 6 months under the contract AND proves intent to pay the above costs (with the exception of an Instructor replacement cost), no deduction will be made to the monthly salary. By signing this contract, the Instructor certifies that he or she has every intention of fulfilling the duties herein described.
Termination by Institute
This contract can be broken by the Institute for any of the following reasons (though others may apply):
1. instructor-initiated contractual breaches;
2. the use or possession of illegal drug substances;
3. excessive and unexcused absenteeism or tardiness;
4. inability to perform in a professional manner;
5. inability to perform as an effective instructor.
The Instructor's employment cannot be terminated by the Institute without fair warning and can only be terminated after the Instructor has been given an opportunity to rectify any deviant behavior. If, however, 1) the Instructor’s behavior is grossly inappropriate (e.g., sexual harassment), 2) the Instructor has no intent to follow legitimate warning, or 3) the Instructor’s behavior make the Institute’s reputation be at stake, the Institute reserves the right to immediately terminate the contract. If it is determined that the Instructor intentionally forces the Institute to terminate the contract in order to avoid reimbursing the Institute for the costs of securing a replacement Instructor, then the Institute will assume an instructor-initiated contractual breach and will levy against the Instructor any due penalties, as described under the section entitled, "Termination by Instructor".
Discipline and Penalties
The Institute reserves the right to utilize the full range of disciplinary measures as allowed under Korean law, if the Instructor violates the contract, damages the reputation of the Institute, or fails to perform adequately. These rights include, but are not limited to: verbal warnings, freezes on pay raises and/or revocations of previous pay raises, demotings, and dismissals.
14. Renewal of Contract
The Institute and the Instructor may jointly renew the contract for a mutually agreed upon time period. The Instructor shall alert the Institute to this possibility two months prior to the termination of the first contract.
15. Governing Laws and Jurisdictions
This contract shall be interpreted according to the internal (domestic) laws of the Republic of Korea. The Korean judicial system, then, shall have full jurisdiction over any disputes or claims arising out of or in connection with this contract.
Both parties have read the above conditions, agree to the terms in good faith, and will attempt to resolve any disputes in a reasonable manner. All disputes that cannot be resolved by the two parties will be solved in accordance to Korean Civil Law.

The Teacher will work closely with Academic Supervisor and other colleagues in the planning, observation, and review of instruction.
As a member of the Institute, the Teacher will contribute to the cumulative experience, wisdom, and resources of team dedicated to developing, implementing, and evaluating a comprehensive program for teaching English to Koreans.
The Teacher should respect the rules and standards of conduct of the Institute (written, verbal) and obey the laws, regulations, instructions, and ordinances of the national and local governments.
Any teaching or employment other than at the above address shall not be permitted, in accordance with Korean Law. Non-compliance may result in discipline including fines and deportation.
The Teacher will have at the most (23) 80-minute classes per teaching week. The Teacher is expected to devote no less than 2 hours a day at the Institute for the following : lesson planning, conference with co-teachers, student evaluations, reporting, consultation with parents, supervision of students, maintenance of the English environment during breaks, workshops, teachers' meetings, and upgrading one's professional knowledge and skills without additional pay. The standard work week is Monday through Friday with the acceptation of national holidays which are paid days off . The work week will follow the yearly academic calendar issued by BLANK.
Staff meetings will be scheduled at the discretion of the Institute Director and attendance is required. Staff meetings will allow time for discussion on topics of current concern within the academic program such as new policies, procedures, methods of training, instruction, curriculum, and other matters as needed. As a staffs member, are encouraged to help work out practical solutions to problem that may arise during these meetings. The teacher should not do the private business at the institute. The teacher has to attend at special activities without additional pay for the following ; picnic, Contest, workshops and sports day.
A. Duties may include, but are not limited to;
b. substitute teaching
c. giving interviews to students for placement test
d. supervision of students
e. preparation/production of teaching materials
f. curriculum design and implementation
g. attendance at teacher’s meeting & workshops which may not be during working
h. writing evaluation comments and preparing evaluation reports
i. diary, essay and journal correction
j. execution of duties as homeroom teacher
k. implementation of teacher policy guideline
l. Special Research Projects
Any part of the Teacher workload can be converted into research and development work.
Overtime teaching is paid at the rate of 1.5 times of the regular pay beyond (23) 80-min classes. Overtime will not be paid on holidays, sick days, or emergency-leave days. The assignment of overtime above the regular 23 classes and less than 25 classes is at the sole discretion of the Institute.
6. Dual Employment Prohibition
The Employee, after signing the agreement and receiving a work visa, can only legally

7. Work Schedule

Teacher hereby agrees, covenants and undertakes that he/she will not disclose any information relating to the Teacher’s employment conditions to others, any teaching materials, or any information relating to the academic program, whether verbally or in written, to individuals or corporate entities.
All teaching materials including any books given to the Teacher by the Institute should be returned after using and the Teacher must not take out or use these materials for other purpose than teaching for this school.
9. Working Period
1 year(12 Sessions) – After a year of entry.
1. Monthly Salary
The Institute will pay the Teacher a total monthly basic salary of KRW ( 2,100,000 ) for teaching month. The monthly salary is based on a calendar month, not the monthly teaching session. Korean income tax, National Pension, & Medical Insurance will be withheld from the monthly salary.
The Institute will provide each teacher an apartment/house. The apartments will be furnished with washing machine, refrigerator/freezer, heater etc.
3. Paid Sick Leave and Emergency Leave
Documented sick leave and emergency leave will be paid for a combined total of 12 80-min. classes a year. The Teacher should provide the Institute with as much advance
notice as possible. Unused sick leave may not be converted into any cash payment. If it is found that the hours/days of absence reported as sick leave or emergency leave were not in fact for such purposes, related costs shall be subtracted from the following month's pay. The above leaves will be included in the period of medical care compensation according to the Article 78 of Korean Labor Standard Law.
4. Teacher Training
The Teacher shall have a period of training before starting to teach in their Institute. During the training period, and for the break between the training and the start of teaching, the Teacher will be in the Institute for classroom observation. The Teacher will receive briefings from their Academic Supervisor, and the Institute Director, and will get acquainted with the local institute policies. During this time the Teacher will receive half the rate of the regular pay.
Although pay starts the day the Teacher starts Teacher Training Program, the effective date of this contract is the first teaching day in the Institute. The total period of this agreement is approximately one year, commencing from the first day of the session and finishing on the last teaching day of the Teacher's 12th teaching session. A delay in the Teacher's arrival at the Institute or in the opening of a new Institute may call for a re-negotiation of the contract period.
Normally the vacation would be in the form of one week in the summer and one week at the end of the year. The above vacation will be included monthly paid leave and annual paid leave according to Article 47 and 48 of Korean Labor Standard Law.
6. Severance Pay
On completion of one's responsibilities of the full 12 session period(1 year), an additional month of regular salary W2,100,000 will be paid as severance pay. However If the Teacher, does not complete the full period of one year contract(12 session), none of the severance pay shall be paid in accordance with the Korean Labor Standard Law. Severance pay will be paid by bank transfer no later than one month after the Teacher has left the Institute. Korean severance tax will be withheld. Any outstanding debts will be subtracted from the severance pay.
7. Early Termination by the Employer and Employee
The Institute reserves the right to terminate this agreement for cause with written notification sixty days in advance, and for serious cause without notice. The Teacher agrees to give written notification sixty days in advance of intention to terminate this agreement or of interest in renewing it.
A. The Employer and Employee may terminate this contract with a written 60 day
notice. Anything less than 60 days will be considered a breach of employment by
The institute or the teacher unless the employment is terminated for a cause.
B. In case the Employer terminate the contract for cause and in case of early
Termination by the Employee, or incase the Teacher fail to complete the contract, the Employee shall pay back the Employer the Total amount of the air ticket and recruit fee.
The Institute shall pay round-trip airfare between the nearest International Airport from the Teacher’s place applied and a major city in Korea. Round trip airfare is provided only once. A one-way ticket will be provided to Korea and at the end of one’s contract a one-way ticket to the port of the departure will be provided.

and classroom conduct under the direction of Employer;
8. Perform other duties as designated by Employer;
All materials developed by Employee while working for Employer will become the property
of Employer, and Employee shall not seek compensation and/or payment beyond what is
stated in this Contract.

Article 4 (Supervision)

but not limited to, the Korean income tax and pension contributions, shall be withheld
each month from Employee’s salary. Employer is to pay these amounts to the proper
government authorities and to provide employee with a monthly receipt evidencing that
the government has received these monies.
3. Employee's salary shall be paid on a pro rata basis on the (10) tenth day of each month.
If this day falls on a national holiday, Saturday or Sunday, the salary will be paid on the
immediately following business day.
4. When Employee has not worked a full month, salary for that month shall be paid on a
pro rata basis either from the first day or until the last day of work.
5. If Employee should be absent from work without having obtained a prior approval,
Employee's salary for that month shall be deducted by the amount calculated on a pro
rata basis for the number of unauthorized absent days.

Employee shall be paid an amount 500,000 Korean won per month in recognition of the degree
held by Employee and/or his/her work experience.
B. Benefit 2 (Preschool / Kindergarten/Elementary/Junior High school)
Employee shall be paid an amount of 400,000 Korean won per month as compensation for
instruction and preparation time in the Preschool / Kindergarten/Elementary/Junior High school
C. Benefit 3 (Welfare)
Employee shall be paid an amount of 200,000 Korean won per month as a Welfare Benefit to
assist with Employee’s living expenses and his/her overall well-being.
D. Benefit 4 (Medical Insurance)
Employer shall provide Employee with medical insurance through the National Health Insurance
Corporation (NHIC). Employee and Employer will pay fifty (50) percent each of premiums and
fees. Employer agrees to provide Employee with a medical insurance card issued to the ELI from
the NHIC within 30 days of the contract commencement date.
E. Benefit 5 (Pension)
Employer shall provide Employee with a National Pension Scheme. Employee and Employer
shall contribute fifty (50) percent each of premiums and fees.

Article 8 (Other Benefits) continued
F. Benefit 7 (Contract Renewal)
Employee shall be given the following renewal benefits on the assumption that he/she continues
to work without any discontinuity in employment.
i. Employee shall receive a re-signing bonus of _______--________ Korean won.

1. Employer shall provide Employee with single housing selected by Employer, and
Employer shall pay full monthly rent and deposit on the housing selected. Housing
selected by Employer may include a leased house, studio, or apartment. Housing
provided by the Employer shall be furnished, including a bed, washing machine, a
landline telephone, air-conditioner, refrigerator, stove, chair, table, wardrobe, television,
cooking utensils, eating utensils, blanket, pillows, and clean linen.
2. Employee shall take care of the furniture and equipment, and shall be liable for the
cost of repairs or replacement to any equipment or furniture damaged as a result of
negligence but where used furnishings are provided, Employee shall not be responsible
for replacement of said furnishings and equipment due to wear and tear from normal use.
3. Any and all fees, charges, costs, taxes, expenses, etc., incurred in using the housing will
be paid by Employee. Employer shall reserve the right to deduct 50,000 Korean won per
month as phone deposit. Employer shall reimburse this phone deposit to Employee at the
end of the Period of Employment. If Employee chooses not to have a landline telephone,
no phone deposit shall be deducted.
4. If Employee chooses not to accept the housing provided by Employer, Employer shall
provide Employee with 200,000 Korean won per month as a rent subsidy in lieu of the
housing set forth in the foregoing Article 9-1.

Article 10 (Airfare)
1. Employer shall provide the Employee a one-way economy-class airfare for the
most direct route from the Employee’s city of origin and Seoul-Incheon or Gimpo
International Airport. Employer agrees to purchase the one-way airfare for the Employee
prior to Employee departing for Korea.
2. All connecting flights within the Employee’s home country, or any other flights
not provided for in the travel itinerary authorized by Employer, shall be paid for by
3. If Employee’s contract is terminated, whether by Employee or Employer, anytime before
the last day of employment as stated in Article 5, Employee shall repay the full price of
the ticket to Employer.
4. After Employee has completed the full period of employment, and all duties within that
period, Employer shall provide the Employee one-way economy airfare from SeoulIncheon or Gimpo International Airport to the closest airport to Employee’s permanent
residence. However, if Employee renews the Contract for an additional year, return
airfare will be provided to the Employee at the end of the renewed Contract period.
Article 11 (Paid Leave)
1. Employee shall be entitled to a paid leave for a total of two working weeks (to mean 10
working days) during the Period of the Employment set forth in Article 5. Annual leave
days shall exclude Saturdays, Sundays, and Korean national holidays. The Employee is
entitled to five (5) days of leave in the summer and five (5) days of leave in the winter.
2. Employer shall decide the period of Paid Leave according to Employer’s schedule.
3. Paid Leave is a benefit given to Employee on the assumption Employee fulfills his/her
Employment Contract. In the event Employee is unable to fulfill his/her full Contract,
Employee shall pay back a portion of Employee’s salary equivalent to the total number
of paid leave days used by Employee.
Article 12 (Codes of Conduct)
1. Employee shall not behave in any manner that may damage or tarnish the reputation of
the teaching profession. Employee shall comply with and observe any codes of conduct
applicable to Korean teachers.
2. Under Korean immigration law, Employee shall not receive pay from any other
job, including a part time job, outside the duties of Employer, during the Period of
Employment set forth under Article 5.
3. Employee shall not be involved in any activities, which may cause harm to the students
or be of detriment to the reputation of Employer.

Article 13 (Termination of Agreement)
If Employee wishes to resign from the Employment and terminate this Contract, he/she must
give Employer eighty (80) days prior, written notice of resignation stating a date of
and a reason for resignation. If Employee chooses to resign, he/she is responsible for
paying back the airfare for the flight to arrive Korea paid by the Employer and the airfare
for the return flight shall be paid by Employee, and his/her VISA shall be cancelled.

occurred in the process of recruitment such as recruiting agency fees which were paid by

Employer may terminate this Contract for any one of the following reasons:
A. If Employee violates the laws of the Republic of Korea.
B. If Employee fails to perform or unsatisfactorily performs any of the duties stipulated

Article 14 (Confidentiality Agreement)
This Contract, and all its contents, is entered into on the basis of a strict, confidential agreement
between Employee and Employer. Employee shall not disclose any information, and/or
contents of this Contract to any third parties without having received prior approval from
Employer. Unauthorized disclosure of this Contract, in whole or in part, whether intentional
or unintentional, shall result in immediate termination of Contract. In such a case, it shall be
considered a termination of contract on Employee’s part and the terms of Article 13 shall be

Matters not explicitly stated in the Contract shall be determined by Employer by taking
Employee's concerns into consideration.

Article 16 (Indemnity)
Employee shall indemnify for and keep Employer harmless from any liability or damages arising
from, or in relation to any negligent or illegal activity of Employee, whether intentional or
unintentional, during the Period of Employment under this Contract.
Article 17 (Governing Law and Venue)
The terms of this Contract and the rights and obligations of the parties named herein shall be
interpreted solely according to the laws of the Republic of Korea. If a dispute or disagreement
arises in connection with this Contract, the parties shall first try to resolve it in good faith.
However, if the parties fail to resolve such disputes to their mutual satisfaction, their disputes
shall be resolved by arbitration in Seoul, Republic of Korea, according to Commercial Arbitration
Rules of the Korean Commercial Arbitration Board.
Article 18 (Signature)
In witness whereof, the parties hereto sign Contract in triplicate on the date entered below with
each party retaining one copy and submitting the third copy for Employee's visa application.
