As the title says, I'm on an E-2 visa and I have an offer to start a new position at a new school in the middle of December. My visa is valid until January 4th, and my current contract is finished on the 5th of December. I assume I will have my new contract sometime in the next week or two before I start. Do I need a LOR and will I have any problems extending my visa once I get my new job? What will I need as far as documents go? |

If your contract is done you do not need a LOR to transfer to the new job.
You will need:
ARC
passport
new contract
application
fees (60k for the transfer and 30k for the visa extension)
new employer's business registration (copy)
new employer's guarantee (sponsorship form)
it takes about 30 minutes at the immigration office.

As ttompatz said.
The problem that comes up is one timing! Immigration sometimes wants to do transfers near the end. The official might not understand that you are finished with contract. They will think you should transfer at the end of December or beginning of January.
Getting a LOR might also prove useful. Should not be needed, but some immi officials might be looking for it when you try and transfer. If you can get one and keep it in reserve for picky officials. |

I finished my contract last June, and started a new contract two weeks later. My visa expired a week before my new job started. I went to immigration with the required documents described in Ttompaz's post, but they still wanted a letter of release. Luckily I was on good terms with my old boss and he gave me one no problem.
My point is.. if your old boss doesn't balk at giving you one, it may be easier to just bring it with you to be sure you can complete everything in one visit.
If you think your old boss may give you problems, then you could go to immigration first and if they request one, tackle that problem later.
Every immigration officer will give you a different answer!! |

Thanks for the answers everyone. My new company seems to think I need a LoR and my old one doesn't seem to want to give me one for some strange reason, so I am in a tight spot. I told the new company that I don't need it but they mumbled something about my new school needing or wanting to have it. For the record, the old AND new companies are both after school programs. I doubt that changes anything, but still, I just wanna be sure.
I'm just worried that for some reason the lack of the LoR will be seen as some kind of screw up either by my new company, my new school or immigration and one of them is going to shut me out of a job, a visa, and Korea. I'm on good terms with my old company, but they still seemed hesitant. Worse comes to worst and I can't get it but someone "needs" it, I will just forge one, I suppose. Last resort. |
