Hi everyone, and thanks in advance for any help.

I have gotten myself stuck in a very stressful situation. Last year I changed jobs mid contract. My visa at that time lasted until 8/19/2013. After signing a two year contract, they extended my visa period. The employee at the immigration office told me I would be good until I signed a new contract, then smudged the visa extension date (written in magic marker) so bad that I couldn't see it on my ARC.

Being an idiot, I believed all of this.

Long story short, I am now in the USA on vacation. I had planned on returning next week to continue working. However, I got a text message last night telling me my visa had expired.

I'm hoping someone can hit me with some options here. I am going to call the consulate here in Texas tomorrow, and probably the immigration office in Seoul as soon as they open, but if anyone has dealth with this problem before, it would be very helpful to know what happened.

I am currently assuming that I will need to pay the fine for extending my visa after the original date, but I am not sure if that will be possible if I am having to enter the country after the visa has expired.

You can't extend a visa that is no longer valid. You couldn't do it at the consulate anyway even if it had not expired. You could begin collecting new documents now. Get fingerprinted and get a notarized copy of your degree made. Some people in your situation might return to Korea, risk working illegally, and then do a visa run to Japan when their paperwork is ready. I'm not suggesting you do that. I'm just saying that is what some people in your situation might do.

IF you are out of the country and your visa has expired then your ONLY option is to apply for a new visa.

IF you have been out for less than 90 days (and it appears that you are returning to the same employer) then you do not need new documents.

Your employer needs to apply for a new visa confirmation number at immigration.
When they get it, send it to you.
You apply for a new visa.
You fly back to work.
