Hi all! Has anyone heard of this HAGWON before? My husband and I have been offered a contract to work for them but we can't seem to find any reviews of them online. If not, maybe someone can help us and scan through the contract and point out any potential red flags? We have heard so many horror stories about HAGWONS so just want to be safe.



2. CONDITIONS OF EMPOLYMENT (고용 조건)
a. The Employee will act in an appropriately professional manner and be responsible for conducting professional English Language classes.
b. The Employee will be required to work for regularly scheduled hours from Monday to Friday, Each teaching hour in excess of 30 hours (actual teaching hours) a week is considered as overtime.
(Employee agrees that institute’s schedule can be made in a time limit from 1PM to 9PM for 8 hours each day and the first class will start from 2PM)
c. Classes and teaching hours are scheduled at the institute's sole discretion.
d. The Employee is required to go through an orientation and training program before starting Employment.

3. SERVICES PROVIDED BY THE EMPLOYER (고용주의 의무 이행 사항)
a. PAYMENT & TAX 급여 지급
The Employer will pay a monthly salary of 2,200,000won for regularly scheduled hours which we mentioned on the page 1 worked. (Payment of salary commences from the first day of teaching.)
b. The Employer may ask the Employee to work over time, and if the Employee chooses to do overtime, the Employer will pay for the overtime at the rate of 17,000 won per hour.
c. The employee salary will be paid on the 10th of each month.
d. Tax for income will be deducted from the salary according to the Korean tax law. The tax would be 3.3% approximately of monthly salary and this rate can be changed depends on Korean Taxation law and policy.

4. THE TEACHER’S RESPONSIBILITIES AND DUTIES (교사의 책임과 의무)
a. During the terms of this Agreement, the teacher must cooperate and comply with the instructions and disciplines of the school. Assisting the ‘Supervisor’ or ‘Director’ he/she must carry out assignments as directed by the employer. The ‘Supervisor’ or
‘Director’ will be responsible for establishing and communicating the ‘Standards of Performance’ as related to the duties stated in this contract.
b. The teacher MUST be adequately prepared for the classes in advance, preparing a
detailed lesson plan for every class,
c. At all times during the term of this contract, teachers must maintain a clean and neat appearance. While suits and ties are not mandatory, a professional appearance is desirable. (no holes in clothing, visible piercing(s), etc.)
d. The teacher’s work will include the following:
① Curriculum design and implementation
② Indoor/outdoor classroom activities for/with students
③ Level testing, grading, evaluation, and assessment of students
④ Providing students with individualized care
⑤ Attending teacher’s meetings, training, and workshops

5. WORKING HOURS (직무 시간)
a. During the term of this Agreement, the teacher should work in cooperation with the Supervisor or Director from Monday through Friday, and during special events. ( working hours are from 1pm to 9pm )
b. Teachers will be required to attend some special events throughout the year (Workshops etc.), which may fall on a Saturday. (it won`t be counted as overtime
pay)
c. The teacher agrees to teach 120 teaching hours a session while adequately preparing for each class.

6. HOUSING (주택 제공)
The Employer will provide the Employee a furnished Single housing and the Housing will be provided at no cost to the Employee with the exception of maintenance and phone bills.

A two-person apartment/house will be provided for a couple, if both are teaching at the
Institute.

7. TRANSPORTATION (교통편)
a. Round trip economy airfare is provided with the one-year contract from the teacher’s nearest airport to the international airport in Korea. Transportation from the airport to the school in where the teacher will be teaching, will be provided. (if the teacher
want to remain in Korea, the school shall give half of ticket price.)
b. If the teacher leaves the school prior to completing 6 months for any reason as agreed to in this contract, the teacher must reimburse the school the cost of the airfare paid by the school or the school may deduct the equivalent amount from the teacher’s last month’s pay.

8. MEDICAL INSURANCE (건강 보험)
a. Medical insurance is to be provided by Korean Medical Insurance Union or by a different private health insurance company/organization.
b. Half of the insurance premium is to be paid by the employer, while the other half is to be covered by the teacher.

9. SEVERANCE PAY (퇴직금)
Upon completion of this one-year contract, the teacher will receive a severance payment of 2,300,000 Korean Won, equal to one month’s salaries, in accordance with Korean Laws.
This payment will be made at the time of completion of the contract period and any and all income taxes are to be withheld.

10. VACATION (유급휴가)
a). The Employee may have 10-working days as paid vacation per year, which will be organized by the institute. (Days in which the Employee does not regularly work i.e., Saturdays,
Sundays and National Holidays are not to be considered as part of the vacation period)
b). Employee's paid sick leave during the Term of Employment shall not exceed three (3) calendar days. (A doctor's note with the diagnosis and prognosis is required to be paid for
sick days.)

11. RENEWAL & TERMINATION OF CONTRACT (재계약과 계약 파기)
a. RENEWAL (재계약)
The Employee must give the Employer a written 60-day notice before renewal or non-renewal of the Employee's current contract.
b.Both the Employer and the Employee reserve the option to renew the contract.

c. TERMINATION OF CONTRACT (계약 파기)
Both parties will give at least a written 60-day notice prior to the termination date of the contract.
d. The employer reserves the right to dismiss the teacher from employment for the following
causes:
①. Neglect or inability to perform his/her duties stipulated in this
agreement.
②. Frequent absences from work.
③. Receiving three warning letters.
④. Criminal behavior or misconduct according to Korean Law.

① Failure to fulfill one’s duties or damaging the business operation of the school due to reasons of the teacher’s interests in employment elsewhere.

b. The employer agrees to give the employee the courtesy of 30 working days notice in the event of dismissal. However, in the case of a teacher’s criminal behavior, misconduct, or with any discretion thereof, he/she will be dismissed from employment immediately, without warning or notice. Overall, the employer reserves
to right to dismiss an employee at anytime.
c. In the event the teacher resigns from employment, he/she can do so giving 60 working days notice to the employer.
If, for any reason, the contract is terminated before the full completion of the contract period:
The Employee will not qualify for benefits such as severance pay and the airfares.
The Employee will be wholly responsible for any /maintenance and phone bills remaining for the duration of their housing lease.
Within 14-days the Employee is required to sign a notice of termination and accompany the employer to the Korean Immigration office to notify the Korean Immigration office of the
termination.

12. GOVERNING LAW & JURISDICTION (법례 및 사법권)
a). This contract is governed by the law of the Republic of Korea.
b). This contract is made final and firm unless any material modification or amendment to this contract is executed with the full knowledge and consent of the undersigned and incorporated into this contract.

Well, at least they're telling you up front that their definition of "teaching hour" is "clock hour".

Not if you're not getting paid full pay for that time.

Payment commences from the first day of the contract. That's the day they fly you into Korea for the job. Pay continues for the full year--the day before the anniversary date of your arrival in Korea for this job.

That seems a mite low for overtime to me.

I really don't like this, but it's the way it seems to be everywhere. Really, given today's technology, especially computers, there's no excuse to not pay someone for the month on the last day of that very month.

If these "Standards of Performance" are in a separate document they need to be made part of the contract. Otherwise this clause is a boon for the boss.

What meetings? What training? What workshops? You should get the workshops nailed down: how many, when (what day of the week), and where.

Ah, there's the answer for one of my questions above. Unpaid work on a Saturday.

Let's assume that "session" means "month" since there are generally four weeks in a month. 120/30 = 40 so that's reasonable, although the earlier bit says any hours in excess of 30 is overtime pay.

Don't fall for the "different private" company.

The law says you can quit without notice.

The employer is required to give you 30 days notice or 30 days pay in lieu.

Again, the law says you do not have to do this.

The accompany to Immigration bit is nonsense.
