Hello,

My hogwan has changed ownership. Is my contract still valid? They are willing to resign a new (identical) contract. Is this necessary?

My concern is that the employer's signature on the new contract will not match the employer's signature on the contract submitted to immigration.

Please offer me some advise here.

Thank you.

A bit of experience on this one but as always, all experiences are different and laws are definitely open to interpretations.

If the ownership has truly changed, i.e. new business license was registered with the proper authorities, the answer is YES, you do need to resign. Because your visa is tagged to a certain business license, when that license is cancelled, so are you.

Make sure you get your severance pay sorted out NOW. How many months have you been working? If you're been working for 6 months, then you want to have your severance paid by the new owners in 6 months time & you may wish to finish your contract.

If you're still unsure, send an email to EFL-Law [email protected]

I had the same thing about a month ago and I needed to sign a new contract and send all my stuff to immigration. I talked to my new and old boss about air fare and severence. I even managed to change a few thing for the better (more holiday). Get your new employer to phone immigration to find out what exactly you need to do, I just handed everything to my boss and they sorted it. I got my old ARC back and there is not change in my passport so I think they just changed the sponsor name on my visa.
