Special education and bilingual education

Is it easier for districts to place students in Bilingual Ed. If they actually need special Ed.? This has been an issue for quite sometime now, an I find it impossible to believe that it still goes on. I am a 2nd grade bilingual teacher and I constantly have special Ed Hispanic students placed in my class. These children are usually significantly fluent in English and have learning disabilities but no language barrier. We need stricter guidelines for placing students in bilingual Ed because these children are not getting what they deserve.
