Waiver of Enrollment for SEI program

While reading Forbidden Language, I became very interested in the section that mentioned that parents have a right to waive their children from enrollment in an SEI program and can attend a bilingual program if there is at least 20 students of the same grade level and language in a school. I wanted to see if this was true of New Jersey, and upon brief research on the internet, I found that New Jersey is required to implement a bilingual program when 20 or more ELL students of the same grade level and language attend the same school. Also mentioned in the article I read was that ELL educators will have professional development workshops available for a year. As an ESL teacher in New Jersey with more than 20 Spanish-speaking students, I was curious: Does anyone know who monitors to ensure that this is happening at our schools?
