I can't think of any reason to delete this topic. I think it's something that every foreign teacher in China should be aware of. I didn't get a negative release form. I didn't get a release. Period. I am not embarrassed or regretful about what I did. I stood up for my rights as a human being. The school broke the contract. I told my side of the story and I prevailed. I don't know if I set any precedents, but perhaps there is a glimmer of hope that we can refuse to be bullied by employers.

Re: "There IS a blacklist!"

I just got this e-mail from the FAO:

The good news is we got your residence permit valid until February 10th, 2013. So you can stay in China and work here without worries. Please take the passport in my office tomorrow during working hour.
But according to the police rules, your blacklist will be kept to the end of our present contract. If you obey the contract rules and do your duty well, we will then apply to the police station to eliminate it.
Again, we appreciate all your efforts to teach students in our university so far. And we are glad that you tell us the truth in the blacklist issue. That's the premise we keep good cooperation and build mutual trust relationship in the future.

I can't believe it. As I said on the "There IS a blacklist" topic, I was sure I was dead in the water.

I need to ask the $100,000 question DID YOU EVER MENTION TO THEM THAT YOU THOUGHT YOU WERE ON A BLACKLIST? Because my thoughts are that if even remotely discussed this with them then you set yourself up for having a collar around your neck and just handed them the leash.

You gave them all the ammo they need to control you and use you.

If you WERE on a blacklist then you would not get a new resident permit.

Pretty simple.

never forget that their desire is to use you and discard you and cheat you - you just made this task very easy for them.

No. I really didn't believe that HBC would have the audacity to try to punish me when they so blatantly and deliberately breached the contract. The FAO sent me an e-mail saying he was going to report me, but from the first day I was there 90% of what he told me he was gonna do was blowing smoke.

As I have said many times, I have never been nor will I ever be on anybody's leash. I told my current employer the truth, the whole truth and nothing but the truth. If I have to do the same thing again, I will do it. They can't make me do anything. I can easily purchase a ticket out of here.

That would definitely be a bummer, but I wouldn't do a runner because of that. That's not the school's fault. Come contract renegotiation time, however............

This is not the school's fault. I will honor the contract if they will. As I said: bummer, but........

This kinda comes under the heading of force majeure.

UPDATE: Several members asked for an update; here it is. I have been paid on time and in full every month. I received my airfare reimbursement and travel allowance today (five days earlier than promised). The water dispenser in my apartment went kerflooey a couple of weeks ago, it was replaced with new one the next day. Everything as far as working and living conditions has been satisfactory and contractually correct. Take heart, people, there are some good employers here.

Glad to hear that. I work for one of the good places as well and will continue to do so till I quit China altogether.

Me also, though contentment is entirely subjective.

I work for a school that is prompt to a fault with monthly pay, reimbursing pay outs, finding good accommodations, fulfilling the contract to a "T" and that's why I stay year after year. They seem to have problems and confusion when it comes to (in my opinion at least) a proper and well-run education system and I often have to grit my teeth and bear it when they make some (again, in my opinion) moronic decisions concerning the betterment of their students. However, the good, on time pay (and other benefits) slightly outweighs the frustrations, so I stay on . . . for at least another year or two, that is.

You, clearly, don't have a brain - be thankful.
