My boyfriend and I have been offered jobs in the small city of Jurong, Jiangsu. The pay is good and the school seems to be well run. Can anyone look over the contract? It is really long but even just a quick lookover would be helpful. Thanks a million.
One thing I don't see is anything about housing. They do provide housing, a 2 bedroom apartment with a western style toilet and shower. They sent us pictures. That should be in here, right? How would I get that added?

CONTRACT OF EMPLOYMENT
1. *** Education and Training Center (hereinafter referred to as Party A) wishes to employ *me* ( Passport No: ) (hereinafter referred to as Party
B) as an international courses teacher in *** Education and Training Centre. The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfill conscientiously all the obligations stipulated in it.
2. The period of service by Party B shall be from October 8th, 2013 to July 15th, 2014 , with the first two (2) months set as a probationary period.
3. Payment of salaries
3. 1 Party B’s salary is 12000RMB (before tax) per month. (the least amount of handling fees 4% will be charged instead of tax in a legal approach if applicable as per local regulations).
Party B’s monthly salary shall be given on the 10th of the following working month.
3.2 The probation period is 2 month(s). During this period, Party B will receive 80% of the monthly salary. If Party B is deemed unfit for the assignment specified in the contract (for reasons of health or professional ability), the Party A has the right to terminate the contract.
Party B will be given a notice 3 (three) days in advance. When the contract expires, if both parties wish to continue the contract, the new contract period is still one year, and Party B does not have to go through the probation period again.
3.3 During summer holidays, there may be no regular classes. If there’s no work assigned, and the salary will be calculated based on basic salary of RMB 3500 per month. If there’s work assigned, basic salary of RMB 3500 per month and 100 yuan per hour will be paid. During the
winter holidays ,Party B will take it as paid leave and enjoy full amount of monthly salary.
3.4 Party A shall give payment to Party B on the10th each month as the salary of the pervious month. If the date coincides with a legal holiday, the payday is moved to the following workday. The payment is given on a monthly basis. The salary is calculated based on the standard attendance of 22 working days per month. Salary of the first month and the last month is calculated according to actual working days.
4. Party B’s Tasks and Duties
4.1 The teacher will work for 5 days a week. The teacher is to be given day(s) off later, if working on weekends. As a full-time teacher, besides class time, the teacher needs to stay in the office, the office hours are ten hours per week. The maximum teaching hours on average for each week are 20 hours. The maximum teaching hours on average for each month are 80 hours. For extra teaching hours in a month, Party B will be given 100 RMB per hour. Extra teaching hours will be calculated on a trimester basis (every three month).

4.2 Party B’s subject, class and working place shall be determined by Party A to meet its teaching requirements, and daily teaching practice will be under direct guidance by Party A.
4.3 Detailed Duties and Responsibilities
1) Accept the work assigned by Party A, Jurong Senior High School
(name of school);
2) Develop and implement lesson plans at a professional level;
3) Develop teacher grade books, including assignments and correcting students’ homework in an organized professional manner;
4) Assess and address attention to students’ individualized needs; keep regular updates re: progress records/progress reports for students during the term; and complete report cards for
students under your charge at the end of the school term;
5) Participate in extra-curricular activities;
6) Supplement, research and develop curriculum for the international education programs;
7) Participate in teacher training of teaching and learning in the international education program;
Participate in school committees e.g. Curriculum Committee, Health and Safety Committee,
Disaster Preparedness Committee, Social Committee, Fund Raising Committee etc.

9) Participate in training/being a trainer, in professional development, securing resources, team building and mutual teacher support.
10) Provide necessary consultancy and support in students’ application to universities abroad, such as college admission counseling, writing letters of references, and guiding students in writing personal statements or essays, etc.
5. Party B’s Benefits and Treatments
5.1 Comprehensive Medical insurance, health check and Chinese residence permission.
5.1.1 Party A will provide Party B with comprehensive medical insurance after the probation. According to the medical insurance provisions, the employee can go to any mainland-based hospital affiliated with the Basic Social Medical Insurance Scheme and apply for reimbursement and claims in person. Detailed information is available in the handbook
Comprehensive Medical Insurance for Foreigners and Compatriots from Hong Kong, Macao and Taiwan, and on the website www.picchealth.com.
5.1.2 Party A will reimburse the fee for health check made in the local Centre for Entry-exit
Inspection and Quarantine (express fees for health check report is not included) when Party B
takes office.
5.1.3 For Party B who passes the probationary period, Party A will reimburse the fee for Chinese residence permission in the contract year.

5.2 Party B will be paid by Party A 8000RMB as travel allowance upon successful completion of the contract.The travel allowance will be paid together with the salary of the last month .
5.3 In accordance with the laws and decrees of the People’s Republic of China, Party A shall provide Party B with all necessary documentation relating to Party B residing and teaching in China.
6. Party A’s Obligations
6.1 Party A shall conduct direction, supervision and evaluation of Party B's work.
6.2 Party A shall pay Party B on the 10th the following working month. If the date coincides with a legal holiday, the payday is moved to the following workday.
7. Party B's Obligations
7.1 Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China's internal affairs.
7.2 Party B shall observe Party A's work system and regulations concerned administration of foreign experts and shall accept Party A's arrangement, direction, supervision and evaluation in regard to his/her work. Without Party A's consent, Party B shall not render service elsewhere or hold concurrently any post unrelated to the work agreed on with Party A.

7.3 Party B shall complete the tasks agreed on schedule and guarantee the quality of work. Party B shall be deducted 200 Yuan RMB for each classroom hour on condition that Party B skips from class without any reasons.
7.4 Party B shall respect China's religious policy, and shall not conduct religious activities incompatible with the status of an expert.
7.5 Party B shall respect the Chinese people's moral standards and customs.
7.6 Party B shall agree to supply the photographs and the physical examination record, which is needed when Party A provides z visa, multi-entry visa, foreign expert certificate and full
residence permit for Party B.
7.7 Party B shall inform the related official in advance about his or her itinerary and time, if Party
B left Party B's working areas and city in case any accident occurs.
7.8 Confidentiality
7.8.1 Party B is obliged to maintain confidentiality for Party A. Party B should obey the rules concerning confidentiality formulated by Party A and is subject to supervision of Party A, including but not limited to the storage, delivery, use and disposal, etc.
7.8.2 All the documents and preparatory manuscripts marked with internal document, secret, confidential and most-secret, etc. available by Party B during work belong to secrets-involved documents. Party B shall neither disseminate them against the rules nor disclose to the third party in any manner or allow the third party to use them. The methods of
dissemination include but not limited to copying, sending e-mail, taking secret documents or articles to public occasions, talking about the secret-involved documents in public, etc.

7.8.3 If Party B disobeys the confidentiality obligation, he or she shall not only compensate the loss of Party A, but also bear the relevant legal liability in accordance with relevant laws and regulations.
7.8.4 The term of confidentiality obligation by Party B is not limited to the term of this Contract, starting from the date when party B knows the secrets-involved documents, to the date when the secrets-involved documents decrypted or enters into public information domain.
8. Management of Sick and Personal Leave
8.1 In case of sick leave or leave for personal affairs, early notice must be given two or three days in advance by Party B to the supervisor for appropriate rescheduling in time.
8.2 When taking sick leave, Party B shall present a doctor’s medical certificate.(hospital listed under the medical insurance program preferred.)
8.3 Requests for use of personal leave days must be submitted to and approved by Party A in advance. The salary in those very days shall be deducted for each day of personal leave. No more than three consecutive days of personal leave will be approved in a contract year. No more than ten accumulated days of personal leave will be approved in a contract year. If the consecutive personal leaves exceed three days or accumulated days of personal leave exceed ten days, two days of the salary shall be deducted for each day of personal leave.
8.4 If Party B is absent from work without the consent of Party A, three days of salary shall be deducted for each day of absence from work. If Party B is absent from work for more than three days without the consent of Party A, the contract will be terminated.

9. Revision, Cancellation and Termination of the Contract.
9.1 Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract with mutual consent.
9.2 The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed.
9.3. Party A has the right to cancel the contract with a written notice to Party B under the following conditions:
9.3.1 Party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out.

9.3.2 Party B fails to amend his/her job performance after receiving formal notice.
9.3.3 According to the doctor's diagnosis, Party B cannot resume normal work after a continued 15-day sick leave.
In either case stated in 8.2 or 8.3, except for the conditions in 8.4, 15 days’ notice shall be given to the other party in writing and the contract shall only be canceled after 15 days, if conditions are not corrected.
9.4 Party B has the right to cancel the contract with a written notice to Party A under the following conditions:
9.4.1 Party A has not paid Party B without valid reasons as scheduled.

9.5 Termination of the Contract:
9.5.1 This contract shall be terminated upon expiry.
Upon expiration of this contract, Party B shall bear all the expenses incurred during his/her own stay in China. Before leaving the school, Party B shall return all the teaching materials, equipment or reference books borrowed from the school library by the last teaching day, covering the replacement costs of any lost items and all outstanding and current utilities expenses. Party B shall move out of accommodations on campus in a week the contract expires.
9.5.2 Immediate Termination of the contract:
Under the following conditions, the contract can be immediately terminated, and salary will be paid only to the last day of teaching:
Party B willfully breaches the ethics of teaching, or participates in dishonest or fraudulent activity.
Party B violates major school regulations, or frequently violates minor school regulations.
If Party B fails in assessment for working performance, Party A will terminate the contract with a notice 20 days in advance, providing transfer or dismissal. Party A will not shoulder any liability of compensation.
Party B provides false information on the resume or fails to disclose full Chinese employment

history.
Party B provides false educational documents or credentials.
Party B works for someone other than Party A designated in this contract.
Party B receives 3 formal written warnings.
Party B fails his or her health examination or Party B’s application of work permit, foreign
expert certificate and residence permission is denied by Chinese government due to policy
changes or events beyond control.
Party B is absent from work for more than three days without the consent of Party
A.
10. Breach Penalty
If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the Party concerned and 30 days’ notice shall be given to the other party in writing and the contract shall only be canceled after 30 days, obtain Party A’s consent, and pay its own return expenses; Party B can’t cancel the contract without Party A’s consent. If Party B insists on cancelling the contract, it should pay its own return expenses and pay a breach penalty of two months’ salary to Party A.

11. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends.
If either of the two parties asks for a new contract, it should put forward its request to another party 90 days prior to the expiration of the contract, and sign the new contract with mutual consent. Party B shall bear all expenses incurred when staying on after the contract expires.
12. Arbitration
The two parties shall consult with each other and mediate any disputes, which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts’ affairs in the State Bureau of Foreign Experts and ask for a final arbitration.
13. Non-Competition
13.1 In this contract, the ‘Non-Compete Period’ is defined as the period beginning on the day that the Employee’s employment is terminated, whether by the Employer or by the Employee, and ending on the day that is 60 days thereafter.
13.2 The Employee agrees not to work for any business, school, entity or organization that may

compete directly or indirectly with the School, or which may affect the operations, legal or financial status of the School in any way, during the Non-Compete Period.
13.3 The requirement in sub clause 13.2 above will not apply if either:

13.3.1 The Employer terminates the employment of the Employee, whether with or without notice,
prior to the End Date of this contract; or
13.3.2 If this contract terminates on the End Date
14 Background Verification
14.1The Employee hereby authorizes the Employer to conduct such inquiries and searches as are reasonably necessary to verify the Employee’s educational and professional qualifications and experience as previously represented by the Employee and on which the Employer based its decision to employ the Employee.
14.2 The Employer is entitled to contact and use the services of any third party to obtain the verification described in sub clause 14.1 above and the Employee’s signature on this contract should be taken by such third party to be the Employee’s consent to obtain and release such information to the Employer.

95% of the content of these SAFEA contracts is identical regardless of the job and I'm too lazy to read the whole thing, why not just post and ask about the parts that concern you. At least edit out the Chinese to make it easier for people to read.

Read the appendix to the contract. It's probably in there. If it's not, ask about it. |

I think probation periods are generally frowned upon here as it's an easy excuse for them to fire you. My contract does have a specific section for housing and utilities. |

Frowned upon, perhaps, but every contract I've ever seen here has a probation period (usually 30 days).

Javelin of Radiance, I just edited out the Chinese. Thanks for the suggestion.
I was wondering about that 4% too. It says:

So I guess that means they may or may not charge it? The salary is still good whether or not they take out the 4%, but obviously I wouldn't want to pay it if it wasn't necessary. Does anyone else pay tax or have a fee like this? |

as far as i know, the safea contract cannot be changed. is this a genuine
safea contract? or have they cut-n-pasted their own from various bits?
normally, a school would also include an appendix to cover anything not
spelled out in the contract. you would make changes to the appendix
and send it back to them, adding bits about housing or getting an insurance
allowance instead of the standard policy or getting a flight allowance instead
of reimbursement. and so on. if they agree, they make changes to their
master copy, re-send to you for signature. |

The only way that anyone can be sure if it is a real SAFEA contract is to see the registration numbers. (One won't be able to see them until he sees the actual contract upon arrival). A real SAFEA-sanctioned contract will bear the registration numbers in the right-hand corner of the front cover. The numbers are printed in red. I've seen only two bona fide SAFEA contracts in nine years. Bona fide or not, whatever the terms to which the FTs agrees to are legally binding AFAIK.
The bit about the 4% handling charge and the tax is really fuzzy here. Will the school remit taxes for you, or will you be expected to remit them yourself? If you cannot provide proof of paying your tax obligations, you MAY run into trouble when you do your banking or try to convert rmb to dollars (or whatever your home currency is). Not everyone experiences such problems over taxes, but I have experienced such problems. It's not fun. Get your prospective employer to spell it out that HE will remit taxes AND help you set up a bank account.
You also need to know whether the employer will pay you in cash or deposit your salary directly into a bank account. Payment in cash may be a dead giveaway that the employer remits no taxes.
I see nothing about the housing. Make sure that it's covered under the contract.
I see nothing about who is responsible for paying the utilities. Get that spelled out.
Re: Flight reimbursement: SAFEA contracts that I have signed stipulated that the FAO is responsible for acquiring the plane tickets at the end of your contract from a governmental agency. Most FAO's try to avoid this by offering an allowance or reimbursement because the governmental agency rapes the school over plane fare.
Unless you speak Chinese, you may run into problems when the time comes for you to purchase your plane tickets out of the country. In major cities, that's not a problem because there's always someone in the travel agency who speaks English. Purchasing your own tickets SHOULD give you frequent flyer miles to use in the future if you have already established an account with an American airline (or a European airline that participates in the FF program).
Regardless of whether you accept reimbursement for purchase of tickets out of china or accept an allowance, BE SURE that the amount will pay for transit to your point of origin. Make them put it in writing. Don't accept any amount of allowance if it won't get you all the way there and all the way back.
Make sure that you will be reimbursed for your flight from your point of origin to where your school is located, and BE SURE that there will be someone at the airport to pick you up when you arrive and that there will be someone to return you to the airport when you leave. This should all be part of the contract. Don't accept "Oh, don't worry about that." Make them put it in writing.
An SAFEA contract spells everything out from beginning to end of contract and includes all provisions such as accommodations, utilities, airfare, end-of contract travel allowances (not much). This contract seems a bit fuzzy to me and doesn't address all of the provisions which it should.
An SAFEA contract addresses the maximum amount of cash that you may convert to RMB on a monthly basis. At one time, the FEC was used to track banking transactions, but IN MY EXPERIENCE the FEC seems not to be recognized as official proof of legitimate employment or as a document of any importance until someone asks to see it.
If, when you arrive at your destination, you are confronted with yet more paperwork pertaining to your employment, ask for time to consider the terms a week later. You won't be in any shape to consider further amendments to your contract for a few days. There's nothing necessarily sinister about these post-arrival amendments. They usually indicate that someone waited until too late to consider the changes to the contract. You won't be bound by them unless you agree to them. Don't feel obligated to accept any changes or additions after you arrive. You may not encounter such a situation. I am mentioning the possibility because I was hit with a couple of changes to the contract immediately upon my arrival at one school, one of which was that I could not change RMB to dollars under any conditions. That told me that the school didn't remit taxes on my behalf. I didn't make a stink about it. I just crumpled that paper up and threw it away in front of the FAO. From then on, the FAO had a different teacher make the conversions for me every other month.
As Choudoufu points out,there should be a provision that stipulates that the contract may be changed by amendment. Usually, at least some amendments accompany the contract. These are the changes to the SAFEA contract, and if you accept them, they become binding.
These are all things that can be cleared up quickly and simply, and the school's failure to address them isn't indication of anything sinister afoot.
Post script: You get provisions added by asking for them. You'll get, "Oh, of course that's included. Nobody has ever asked for it in writing". Be the first. Start off in a businesslike manner, and when you arrive you can drop the hard@ss attitude.
Chinese don't get out much. They fail to understand what it's like to make leaps of faith for people whom they've ever met before and after traveling 8,000 miles to live in a foreign culture that expects you to accept the ways of their world immediately upon your arrival.
It isn't the big things about living in China that'll drive you absolutely wall-banging crazy. It's the small things, in particular the aggregation of small things that'll make you wonder if you should pack your bags and pull a runner some Friday night. They can usually be worked out. especially if you make an effort to establish a rapport with the those who are really in charge. You may not find out who is really in charge of things until you have been at the school for awhile. Some day, you may learn that a cafeteria manager has seniority over your FAO and has more influence over the daily operation of the school than the FAO.
Just make sure that your questions are addresses in amendments to the contract. Look at it this way: Your employer wants no trouble, so as long as your requests are reasonable, your employer may actually consider your questions as help toward making his contract airtight and more easily understood.

Contract says that the first 2 months are at 80 percent. Do they give you back the other 20 percent? I don't like the sound of that
I did not notice housing.
80 hours and 10 office hours are fine, but the extra can be a ton of time.
How much time is winter holiday? One month. Two weeks? Some times the teachers have to be in a few days before the students.
8000 airfare added to your last pay will be taxed high.
Tell them to put the housing in the contract. Where is it? How close to the school? If utilities are paid by you they can be high.
You see pictures of the housing, But will the furniture be there for you? Rice
cooker? Microwave? Blankets?
Also others have said, make sure what ever tell you, have them e

Overtime paid every three months? Is it voluntary or mandatory?
Have it changed to paid in the current pay period otherwise you can get shafted on OT by them saying well this month you did less than 80 hours teaching so we subtract it from that 100 hours you did 2 months ago. |

With respect to a labor contract with a fixed period of above three years or without a fixed period, the probation term thereof shall not be in excess of six months.

Article 20 During the probation period, the salary of a worker shall not be lower than the minimum salary for the same post of the same employer or not lower than 80 percent of the wage as stipulated in the labor contract, nor may it be lower than the minimum wage of the locality where the entity is situated. |
Your contract is from October 8th, 2013 to July 15th, 2014. That is less than one year. You cannot be held to a probationary period that is more than one month. The amount of pay during that period is legal tho. |

don't bother quoting labor 'law' to an agent or recruiter or manager or
chinese person. that'll get you as far as quoting the constitution to a
tsa goon with his latex gloved hands in your undies.
just decide what is acceptable to you. tell whomever the changes you
'would like' to see made. if they agree, then sign. if they don't agree,
move on to one of the other 100,000 teaching jobs in china. |

Maybe not but it is still good to know when they ask you why it's unacceptable for you. |
