|
|
I have what I think is a rather naive question, but I'd still like some feedback. My Z visa is valid until August. However, I am leaving my university employer at the end of this semester (and my contract expires on January 21st). I have a number of options where I live for employment, but don't want to rush to sign anything until after CNY, if possible.
So, here's my question: am I legally able to reside in China after my contract expires later this month, as long as I'm not working for anyone else? I'm not sure exactly when my RP will be "canceled" by my university, so I'm sure that will factor into things as well.
Thanks for any pointers. I'm thinking I'm legal until my former employer, the university, decides otherwise. |

I would talk to the uni about when they will cancel your RP. They don't need to cancel it straight away, and mine have always run on for at least a few weeks after the end of the contract, to let you organise leaving the country or move to another employer I guess. If they cancel it straight away, you could get a married persons visa, since your married to a Chinese national. Your not allowed to work on that visa, and I'm not sure what the situation would be regarding using it as a replacement for a new Z visa, could you get another FEC and RP without leaving the country I mean, but it would cover you in the meantime. |

I went from a Z to a 'married persons visa' in-country, but I was not able to go from that back to a Z without going back home to get the new Z, so I'd say getting the that would be a last resort. Z to Z can almost always be done in country, so that is better. |

What am I missing here?
The OP doesn't mention being married to a Chinese national, and auchtermuchty advises against applying for a Z visa because it would required him/her to leave the country, then auchtermuchty says that a z can almost always be done in-country. Huh? |

your z visa was cancelled when your RP was issued.

you mean a tourist visa? they've got the new Q1/Q2 family reunion visa
now, not sure if that would apply.

If you get another RP before the old one expires or is cancelled you are okay with the same visa. |

What I mean is transferring a working permit from one employer to a work permit from another employer. People refer to these as 'Z visas' as that is the visa someone coming to work here enters the country with. I apologise for the obvious confusion this caused you.
I advise against changing the current visa status (working permission) to the visa/residence given to spouses of Chinese citizens, as it is awkward to then go back to a working permit when you get another job.
The OP didn't say he was married. I assumed from doogsville's response that this was something the OP had said on another thread. |

T'was indeed.
Choudoufu, those of us married to Chinese nationals can get a 'spousal' visa, which lasts for a year at a time. It might as well be a tourist visa, since you can't work on it, but it is multiple entry. |

I am married to a Chinese national, as expressed in another thread.
Sorry for misspeaking...of course I meant the RP. Didn't this it would be that nitpicky.
Uni. says it's cancelled on the day the contact ends, Jan. 21st. Guess I'd better get to pounding bricks then... |

They're going to cancel it on the day your contract expires? They don't sound very nice. |

for those of us considering the 'ole frontal lobotomy, could you tell us
what kinda visa you have? i've heard the term "spousal visa" used for,
emm, the visa that, uhh, spouses have.......but it turns out just to be
an ordinary tourist visa valid for a year.

not intending to pick at nits. the terminology is confusing and often
misuseded. i know you prolly meant RP when you wrote visa, but the
new guys reading this expect their z-visas to be valid for a year or
length of contract. anyways....how come they gave you an RP expiry
6 months past your contract end? |

@ chou: I decided to leave after the first semester, which ends on Jan. 21. Contract was August-August. With three months' notice it was no big deal.
Yeah, they said my RP would end on the day the first semester ends, but let's see. That would be pretty heartless, no? (That being said, it's a HK operation...heartless is their middle name!) |

okay. but it seems in your original contract, the semester would end
around the first of july, yet your contract and rp would run until
sometime in august. pretty heartful!
of course since you decided to terminate the contract you obviously had
something else planned. no point in them being responsible for you any
longer than necessary. no big deal. |
