Hi guys. I'm coming up to the end of my first year in China in March and have just started looking for a new job in a new city (Wenzhou*).

One thing I've been wondering though, is how to tell whether or not an employer can legally hire foreigners while in China, since this time, I don't need to get a Z visa and only need a work/residence permit now (right?). It was easy when I was back home, because if the employer couldn't send me the documents I needed to apply for a visa, I could just ignore them, but I didn't see a single document for my residence permit for this until I was actually IN China.

Are there any documents that they should be sending me if they are actually legitimate employers?

My understanding is that when you have a Residence Permit you can do three things:
1. Renew it with the same employer.
2. Transfer it to a new employer.
3. Let it expire and leave.

If your new employer is legit, I think they will need the paperwork to transfer your RP from your current employer. This isn't a big deal, but it's something that they would need to do with your current FAO. Someone can correct me if I'm wrong about this, but I think they require two things from your current employer, a letter of recommendation and a transfer form of some sort that basically says that you've completed your contract.

I'd ask them specifically about transferring the RP.

When should my current school start dealing with the paperwork to transfer me? Does it have to wait until my current contract is up, or can it be done before? My school is actually quite quick with things like this in general, but my residence permit expires like 1 week after my contract does, so I don't know if it will be a problem.

When a past employer did it for me they took care of it a month or two ahead of time. They wanted it done so they could go on vacation.

You might search on here for "release letter". I think that's the first document I was trying to think of.

I did such a transfer although it was 10 years ago.
The old school tried to get cute over the transfer letter but I found the new school was my best ally.
They had a tier one status and the old place was a vocational and from what I gather new school just leaned hard.
My message is don't fight the letter bit yourself. Leave it to the new school to fight that battle.
Of course it may all go smoothly but I agree that it should be done sooner rather than later. The Winter break is more important than summer to Chinese and they won't want to delay their holiday time.

If you are legal in China, do you give your passport to your current school to cancel the residence permit?

Just ask your new school to speak with one of their foreign teachers and ask to see his foreign expert certificate. If they do not even have one teacher who will oblige, then you should be weary, either that they don't have an FEC license or that not one of their teachers is willing to help them.

If this is about me, then I did not make myself clear. I have no problems with the new school, it is my current school giving me problems.

Now they say they cannot let me go because they do not have a replacement. But I asked how much notice they want, they said 30 days, I gave it.

A lot simpler than that (if you can read Chinese). There's a list of employers allowed to hire foreigners.
