Hi everybody,

I won't be returning to my current place of employment because we didn't agree on the terms of the contract.

Is it normal to be asked to write my employer a letter of resignation even though I'm technically not resigning but rather not returning for another year/renewing my contract?

What are the legal ramifications of doing so rather than doing nothing about it?

Most important, how long have you been there? This could affect severance terms.

What kind of institution? If a university, go and find someone in the Law Faculty to ask...

NOT normal to ask for this letter...the mere fact that they ask for it means that they are trying to avoid some sort of legal obligation.

Yep good point, if you have worked for a year or more and intend to work in another school a letter of res from you means you were not dismissed!
Makes a difference apparently!

I'd write the letter of resignation stating clearly (but objectively) the actual reason/s I'm not returning.

I've been there for a year.

It's a primary school.

But how would other schools know that I wrote one or not?

Here's the exact quote of what I was sent:

I need your resignation letter in order to continue for some formal regulations.


Here's what I'm thinking... I can write the letter but only hand it in to them after they deposit my last paycheck in my bank account.

I wouldn't. The contract ends, that's it. They want the letter to bypass something...return ticket? Or, some other commitment they need to meet.

At my school the actual legal contract goes Jan to Dec, even though they hire the teachers from Sept to June. The uni asks for a letter of resignation because on paper the contract isn't finished.

I'm guessing your university didn't give you a work visa from September to December, i.e., they made you work illegally without benefits, right?

Work visa goes Sept to Sept. I donno why the contract is different.
