Anyone here have to file any kind of tax reports with the Mexican government? I didnt worry about it last year as I didnt work here that long and didnt make enough. They have been taking taxes out of my pay, so I'm not worried about owing money... Im just wondering about paperwork (guess that is my "IRS" mindset nagging me Laughing )

That depends on if you have an FM3 or not. If you do, then you are going to have to file a return. If not, then unlucky you, the school is taxing you for working under-the-table

Guy, doesn't it depend on whether one is paid nomina or honorarios? When I was paid honorarios, I had to file taxes quarterly. However, on nomina the university takes care of all my tax dealings with hacienda.

I do have an FM3 and I am paid nomina. Lucky for me, while at times the Tec has been somewhat incompetent, it hasn't tried to screw me. Im not looking to get money back... I know better than that!!!!! just want to do what I am supposed to. Talked to one person in tesoria today but she was not helpful, neither was my immediate boss. Oh well, will just enjoy my next two weeks off!

As I understand it, if you work nomina you don't have to file, that's what we were all told at the Uni. in the BC of the A's. Told by the university, not the other teachers.

If you work honorarios you owe 5% IVA above what has been withheld, and either owe or are owed ISR (a.k.a. Income tax) depending on how much you earned. You are legally bound to file quarterly an annually, the forms are a major headache to fill out, but you can get them dome free at the SAT office that covers you, in Mexico City that may not be the closest one, so check before going. Around tax time there is an enormous queue, I had to wait almost 3 hours on the two occasions I went, to the office in Rio Consolado, near PEMEX, even though I lived in Col. Morelos.

It was such a hassle I stopped paying taxes, thereby depriving the government of much needed funds. When I started working nomina I was a bit concerned my tax-delinquent status would show up, but it didn't, despite using the same RFC and CURP.

PS I wouldn't tell you this, but I'm already out of the country, LOL.

If you are on the n�mina of the institution, the responsibility for taxes being deposited with Hacienda is the employer's.

I work mostly on honorarios...we've always worked monthly, then an annual summary. I think it depends on the bracket.

One of the "rules" in Mexico seems to be If you don't ask, nobody will bother to tell you. Lots of information that should be made common knowledge is maintained as best kept secrets.

Are you sure that taxes aren't being withheld from your pay? If you haven't been asked to get a special booklet of receipts printed up, which include your name and other information about your own hacienda file, then your employers may well be withholding taxes and taking care of your dealings with hacienda. If you're being paid on honorarios, meaning you pay your own taxes, your employers need to fill out or at least sign one of those receipts each time you're paid. At least that's been standard procedure wherever I've worked on honorarios.

Foolish question because you probably don't have them yet, but what does it say on your contracts? Along with how much you're getting paid per hour, it should say on your contracts whether that pay is on n�mina or honorarios. By the way, you may never see an official contract from the private language school, even if it's listed on your work visa, but the Tec should eventually ask you to sign a contract if it hasn't done so already.

I have no idea how things function at the private language school where you work, but at the Tec you should be able to talk to their accountant to find out what you need to know. If it's a large campus, they should also have an office of recursos humanos and/or an administrative director or something similar, where you could also get the information you're looking for.

I may be wrong herre, but as a starting point, if you have to provide a Recibo de Honorarios when you get paid then you are on honorarios. You need to have your own personal recibos printed at an approved printer with all your own data on them.

If you don't use these, then you are probably being paid under the table, or possibly somebody else is providing a recibo, in case they are responsible for the taxes. This is illegal, it's like using somebody else's Tax file number to evade your fiscal responsabilities.

Or of course you may be working nomina, especially if you get aguinaldo.

If you feel bad about not paying taxes I would ask your job's pay officer, asking at the tax office is likely to get your employer in serious trouble if all is not above board, and you may find yourself also in trouble, both at work and with Hacienda.

The letter that you took to Immigration to get the FM-3 should have specified your salary and status.

If you didn't have any taxes withheld something is wrong. You should have a "recibo de n�mina" that you SIGNED and received a copy of when you were finally paid. It should indicate your gross and net pay.

If you are paid on n�mina you do not have to do anything in regard to taxes.

In most places part-time folks like you have to provide "recibos de honorarios".

My guess is that you are being paid under the table--and if they deposited money in a bank account then you are on n�mina, as Mike suggested, under somebody else's name.

You are being paid honorario... all part-time teachers at Tec are paid this way. Even part-time teachers get something in the way of an aguinaldo. You may not have had anything taken out this year because you worked for such a short period of time.

You and I both need to go to Juridico and investigate what needs to be done. Latest rumor I heard from work is that you dont have to worry about filing a report (remember I already have withholding) unless you make over $300,000 MN. But Im skeptical.

I really doubt Leslie is being paid under the table ... Tec generally does not work that way. They require FM3's (however if you did any work for them BEFORE you got your FM3 (as sometimes happens), consider that "under the table" My campus has done this but they got in hot water with Hacienda so they have tightened up considerably since last year when I was hired.

Leslie ... if you have your work ID # and Tec email password (which you should since you have your FM3), you can log on to your campus's web site and look at your recibos If you have an IMSS # or other govermental ID # ... youre in the system. But working there only a couple of months I doubt you made enough to be worried. I didnt file anything last year because I was told I didnt make enough and I worked 4 months, full time.

But I will check when the campus reopens and post what I find out.

OK I finally got some kind of answer to my original question about whether or not I need to file a tax return or "declaracion" in Mexico. According to human resources at my school (Tec de Monterrey) - I dont have to file anything unless I make over $300,000/yr (not a problem) or need to take a bunch of deductions (like medical expenses) - also not a problem. Since Tec takes out my taxes from my salary... I dont have to worry about anything concerning Hacienda.

Course I have to take care of business tax return-wise in the States. At least this year I have lived the required 330+ days in Mexico and dont have to pay US taxes on my Mexican income.
