Hi, I've been thinking of coming to China to teach for a few months. The story is I contacted one school because I liked what I saw and they sent me a copy of their contract to teach. All ok except one little clause. In short they would want me to resign a contract for the next semester 90 days before the present one finished. Bit hard to know that so far in advance, evan more so for a first timer.

Question, is this standard practice on all ESL teaching contracts?
Would they give me 90 days notice if they wanted to sack me?
or are they just trying to get commitment for the next semester?

As far as I can see (from what I have read on Daves) you would not get 90 days notice if they wished to sack you.

We have three new Teachers here from the U.K. They just started teaching this week and they signed their contracts today. They were told that they would have to give 90 days notice of their intention to leave or stay - by next Thursday! Because they are only here for three and a half months, they have virtually no time to make up their minds if they like it or not before they have to tell the School.

It is crazy I know, but I think the School needs time to find replacements prior to 15th June as the School will be closed for about 10 weeks - and they need to line new teachers up prior to the end of this Semester.

The new Semester commences on the 1st September.

I think there is nothing to worry about here.

This is a standard clause in our contracts, I believe (it is in mine). It is only there so that you have a timetable for initiating the whole process of re-signing with your school -- which is a lengthy one. It does not mean that you cannot re-sign with your school within 90 days of your contract's expiration, and it has nothing to do with advance notice of dismissal.

If your school wants you to resign with them, anytime after that 90 days should be OK (though they want to know as soon as possible because they have to re-apply for all your papers). I re-signed only 4 or 5 days before my first contract was due to expire, and I have the ame clause in my contract.

Remember that if something is vague or unclear to you, you can always ask them to make it clearer in writing -- and everything is open to negotiation. Good luck!

I was wondering how this works as well. I would like to work at my school again next year, but was not sure how this whole resigning a contract works. Would appreciate any advice.

What! It's really very simple.

Your school should start dropping hints about wanting you back as soon as possible (assuming you haven't completely fucked things up during your stay). Anyway, once you agree to return, they will be absolutely delighted! Well, at least relieved that they don't have to find another damn foreigner.

You will have to surrender your passport (including Temporary Residence Permit), FE Certificate, and degrees (BA and TEFL), because they need the latter to re - apply for all of these papers. These items (now renewed) should be returned to you shortly. You will also have to go for another Health Examination, at a hospital approved for handling foreigners (likely in your provincial capital). Once that is completed, and you have your papers back, you will be asked to sign another contract.

So it's basically like starting over again, I think -- minus the heady banquets, mercifully there won't be anymore of those drunken rambling feasts. At least there weren't in my case, thankfully.
