The Ministry of Education's advice to school boards in Feb 2005 was that they should stop using gyomu itaku and use the JET Programme or direct hires. You can find part of this notice at www.nambufwc.org in the "ALT/Outsourcing Issues" section.

Illegal dispatch companies and the BOEs that they service are leaving themselves open for legal and financial penalties if they continue with things as they are. Eventually all teachers will be legally dispatched and then hired directly when the legal dispatch period ends. The problem is that most illegally dispatched teachers don't know that anything is fishy. Until the majority of them know that they are being cheated, things will remain the same.
