Jester, my understanding of the word 'whining' may vary from your own, but to me it means someone who complains. I think that you may in fact be thinking of others when you use this term for me as I don't think that any of my posts here could be categorized that way. Lengthy, informative, opinionated...yes, but whining or complaining...I don't think so.
Jester you say that you are new here. I suggest that you take a deep breath and stop trying to promote yourself by putting down others. This is a forum for work related discussions about teaching in China. If you have something to offer the discussions then please do, but if your only aim in being here is to attempt to insult others then you will probably find that you will be labelled as a troll. |

No offense Clark but IMO Killjoy is absolutely right.
I don't see anything in the OP's comments that indicate he's violated the contract.
The school on the other IMO has been in violation of the contract from day one by not supplying the OP with a residence permit that carries through to the end of the contract.
I have 4 months left on my current contract. I'm in the process now of shopping around a bit. May stay with current school, may go, nothings been decided. But if I took an offer tomorrow and signed a new contract starting on say September 1st and running a full year. I would turn my paperwork over to the new school, they should immediately begin processing it and I would expect to get my Passport back in a few weeks with a new Resident Permit in it good until at least September 1st of next year. If it wasn't returned to me in this manner I'd have a problem and would ask to have it dealt with before ever working a day for the school.
I'm not sure if it's a rule or not so please don't quote me on this but I thought I'd heard that the Residence Permit is supposed to run 10 days beyond the completion of the contract in order to give the Foreign teacher some time to make their next move and stay legal while doing so. This is certainly the case with my current permit. contract expires on Sept 1st, while permit is good until Sept 10th. Hell who know this is China and things tend to differ from Province to Province.
Those of us that are currently under contract are in a much better position to negotiate and ensure ourselves that we are where we want to be and everything is up to snuff before accepting our next contract. If you think you're not going to renew don't wait. Get busy now and start working on that next contract.

I wasn't aware that the resident permit superseded the Z visa. If your Z visa is still current you can work the last 2 weeks without the resdident permit can't you? I would continue working to the end of the contract regardless of the resident permit expiry date. Then you have fulfilled your contract and should get paid. After that you can choose to go home or move to anothert city and renew your resident permit there. But don't take my word for gospel - my school was thoughtful enough to have the resident permit expiry date after the contract expiry date. However I was working for the first 6 weeks without a resident permit. Is this illegal? The FAO seems to be nice and willing to meet your needs all you need to do is fulfill your contract regardless of the resident permit. They cant withhold your pay if you have completed the contract with or without the resident permit. that is the schools fault that the permit expires before the contract has ended.
I agree that you should not discuss your intensios of leaving until you have been paid. The chinese way is to leave everything to the last minute so play their game. Dont tell them you are leaving until you get your travel allowance. Even then you can say that you want to go home. They will not know if you plan to move to another city and sign a new contract with a different school.
As for trying to find a new FT for them - let them sort it out. It is not your duty to find a replacement if you decide to leave. Your duty is to complete your contract. then they can't legally withhold your pay for any reason, regardless of government regulations. The red tape that goes al;ong with you working in china is out of your hands. They can't say that because your resident permit has expired that they will not pay you but they can say that you did not fulfill your contract if you choose a midnight runner or stop work because of the permit.
All in all - COMPLETE YOUR CONTRACT that is your obligation. |
