if you want to cause heat..go to the tax office that is the reporting station of tat area....ask them for an official tax receipt and find out if tax has been paid or not..then if not..the tax office can try and collect the tax and may do an investigation.

I tried to get some help from the local police. Not any given.

Who should I contact for assistance?

it says right in your contract who to call for assistance - you go to the arbitration board listed if there is any disputes. At least in your contract they tell you who is responsible for arbitrating your case.

i have tried many times to get this company BYD Company of Shenzhen to give me my money but they will not.

Arbitration is too long of a process.

i tried posting my story to some other sites, some work some don't.

In any case, really stay away from BYD because they are cheaters and liers.

I for one think you have done the right thing by sharing you experience here.
Although you quite possibly will not get your money, at least you have some peace of mind with the knowledge that will have some difficulty in finding a replacement.
My advice, don't sign a contract that appears to have come out of a cornflakes box.

I'd add to this:

Make sure you are working within the law if you want protection under the law. If you are working illegally (either by choice or ignorance) you are going to find getting any justice just that much harder.

Clark, I see that you know those Chinese laws well Laughing

Contracts in China are tough to deal with. Many Chinese employement contracts for foreigners are twisted, purposely ambiguous, misleading etc. Some of those contracts seem to have come out of their rice fields rather than that "cornflakes box" that James've suggested. Just have a look at the SAFEA one and see the Chinese English in it protecting the employers and forgetting to mention the employees...well it does have a clause where the employee is to pay a penalty for breaking it. Wink

Now, it might not even be important whether the employer has got a licence to hire foreign teachers as long as he/she can get you that Residency Permit for purpose to work in China. Wink
Laws in China are just like the Chinese Contracts at times. Crying or Very sad

So it appears that another teacher is cheated by an employer in China...
When will the cycle ever end?

Is there a moral to this story?

Yes, I guess... The Chinese always cheat whenever they can. BYD Company is no different than any other employer - they will cheat whenever they can and cheat cheat cheat all they can get away with...

They "might" sue you sounds like an empty threat to me to get you to shut up and stop embarrasing them. If they actually could make something of it and get more money out of you then they probably would and you'd be dealing with a lawsuit now.

I've been "defaming" a certain Global ChinaTEFL located in Hangzhou for years now when they ripped me off for a couple of thousand yuan and they threatened to sue me as well, nothing ever came of it so I wouldn't worry so much and keep doing what you're doing. If they do contact you again, tell them you'll stop once they pay you what they owe you (or maybe not because that seems like a lost cause by now).

Been there, done that.

After dishing dirt on a certain school in Zhuhai, I recieved a "formal" letter of pending libel action.

I was asked to retract everything I said on this very same forum, which I did. But it was too late. The damage was done.

The school in question has not recovered from the shock that was created by the many disgruntled teachers who wrote negative reviews at that time. Somewhat predictably, the school has never tried to backtrack and admit its previous faults, but has continued to slide, with the main protaganists still very much part of the organisation.

I have followed this thread for a while, especially since I work in Shenzhen in a similar field (business English corporate training), and I originally had mixed feelings towards the legitimacy of your claim, since they did not seem that outlandish. However, such cowardly actions as sending fictitious letters of libel, simply do nothing but confirm that the people behind BYD have no right to operate.
