I'm working at Hess, and three superiors have watched my lessons and evaluated me. One of them didn't like my lesson, one thought it showed improvement and wasn't so bad, and the third, I still haven't heard back from.
My immediate supervisor has already told me that I shouldn't count on having this job after the probational month is up -- it's "up to me." Well, I've done my best, and they'll let me know on Thursday whether I'm fired or hired.
Let's suppose I'm fired. Here are my questions:
1. Do I have 14 days after they report the firing to get out of Taiwan or find a new job, or just seven?
2. If I have to leave Taiwan, will it be easy to get another 60-day visitor's visa and come back? Or will the Hong Kong visa office know I'm just going back to get another job and refuse me one?
3. What should I say to interviewers? I mean, on one hand, I was fired, but on the other hand, I already have a visa and can start working immediately. What should I let on in interviews? |

Rooster,
Not sure about what the law says. I've got it in my head that your ARC is revoked immediately if you get fired. I won't take a bet on that though- but it's probably maybe 7.
Don't go to HK for a visa run. They are difficult customers to deal with. Look at Thailand. Don't know if Macau has such services , but that's probably also an option.
In interviews just say that due to unforseen circumstances, you were let go from your old job. But don't downplay Hess,or bad mouth them or anything like that. You don't want to drag a negative experience with another employer into interviews.
That being said...Hess should have a valid reason for "firing" people. But I'm not sure if during the probabtion month if they have free rain in that area. No employer can just let you go, without there being proper documentation for it. But maybe, during probation things work differently. But shouldn't there still be a valid reason? Like conitinously being late, or teaching when hung over or at least something. Being given a reason that you are not "shaping up" just doesn't sit well with me.
This is off topic - do you know of the yahoo group "Kaohsiung Living" ? IF not, get on there. Loads of positions are advertised on there. DO a search on ConnectKaohsiung to find them, if you're not part of it already. Can also find other things on there as well.

Sorry i dont know the answers to your questions but not passing a probationary period is NOT the same as getting fired.
I always look at the probationary period as a two way street, a getting to know you period, I like it because i might decide i dont like the company and i can leave the job without having to quit.
I would not even put a one month job on my resume.
I didnt pass a 3 month probationary period at my last job, but honestly, I wouldnt have accepted the position if they had offered it not because they were bad or i was bad, it was just too inconvenient for me to drive so far for the low pay they offered.
So i will put on my resume that it was a summer post and the school will give me a fair recommendation if anyone calls them.
perhaps you can do the same thing. |

Thanks man, I guess I can look at it that way.
I got a "Notice of Termination of Contract" today.
They have real brass balls, I'll tell you.
They said I had to pay a 20,000 NTD fine if I worked for another employer EVEN THOUGH IT WAS THEM WHO WERE FIRING ME!
I refused to sign the piece of paper and finally they caved and agreed to take that part out of the document.
Can you believe an employer would not only have the brass balls to string me along and fire me at the end of probation, but THEN tell me that if I worked for anyone else in Taiwan, I'd have to pay upwards of 700 American dollars? Incredible.
I understood full well before working for them that if I QUIT I would have to pay this fine, but I never signed a contract saying I had to pay it if involuntarily seperated! Jesus Christ!
Fortunately we took care of that one in the room where I was cut off...
I have to work at Hess for another week and find a job within the next ten days. |

| ARC's are supposed to be transferable, its the law, but your school not tell you that or help you out with it. I dont know all the details but maybe you can find someone who does. |

Wh-wh-what?! That sounds crazy, even for here.
The contract with my school states that full-time teachers can't work for the competition within a certain radius of the school (understandable), but that's while still working for them. How could anyone make you pay a fine if you're not working for them anymore? Especially, as you say, when they're the ones terminating the contract.
I'd like to hear 123Lotto's take on all of this.
In any case, I'm sorry you're going through this. In the long run, however, it'll work out to your benefit if you eventually end up in a better situation. Chin up! |

I believe that clause has been struck down in a court of law. HESS tells many lies to control their foreign teachers. They mainly hire newbies thus they don't have to worry about them actually knowing the law. |

You could have signed the paper. It would not have stood up in a court of law not to mention why HESS would bother suing you. I really doubt it is worth their time an effort. |

I didn't sign the paper, and eventually they grew tired of waiting and crossed out the clause. Everyone initialed next to the crossed-out part and now I don't have to worry about paying the Hess fine.
So now all I have to do is find a job in the next nine days and get my paperwork submitted. |

As a word of advice, if you didn't do your health check already you better get to the hospital first thing Monday morning. You cannot submit the papers without a new health check unless the old one is less than three months old.
It take seven days to get the health check back. |

The old one is just two months old. Glad I ignored everyone's advice to "do it first thing," or I might have to do it again.  |

HESS could allow you to keep your work visa thru them for longer than seven days--if they wanted to.
However, that doesn't seem like it will happen in this case. This one month probationary period is totally an invention of Hess, as far as I know. When all of your paperwork was submitted to the government, a signed contract was presented that said you will work there for a minimum of 14 hours per week for a one year period.
I really think you should post your question on forumosa. Some guys there have been on the island for decades. They would certainly have some comments about your situation.

Yes, Rooster could even file a grievance with the labor board. You cannot be forced to leave Taiwan until the issue is resolved. By that time you would have a new employer. |
