I received the following response after contacting someone in SAFEA's training division:

For a foreign expert wishing to remain employed in China for a period of longer than 5 years, the employer can sponsor the foreign expert's Chinese social security, thus bypassing China's governmental limit on one foreign expert's stay. Previously, there was a 5 year limit, albeit not enforced in every case and without explicit recourse. The modification here is a specific provision for employer sponsorship.


So apparently, if we're paying into China's social security system, we can be exempt from this five year guideline. To be confirmed!

In Henan Province the law requires a 6 month leave after five years, after which you can work for another 5 years, until age 65.

I'm now in my 6th year at the same school after coming back from my mandatory leave. You don't have to go home, leave the country, or anything else, you just can't work in the Province for 6 months.

Nobody I've talked to can provide an answer for why this law exists.

There are some explanations earlier in the thread Greg.

I've started paying Chinese Social Security, and have applied through the 人力资源发展促进中心 or Human Resource development promotion center for a Social Security Card - which has been granted apparently. So according to the above advice this is a way to get around the five year guideline.

To get a foreign expert certificate does the school need your degree or do SAFEA need it? or both? I may have a problem getting a FEC with my diploma so just wondered who views the degree before you get the FEC? Do SAFEA get a copy of it or something to check over before issuing an Fec?
