I have said it before and will say it again...they are not required by labor law...I have the credentials and have no signed contract...sometimes though they will submit the number contract unsigned with a line drawn through the document...that is due to the requirement of recording the number that is at the top of the SAFEA contract. Anyway, doesn't matter, if the OP didn't sign; the instrument is not valid and doesn't come into play even if the OP wants to "defect" from the employer. The main documents at the present time is the FEC and he should retain that so that any new employer can transfer (if possible in the area he will next seek employment) the document. |

A contract is required by LAW to obtain a foreign expert certificate and resident permit. Whatever your situation is, who the heck knows, but please do not spread falsities here. |
Actually the Foreign Experts' Certificate is the property of the employer, not of the employee. All of this is on the SAFEA and local Foreign Expert Bureau websites. It should be returned to the employer at the end of the employee's term of employee who then cancels the entry, now automatically, through the SAFEA online database.
Any kinds, please read below. This is taken verbatim from the SAFEA website.
9. What is a Foreign Experts Certificate and how to apply for it?
This certificate is necessary for foreign experts working in China to prove their identity and apply for residence permits. To apply for it, the work unit should present the introduction letter from the authoritative agent; cultural and educational experts should present the contract, agreement between the governments or universities, Visa Z or its duplicate, and 2 personal photos.
This certificate is valid for one year at most. When it expires, it should be renewed, otherwise it will be invalid. When work units change, the certificate should be returned to the Issuer and a new one applied for in the new work place.

Exactly. Although technically, the FEC always belongs to the Chinese government, just as your passport always belongs to your government.
In any event, the FEC NEVER is the property of the FT.
As most professional FTs know, you can have your FEC legally and safely transferred by your new employer before leaving your old job.
That is provided both you and your employer have a professional working relationship.
If you are a fly-by-night teacher at a fly-by-night school where you and the headmaster spend your free time planning on how to steal from each other, then there are other poster's on these forums with that kind of experience who can advise you accordingly. |

| You are a tourist now and not a Foreign Expert. When you start a new job your employer will need to go through the procedure for your legal employment so new contract, new FEC, new RP etc etc and you may have to leave the country to apply for a new Z visa. Good luck. |
