Just an update. Went to the Labor Board, and they said that with the contract being for "varied hourly employee" that if I got one day off a week, it was legal.
First time I went it was in Japanese, and I thought the guy wasn't understanding me. Had a lady there the second time who can speak English, said the same thing.
So basically you get 8 days off a month, even with national holidays. So if you get a day off in Golden Week, you have to make up for it later that month with a day week.
I guess the Labor Board allows a lot of latitude in what companies can do? |
I was trying to pay off all of my credit card debt when I first started working for Berlitz. I was signing up to work 7 days a week and was putting in about 10 hours days. It was going smoothly for a short while until my manager told me it was against the law to work 7 days a week regardless of pay and/or contract. They bumped me down to 6 days/week and then eventually I paid off my debt and just worked my original contracted hours.
When I switched industries, I asked my president about the law and he confirmed it. He said that unless the company was really shady, you shouldn't be working more than 6 days a week with the rest up to your contract.
I suppose you could spin it and say that companies are allowed to get away with a lot of bs, but it really comes down to whether or not you understand the contract you're signing. Companies are going to do what they need to do in order to make money, and that unfortunately (?) includes taking advantage of contracts when possible. |

That's true, if I really wanted to make money 7 days a week could happen. But it is against the law. Good luck to you, but I would not want to work that much, too draining.
Actually what the Labor Board did say, was that Seiha needs to put more details in their contract, as a lot is not written in it. They like to do as much as possible verbally. Including giving you the working conditions verbally, after i signed my contract. |

They followed the law. What more would you expect the labor standards office to do? I think you should have looked at your contract a lot more closely, especially if this is you:

Yep, that's me.
Not mad at the labor board at all. They did tell me that the way that it was worded was substandard, and that he contract itself was poorly written. There was nothing that they could really go after, as a lot of it was a bit to the inside, but still legal.
They also mentioned that if more people complain, that they will look into it further.
I did read the contract. They real situation and working conditions didn't really match the contract, but not in a way that I could actually make a formal complaint. |

Interesting that you would say that, considering what you wrote on your first post on Gaijinpot:

Seems that this was in such a way that you would want to complain.
By the way, you might want to be more careful about your spelling, here and on Gaijinpot. |

I did complain about that. Nothing I could do, as it wasn't technically illegal. Though they did not inform me of said working conditions until I had been hire full time. Not really sure what you point in though to be honest.
Yeah, my keyboard is dying, and a lot of the letters don't always get typed when I press the keys. Drives me nuts when I have to edit my sentences several times. |
