Thank you for this cite. It is quite insightful regarding the criminalization of things that should, at best, be civil matters. Looking at the records at Ellis Island, immigrants to the U.S. 100 years ago were asked only if they were bigamists or anarchists. Europe's criminals were welcomed to America however. Today, American citizens who had some brush with the law, however minor, too frequently cannot get their records expunged. This limits their ability to work and travel abroad.

Should potential employers really have a right to know if someone spent the night in the drunk tank or got into a loud argument with a girlfriend in a parking lot at 18? Information about felonies, violence against others, and theft is quite relevant, but other matters should be closed and expunged as a matter of course. The FBI report is far too broad.

I've never heard of immigration in China wanting an FBI check. Might be your potential employer is going a bit overboard. A notarized state check should suffice, even in Beijing.

I've had to jump through a lot of hoops to get my residence permit moved to Beijing, but no FBI checks required as of yet...maybe that will be the next thing they pop on me....

My former roomie lived in China for four years and before China, taught in Dubai. He ran into the same problem. He ended up having to lie and say he worked in Korea for last 8 years and he got a police certificate from Korea in less than a week. They are making things so difficult for people to work here I think they will have a foreign teacher crisis on there hands shortly.

So I got the criminal background check, there was a "Public Intoxication" charge from 1982.

Now I can't work in Yunnan or Zhejiang provinces. Two jobs hired me but then couldnt get my CBC past the Government FAO.

WTF?

In the States there are DUI lawyers who specialize in expunging such records. I can't remember where you're from, but you might want to look into such a lawyer in your home country.

Isn't that great part - people with clear criminal history's who dashed off to China to find work and then the laws changed and now they want to get into the legal system to pay lawyers, talking expunging, and whatever else, all to live in China and earn money well under US Poverty numbers. I know American life is horrible these days, but come on. By the way, what does Target pay these days?

Your record there is older than me. It was probably something stupid, but now you are made to pay for it. I think trying for other provinces might work.

So odd though, I doubt a Chinese FAO office even knows what counts as public intoxication in the US.
