OK. 50 this year with little to no pension in Canada
Certified to teach in Ontario, Canada: economics, business, marketing, accounting
M.Ed with 10 years post-grad experience: 2 years substitute teaching in Ontario, 8 years ESL South Korea, in Unis
IT background: networking, responsive web design, using LMS/CMS for teaching
Totally frustrated 2 years after returning to Canada; either overqualified or lack experience. Figure some experience teaching my major is a positive, although would prefer doing instructional design, but spending six grand to prove I know how to do it doesn't sit well with me.
So: 22000 but no apartment, 25 hrs a week, 40 at the school ( prestigious public school in a nice part of Beijing ), some harsh penalties for being late, extra-curriculars.

Without limiting the generality of sub clause 6.3, the Employee will be subject to a probation
period of 90 days beginning on the Start Date (the „Probation Period‟). In the probation period,
if the school finds out that the employee is unfit for the assignment specified in the contract
for reasons of health or professional ability, it has the right to terminate the contract. In such
case, the Employee will be paid his/her remuneration earned up to and including the date of
termination. Further, the Employee‟s contract is subject to the termination if the reference
check and background check or either one is not satisfied by the employer in 30 days from
signing the contract date, the Contract will subject to the termination. If the Employer
terminates the contract due to the Employee‟s failure to past the reference and security check,
the Employer only requires notifying the Employee in writing for the final decision without
providing any other proof documentations. The Employer will not be obligated to make any
other payments to the Employee.

教学研讨和规划。
Develop and implement lesson plans at a professional level; and, develop a curriculum
guide for
A-level & AP economics and AP statistics courses, and study and research
the contents on AP Economics, IB economics, A-level economics, and business
course and participate weekly departmental collaboration.
2.2.3
制定并完成学生评价,每天要认真批改和评价学生课内外作业最少要每个星期一
次测验,一个月一次月考。
Develop teacher grade books, including assignments and correcting students‟
homework on a daily basis and in an organized and professional manner; and correct at
least one quiz per week and chapter exam monthly for each student per week

Supplement, research and develop curriculum for the international education programs.
Participate in co-teaching between foreign teachers and Chinese teachers; participate in
teacher collaboration and prepare for the lesson plan , pacing guide, syllabus, according
to the requirements of leader of the teacher collaboration team and submit lesson plans
on time required by the school.
2.2.7
参加教师培训与教育教学活动和必要的出差等事务。
Participate in teacher training, educational activities, business trips, and other work as
necessary;

积极参加各项培训工作,注重合作教学和资源共享。
Actively participate in each training activity, giving special attention to collaboration
and sharing of resources.
2.2.9
为学生申请外国大学提供所需的咨询和支持,如:提供入学申请咨询、撰写推荐
信、指导学生撰写个人陈述文章等。
Provide any necessary counsel and support in students‟ application to universities
abroad, such as college admission counseling, writing letters of recommendation, and
guiding the students in writing personal statements or essays, etc.
2.2.10 在雇主批准和安排后,雇员可根据自己的学历和兴趣教授不同的学科。
After the employer‟s consent and approval, the employee may teach different subjects
based on the Employee‟s training and interests.

2.2.11 如果有老师因病请假,服从项目负责人调配代课。如果因自己生病,需其他老师与
自己调课的话,在经过批准后,要在以后时间补回所被替代的课。
The Employee should follow the school‟s instruction to substitute other teacher‟s
classes if the teacher requests the leave for the day. If the Employee who requests the
leave, will swap the sub teacher‟s classes with his or her missed lessons under the
school‟s arrangement and use the classes to teach his missed lessons .
与同事即使交流,加强合作,配合教辅人员工作,及时与学生和家长沟通。
2.2.12
Communicating and collaborating with other teachers, supporting staff, students, and
parents.
2.2.13
雇员必须严格遵守教师守则所规定的内容。
The Employee must follow what is requested on the teacher manual.
2.2.14
遵守教师职业道德规范
The Employee should follow the teacher‟s code of conduct and professional ethics, keeping
the normal teacher-student relationship with the students and prohibit to engage in any
activities beyond the normal teacher-student relationship in the expression of language and
behavior and it includes but not limited to date or going out alone with
students without parents‟ or guardians‟ and school‟s knowledge and consent and ect.
3.
薪酬及工作时间 Salary and Working Hours
3.1 雇员的税前月基本工资为:人民币 22,000 元
所有每月要付给雇员的薪酬以人民币支付。
雇主将根据劳动法扣除相应的税款及其他费
用。
雇员有义务支付雇主未扣除的相应的税款。
一天工资的算法是按照雇员的月工资除
以 30 天而得出的一天工资。税前工资其中 4000 元/每月 作为住房补贴发放。
The gross (before tax) monthly salary of the Employee is: 22,000 yuan.
All amounts payable to the Employee will be paid monthly, appearing in RMB, and will be
subject to deductions for all taxes and other amounts required by law to be withheld by the
Employer. The Employee will be responsible for payment of any and all taxes which he/she
is liable to pay but which the Employer has not already deducted. The Daily Rate is that the
monthly salary is divided by 30 days.
A portion of the monthly salary , amounting to 4,000
Yuan/per month will be given as a tax-free housing allowances
3.2
雇员工作时间每周 40 小时(在校时间),其中教学时间不超过 25 教学小时。雇员应按照
主管领导的要求认真完成教学任务及备课工作,并保证质量。雇主有权调整工作时间。
如有必要,雇主可以要求雇员在非工作日进行加班工作。

The required working hours per week are 40 hours (on campus), of which teaching time shall
be no more than 25 teaching hours. The Employee is expected to work the hours required to
complete the tasks and prepare for the classes as assigned by the Employer, in a professional
manner. The employer reserves the right to make adjustments to working hours. When
necessary, the Employee is expected to work beyond school hours for after school activities
and school functions held on non-school days.
4.
雇主的义务/雇员的权利 Obligations of the Employer/Rights of the Employee
4.1
在雇员的任职期内,雇主将为雇员提供医疗保险。
The Employer will provide the Employee with medical insurance.
4.2
雇员在履行完合同后,
雇主将为雇员提供来中国和回家的双程机票。
雇员提前支付来华
的机票并在提供相应的收据后,
雇主报销雇员的机票费。
雇主会为雇员购买离家最近大
城市的回程机票。机票不会以等价现金给予雇员。
对于来华机票:学校不以老师提供的机票价格为准, 而是提供对学校最有利的机票价
格购买回程机票。来回机票总价格不会超过 10,000 元人民币。
Round trip airfare is provided after the employee completes the contract. For the employee
abroad, the employee should pay for the airfare to China in advance, and then gives the
receipt to the school for reimbursement. The school will purchase a flight home to the nearest
major airport at the end of the contract. Cash in lieu of a ticket will not be given.
For arrival airfare: The school will check air travel for rates most favorable to the school and
not according to the teacher‟s frequent flyer or other preferences. If the teacher chooses not to
accept the carrier and scheduling the school suggests and makes other travel arrangements,
then the school will only reimburse for the cost quoted for its suggestion. Any additional
costs will be the responsibility of the teacher. The school will not give cash allowances for
travel. The teacher is responsible for any other travel to and from the home country during
the term of employment. And, total air fair will not exceed 10,000RMB.
4.3
雇主将为雇员办理工作签证(多次入境)及居留许可证、外国专家证。雇主将支付雇员
的工作签证及居留许可证的相关费用。
雇员负责体检费用。
如果雇员不论任何原因终止
劳动合同,并早于工作签证及居留许可证的日期的,雇员将全额赔付该相关费用。
The Employer will be responsible for helping the Employee apply for the Visa, Residency
Permit, Foreign Expert certificate, and pay the relevant application fees. The Employee will
pay for the physical check-up fee. If the Employee terminates the contract before the end of
the contract term for any reasons and before the visa or Residency Permit is expired, the
Employee is subject to pay for all the fees related to the above applications.
4.4
依据学校教师校历,雇员可以享受学校规定的休假。这些休假期间雇员可享受全薪(包
括一个寒假,不包括暑假)。
The Employee will be entitled to enjoy holidays as set by the school, with full payment of
salary including allowances (including one winter vacation, summer vacation is not
included).
4.5
事假应至少提前两周向雇主提出申请;
病假需提前至少 1 天提出申请,
如超过两天包括

第二天,需提供医院医生证明。一学年病假最多不可超过 14 天,事假最多不可超过 8
天, 一个学年雇员最多可请 2 天带薪病假.没有带薪事假。一学年最多事假不可超过 8

违反上述任何一种情况,
超过一天,
可扣发两天工资。
如果上课迟到或者上班迟到,则扣除迟到当天的工资。旷课一节或旷职一天,扣发三天
工资。违反病假、事假条例(单位对严重违反病事假规定有最终解释权)
,或旷工情节
严重的(累计旷课达到 3 节,旷职 2 天的)
,聘用单位有权解除合同,并追究其违约责
任.
The employee should request personal leave from the Employer two weeks in advance; for
sick leave, the Employee should notify the Employer one day in advance. If the sickness
leave is over two days including the second day, there is a doctor or hospital proof needed.
The total number of sick days allowed are 14 days and total number of personal days are 8
days. The total numbers of paid sick days are two days per year. There is no paid personal
day. The maximum of personal days are 8 days or there is no 3 consecutive personal days
allowed, violating above either one condition, every additional personal day will subject to a
two days‟ pay deduction. If the Employee is late for the class or for work, that one day‟s
salary will be deducted. If one period or one day of work is skipped, then three days‟ salary
will be deducted. If the Employee‟s cumulated absences are over 3 periods of classes or 2
days of absence or the Employee violates sick leave and personal leave policy in a severe
level (the Employer will finally define the level of severity of violation of the sick and
personal leave policy), the Employer has the right to terminate the contract with the
Employee and the Employee will subject to pay the Employer one month of salary for the
violation of the contract.
4.6
雇员将受到一年两次的工作成绩评估。
The Employee will be subject to a performance appraisal twice annually.
4.7
雇员必须对自己的工资保密,不得和其他员工同事分享。
The Employee must keep the actual figure of his/her salary to him/herself and is not allowed
to share with other staff.
5.
雇员的义务/雇主的权利 Obligations of the Employee/Rights of the Employer
5.1
合同期间,雇员不得从事雇主安排之外的其他赢利活动,除非雇员和雇主有书面协议,
且该协议必须在雇员能力承受范围之内。雇员须知,雇主的要求高于一切。
During the term of this contract, the Employee agrees not to engage in any remunerable
activities other than for the Employer, except with the prior written consent of the Employer,
such consent not to be unreasonably withheld. The Employee understands that he/she must
give priority to the work requests of the Employer.
5.2
合同期内,除非与雇主有书面协议,雇员不可直接或间接以法人、校长、代理、合作伙
伴或雇员的身份,以任何形式参与其他可能对雇主形成竞争的实体的产品或服务的设
计、计划、创造、执行、散发或建议等。

During the term of this contract, the Employee will not act directly or indirectly as an owner,
principal, agent, partner or employee, to design, plan, create, implement, deliver or advise in
any way whatsoever, goods or services of any description or kind similar to or which may
compete with those offered by the Employer, except with the prior written consent of the
Employer.
5.3
雇员将在给雇主提供有效真实的资格证书及学历证书等证书复印件。
the Employee will provide the Employer with copies of his/her valid and authentic
qualification certificates and academic certificates.
6.
修改、取消及终止合同 Revision, Cancellation and Termination of the Contract
6.1
雇主有权依照《劳动合同法》等相关劳动法律法规解除或终止劳动合同。
The Employer may terminate or cancel the contract according to provisions of “Labor
Contract Law”.
6.2
在下列任何情况下,
雇主在合同期限内,
无需通知可直接与雇员终止合同并且雇员要支
付一个月的工资作为合同违约赔偿金。
The Employer may during the term of this contract terminate the employment of the
Employee without notice, under any of the following circumstances and the Employee will
subject to pay the Employer one month salary for the violation of the contract:
6.2.1
雇员故意使用虚假的学历证书或关于其能力的其他相关证书,一经发现,即刻解
除合同。
If it is discovered that the Employee intentionally misrepresented his/her credentials or
any other information relevant to his/her ability to discharge his/her duties under this
Contract
6.2.2
如果雇员有犯罪行为或玩忽职守。
If the Employee is guilty of serious misconduct or willful negligence in the discharge of
his/her duties
6.2.3
雇员如有犯罪行为,无论与其职责是否相关。
If the Employee is found to commit criminal offense, whether related to the discharge
of his/her employment duties or not
6.2.4
雇员没有通过每年的工作成绩评估。
The Employee doesn‟t pass one of the annual performance appraisals.
6.3
雇员清楚:
无论因何种原因合同终止,
雇主有权从雇员工资或其他费用中扣除应属雇主
部分、雇主替雇员垫付的贷款或押金等。
The Employee hereby expressly authorizes the Employer, on termination of this Contract for
whatever reason, to deduct from any part of his/her salary or other payments still owing by
the Employer to the Employee, the amounts of any loans or advances made by the Employer
to the Employee, which are still outstanding.
6.4
无论以任何理由终止合同,
雇员都需要立即归还雇主的所有财产,
其中包括:
所有资金、
设备、文件、规划、数据清单、课程资料、课本以及其他所有关于学校的书面版、电子

版或其他任何形式的资料。如果有损坏或遗失,雇员需照价赔偿。
On termination of this contract for whatever reason, the Employee will immediately return
all of the Employer‟s property, including any and all funds, equipment, documents, plans,
lists, timetables, curriculum, and any other information relating to the School, whether in
paper, electronic or any other form whatsoever.
If the items are broken or lost due to the
Emplyee‟s fault, the Employee should pay the total price of the item original price.
6.5
签署合同之日起,如果雇员未能按时在_2013_年_08_月_25__日到校报道(除事先通知
并得到学校批准或不可抗拒的原因)或者中途毁约,雇员负责赔偿雇主签证办理的一
切费用和学校支出的其他费用,并支付两个月的工资给学校。
From the start of signing the contract, if the employee can‟t report to the school on
dd/mm/yyyy ___25/08/2013__________ (unless notify the employer early and get approved
or in consequence of any Force Majeure incidents) or terminates the contract early, the
Employee will pay the Employer all the fees involved in the visa applications and the
Employee will pay the Employer two month salary.
6.6
签署合同之日起 如果雇主在雇员结束试用期后,或并没有违反和合同条款提前下或者
在没有适当的理由下解除合同,雇主付给雇员一个月的工资。
From the start of signing the contract, if the employer terminates the contract early after the
probation period or the Employee doesn‟t violate the contract teams or reasonable reasons,
the employer will pay the Employee one month salary for early termination of the contract.
7.
知识产权 Intellectual Property
7.1
在该合同中,“知识产权”包括:但是不仅仅局限于任何制图、设计、发明创造、方法、
研究、著作、文献、规程、课程资料、计划、数据、开发项目、结论以及工作成果。上
述所有的项目只要是雇员在任职期间所开发的、设计的、策划的、规划的、创造的、著
作的或绘制的,
无论是否完成或未完成,
无论是否注册或未注册都统一称为“知识产权”。
In this contract, “Intellectual Property” includes, but is not limited to, any drawings, designs,
inventions, methods, research, writings, literature, instructions, curriculum information, plans,
data, developments, conclusions, and work products, that the Employee develops, designs,
engineers, programs, creates, writes or draws in the course of his/her employment, whether
completed or uncompleted, and whether registered or unregistered.
7.2
雇员同意所有知识产权都归雇主所有。
The Employee agrees that all Intellectual Property shall be the sole property of the Employer.
7.3
雇员同意签署任何及所有文件及注册登记文件以确认、
保护和转让雇主的知识产权。
像
雇主所要求的那样,无论是执行合同期间或是终止合同以后。
The Employee agrees to sign any and all documents and registrations necessary to confirm,
protect and transfer any rights in the Intellectual Property of the Employer, as requested by
the Employer, whether during or after the term of this contract.
8.
保密性 Confidentiality
8.1
在该合同中,”保密资料”包括:但是不仅仅局限于关于雇主的所有资料、与其相关的学校
资料、运作方法、财务管理、入学登记信息、学生团体、学费定制、课程安排、全体雇

员、调查研究、供应商、合作伙伴、法律资料以及其他关于其运作方法、法律或财务状
况,除非一些信息资料已公布于众。
In this contract, “Confidential Information” includes, but is not limited to, all information
about the Employer, its related schools, their operations, finances, enrollment, student body,
tuition, curriculum, staffing, research, suppliers, partners, legal matters, and any other
information relating to its operations, legal or financial status, unless such information is
already in the public domain.
8.2
合同期结束,没有雇主书面同意,除非政府部门或司法部门通过合法程序要求,雇员不
得向任何公司、个人、实体或集团泄露任何机密信息。
During and after the term of this contract, the Employee will not disclose in any manner any
Confidential Information to any company, person, body or group, without the prior express
written consent of the Employer, unless required to do so by a court of competent jurisdiction
or government body acting within its proper legal authority.
9.
防竞争 Non-Competition
9.1
本合同防竞争期定义为提前结束合同后 60 天,无论是何方首先终止合同。
In this contract, the „Non-Compete Period‟ is defined as the period beginning on the day that
the Employee‟s employment is terminated before the end of contract term, whether by the
Employer or by the Employee, and ending on the day that is 60 days thereafter.
9.2
防竞争期间,雇员不得为那些直接或间接可能与学校形成竞争的商业、学校、实体或机
构工作。
The Employee agrees not to work for any business, school, entity or organization that may
compete directly or indirectly with the School, or which may affect the operations, legal or
financial status of the School in any way, during the Non-Compete Period.
10. 背景核查 Background Verification
10.1 雇主有权对雇员的教育背景、
专业资格和工作经历进行询问和调查,
并据此做出是否聘
用雇员的决定。
The Employee hereby authorizes the Employer to conduct such inquiries and searches as are
reasonably necessary to verify the Employee‟s educational and professional qualifications
and experience as previously represented by the Employee and on which the Employer based
its decision to employ the Employee.
10.2 雇主有权通过第三方获取 10.1 条所列信息的确认。雇员在本合同的签字,等同于授权
第三方提供此类信息给雇主。
The Employer is entitled to contact and use the services of any third party to obtain the
verification described in sub clause 10.1 above and the Employee‟s signature on this contract
should be taken by such third party to be the Employee‟s consent to obtain and release such
information to the Employer.
11. 概述 General

Any amendments to this employment contract must be in writing and executed by both
parties and stamped by the Employer.
11.2 本合同遵循中华人民共和国法律。
The laws of the People‟s Republic of China shall govern this contract.
11.3 如果本合同中,
任何一项违背中华人民共和国法律的内容将视为无效,
其他条款将仍将
有效。合同双方自愿签订。
Should any term or condition of this contract be void under the laws of the People‟s Republic
of China, the remaining terms and conditions shall continue to apply and the employment
contract will be interpreted in the manner which is most consistent with the intentions of the
parties as expressed herein, subject to being in compliance with the law.
11.4 雇员在合同期间须履行所有义务。
The Employee must follow all obligations during the period of this contract. |

A serious (and professionally-worded) employment contract outlining serious teaching duties and responsibilities for which a serious monthly salary is provided.
Income tax on your base salary of RMB18,000 will be about RMB1,980 and the social security levy will probably take away another RMB1,540.
Have you considered Saudi Arabia?
My personal 'specifications' are similar to yours and I've recently been offered a university position in KSA offering USD3,500 per month, tax-free, plus accommodation and a few other perks.

Yes, it sure is serious Zhejiang_Man. Only thing is that it's in a very high-end area ( with all the requisite opportunities ). Finding an apartment nearby that doesn't cost more than the housing allowance (4000) will be impossible. Being close to work is a primary concern, along with the hassle of being responsible for administering my own habitat; proximity makes the long hours palatable.
Yes, I am worried scot. I really would prefer to be in Canada and involve myself with a profession that would last until I croak; that's why I returned. After a certain age one can easily be perceived as obsolescent in any society, especially one which is foreign; despite competitive advantage. The decision becomes contingent on the probability of outcomes. Given the uncertainty of the future, is cash plus experience ( and the opportunity to teach all over the world ), or adapting and adding to one's skills to meet the perceived needs of the future the best solution; comfortable retirement is all but out of the question.
I threw this thread out because I needed a forum to solidify my decision. Extra education has only helped me over the past 20 years, because I am able to adapt. What has hindered me is my introversion; so really, I need to get out and speak with like-minded people, and this is where upgrading with a certificate in adult education would be helpful. So, I'm going to get out and rub shoulders, but be prepared beforehand with my mind focused on the necessities of the future.

have you looked into international schools in china? for someone with your qualifications and experience, you should expect a better contract. whether or not it's possible now, due to the late timing, i'm not sure.
the main parts of your contract that stood out to me (i only skimmed) were the fact that summer vacation is not included, lateness equals the deduction of one full day's pay (traffic in Beijing is a b****, i admit i was ~10 minutes for my morning prep period a couple times when i lived there), airfare isn't reimbursed until you complete the contract, and the salary of 22,000RMB includes the housing allowance.
i'm also a certified teacher, but with less teaching experience than you. if you want more information, feel free to PM me! |
