One has; the other is an Indonesian teaching assistant. I think there are some charges against another western teacher (a woman) but, for whatever reason, she hasn't been imprisoned. |

One is a Canadian administrator ("learning leader", as his position is apparently called by the school) and the other is an Indonesian teaching assistant. |

Your confusion is understandable. There are actually 3 different cases here. The first involves a group of 5 janitors, who were obviously locals. One of them is dead. He died during interrogation. The police claim that he commited suicide by drinking bleach. (Why a rape suspect would be given a bottle of bleach in his cell is anyone's guess).
In the janitor case, all 4 surviving janitors have now said that they witnessed the 5th janitor being beaten to death by police. They all claim that this done to coerce them into giving confessions. If you check with Amnesty International, you will find that the use of torture to gain confessions is very common in Indonesia, so these claims do not strike me as at all far-fetched. But I guess we will never know for sure.
In addition, there are now 2 'teachers' being charged with rape as well. The original statements from the alleged victims mentioned a 3rd foreigner, a Canadian woman who was the principal of the Elementary school. In this statement, she was said to have recorded her staff raping on a Digicam.
Perhaps these claims were judged too ridiculous to be believed, as they eventually disappeared from the dossiers, and she was released. Yet this is precisely the problem. The prosecutors have kept sending the dossiers back to the police time and again and the story keeps changing.
When it was revealed that the site of the alleged rape was actually a glass-walled room in the school lobby, that was judged unbelievable. So they have now changed the location of the alleged rape to the school kitchen in school hours! Yet police have never even interviewed anyone in the kitchen to see whether this saw anything.
Furthermore, 'a magic stone' which was 'conjured out of the air' nhas now morphed into a drug which was inserted into the victim. The story changes completely every few weeks and yet the case is allowed to proceed with no eyebrows raised. I don't think anyone expects this case to reveal what really happened, or if anything happened at all. |

Perhaps the perpetrators escaped with the help of a Jinn. I mean if they say it was a magic stone, or a drug that confused everybody by looking like a magic stone who are we to question that? |

Hey thanks for the updates, guys - keep them coming!
For whatever reason the Globe no longer makes it past the Great Firewall where I am.
Fascinating case.....has all the hallmarks of tin-pot, banana republic justice. No legal rights, prisoner torture and extra-judicial killing, staggering levels of corruption, scapegoats, facesaving - real turd-world BS. Everyone's got a whiff of that filthy lucre. Only in this case it feels like it could have happened to any one of us expat teachers.
Good luck to Neil and Ferdi, can only hope that their Billy Hayes-esque "For a nation of pigs....." speech didn't get them in deeper shit. |

Psychiatric Record Tests (PRT'S) are NOW to be carried out on EFL teachers in Indonesia...on top of criminal record tests etc. If YOU are proven not to be sane you will be deported back to your home country. |

Quite easy to ascertain actually.
DIKNAS "Do you want to work in Jakarta?"
DUM BULE "Yes"
DIKNAS "Quite clearly you are mentally unstable. Airport bus is over there, mister. P.S Got any cigarette money?" |

I believe they're struggling to attract new recruits and are also having problems attaining work permits. I was told that one DoS in Jakarta is currently managing SIX schools as they are so short-staffed - that sounds a bit of an exaggeration but there's probably some truth behind it.
What's that saying about chickens and roosting? |

So, with evidence that seems to have been partly conjured from the fantasy world of J.K. Rowling-the janitors have been found guilty and are facing massive fines and eight year jail terms.....shame on Indonesia's corrupt legal system! I fear for the westerners in jail. |

There was a recent article in the Indonesian press in which the Police Chief was boasting about how well the police and jaksa (prosecution) are cooperating together with sinergi (synergy) to ensure that prosecutions were successful in Indonesia. What this 'sinergi' of police and prosecution actually means is a rigged system whereby dossiers are doctored and amended to ensure that the deck is stacked against defendants.
For example, in this case the original claims against the janitors were different. One of the alleged rapists was a woman, meaning there were 6 alleged rapists. The prosecution must have thought this would look dodgy in court, so they sent the dossiers back to the police and they rewrote all the documents to remove all reference to the woman rapist. Such 'sinergi' has nothing to do with achieving justice and everything to do with making sure people go to jail, whether they did it or not. This means the court is more of a show trial or 'kangaroo court'.
Worryingly, the same thing has happened with the Western teachers' dossiers. The alleged child victim originally stated that he had been hypnotised by a magic stone which was conjured out of thin air. The prosecution didn't like the sounds of that but it was already widely reported in the media. So the magic stone then morphed into a magic stone / drug which was inserted into the victim to somehow facilitate the rape. You are left wondering how fantastic a story would have to be before the Indoneisan judiciary would throw out a case.
As Tazz has suggested, there is a Hogwarts level of fantasy to these horrible claims. It may be a year or two more before all the legal cases and appeals have ended and the dust has settled on this wretched affair. In the meantime, JIS has now been forced to rename itself Jakarta Intercultural School, because the government has banned it from using the word 'international', which is somehow offensive to the Education Ministry's sensibilities. The farce rolls on. |

“We are aware of the verdict in the case against the JIS cleaners, as we have been following this case with great interest. The protection and welfare of children is of utmost importance to educators, to law enforcement, to all of us, and all allegations of abuse must be taken seriously and examined. However, we note with concern that the investigative proceedings of both this case, and the accusations against the JIS teachers, raise serious questions about the standards of evidence applied.
We are also concerned about the defense claims that police used violence against these defendants to extract confessions, and we hope that the appropriate agencies will investigate those claims.
The international community here, foreign investors, and foreign governments are all following this case and the case involving the JIS teachers very closely. The outcome of these cases and what it reveals about the rule of law in Indonesia will have a significant impact on Indonesia’s reputation abroad.”
