OK. My bad. Apologies to everyone for putting up the incorrect information. Here is the real info:
My co-worker has a residency permit that is expiring in about 10 days. He is married with 2 kids if that makes any difference. For whatever reason, the school is unable to get him a new residency permit before the old one expires. My boss says 30 to 60 days and then all will be OK. So, the question is what should my co-worker do? He wants to be legal and we need him to finish out the school year. Should he go to HK and get a 90 day business visa just to tied him over? I had to do something like this a few years ago (My stupid boss at the time said it was OK to visit HK before I had converted my Z visa into a residency permit.) and it worked out well.
Any and all suggestions welcome and, again, I apologize for the earlier confusion.

Why can't they get him another residence permit? He doesn't need another Z visa if the school extends his residence permit.
If he goes to HK, then his residence permit will be canceled. If his wife is Chinese, then she would know the reason why he can't get a spousal visa. If that is definitely not possible, then I would address the problem as him getting the residence permit extended and the school getting it for him. The spousal visa would be a side issue and resolved when it can. |

A Z visa got him into China. A residence permit kept him in China as long as the school employed him and got it renewed. The Z visa expired as soon as he was issued his residence permit. |

My understanding is if you change your visa status, then you will have to get a new Z visa. So, if they go to HK and get something different, they will have to at best go to HK again to get a second Z visa. Then they will have to apply for a residence permit from that Z visa which they could be doing now instead with the current residence permit by extending it.
They can extend their stay now by asking PSB to give them a tourist visa for 30 days. I understand this is possible. Then the school would have to get all Z visa paperwork again and send them to HK. This would allow for 1 trip.
Make sure it is 30 days and not 2 weeks. However, I don't see how this helps the school. I was on my final day once, and my school was able to get my application in and it allowed me to stay in China. Just because you don't have the residence permit in hand doesn't mean you can't stay in China. 30 days or so later, I got my extended residence permit.
I would get an explanation why they can't or don't want to extend the residence permit. The only reason I can think of is that they don't want that teacher anymore but they want them to finish the year. So, they are making up excuses.
As for being married to a Chinese woman with two kids, that Chinese woman would have to find out why he can't get a spousal visa. We can't know that here.
You should tell them this. Find out from the school why they don't want to extend the residence permit now which would be easier and cheaper and why he can't get a spousal visa from the Chinese wife. |
