				| I am in a dilemma - school wanting me to cancel my Residence Permit before my agreed last day. They say it is legal and I can continue to work. Independent advisor says it is illegal and that once residence permit is cancelled it is illegal for me to work out my notice period. Anyone know? |

				I'm not sure either. They shouldn't be wanting you to cancel it. That doesn't mean they can't cancel it themselves but it is troublesome task for them to do if you don't play ball.
 
 
Once it is cancelled, then you certainly cannot work and technically would be illegal.
 
 
Assuming you are transferring schools then they should be cancelling your FEC. and giving you the documents to give to your new employer. The current RP in this case should not be cancelled.
 
 
If you are leaving China then you can either just leave and it will expire itself or ask them to take you to the PSB for an interim visa. It used to be 30 days but recently it has been changed to 15 days in some provinces.
 
 
It sounds to me like crossed wires somewhere. They are more than likely just wanting to clear their books, but they should not be doing this until you officially leave. Explain to them politely that there is no need to cancel it and suggest that they contact the Foreign Experts Bureau for advice. They will confirm this. |

Thanks that's what I would like to see happen. That they are not or prevaricating in doing so, saying they can only do so on my last day of employment, is a cause of some concern. |

				They have no reason to cancel your RP, it expires itself and is in your passport. When you switch schools you will get a new one and your previous one will be void/cancelled. Having no RP is like being here with no visa, you will not be able to leave without a fine or possibly jail.
 
 
The FEC is probably what they are talking about. That does need to be cancelled to get your release/recommendation letter in order to transfer to a new school. |

				OP - is your school pissed with you or something?
 
 
They either don't know what they're doing or are trying to mess with you in a big way.
 
 
If you cancel your Resident Permit - you not only cannot work in China - you can't STAY in China.
 
 
That is your visa that allows you to be in the country - once that's cancelled you have to leave within 10 days - or somehow have some other visa arranged.
 
 
Your employer can cancel it without your consent, but have to show that you have somehow breached your contract in a major way or have broken the law - something serious enough to warrant kicking you out of the country.
 
 
If they're asking you about it - it makes me think they're not so sure themselves what this means. But unless you're looking to leave China soon after - DO NOT allow them to cancel your Resident Permit. |

				Cancelling your residence permit is the quick way to getting booted out of the country and having to start all over again from the beginning.
 
 
They can cancel your FEC (Work permit) but they are unable to cancel your residence permit (permission to stay in china inside your passport) without your passport. If they do cancel your FEC you MUST get the paper with stamp on it to say its been cancelled from the foreign experts bureau in your city or you will have huge problems getting another FEC in future.
 
 
Just to further add to this, if they cancel your residence permit in your passport it is extremely difficult to get a new one if they give you a 1 month temporary permit to settle your affairs as its intended that you leave.. so in my opinion, dont give it to them no matter what they say unless you intend to leave the country. |
