On 24 December 2004, judgement was passed at Osaka District Court in an unfair dismissal case brought against Nova by a General Union member. This was the first time Nova's policy has been judged upon by a court of law. Although the plaintiff was found to have not been unfairly dismissed for other reasons, the court had this to say about Nova's controversial, non-socialization policy:
'A comprehensive prohibition as in this clause forbidding socialisation cannot be held to be necessary.' .... 'Forbidding in advance in a comprehensive manner any socialisation between English conversation teachers and students in order to prevent trouble and disciplining for a violation of this rule cannot be admitted as fair or socially acceptable.'
