I received a call from a fellow teacher in Northern China late this morning looking for some general legal advice if possible. Law is not my area.

Seems like the school she works for has not paid its payroll for the month of February (and March is payable soon) to any of its teachers or staff. Problem is that the school is a Sino-British joint venture with a Chinese 60% partner and a Canadian 40% partner. The Canadian partner has gone missing and has resigned as General Manager of the school. The Chinese partner says it will honor 60% of the salary responsibilities but not the other 40%. My friend is wondering if the 60% partner is legally responsible for the other 40% as well as the other provisions of the contracts such as flight reimbursements, rent, etc.

The school is legaly bound to pay 100% of the salary. The cantract was signed between the teacher and the school not the teacher and one of the directors.

From the sounds of it, this school is starting to go downhill. I would advise your friend takes the 60% and asks to be released from the contract. There is a good chance that this school will just have further problems. It will be extremely difficult to fight for your rights and get what is owed to you.

Your friend should cut her losses and make a break. Find another school and start again.
