I am a bit suspicious.
I wonder whether these foreign teachers are legit themselves??? Let me bet here: they aren't!
They are business visa holders or work visa holders from other fulltime employers. They are moonlighting.
So, do these FTs have a well-grounded concept of "contractual obligations and rights"? I doubt it.

It is really tough for many ESL teachers in China (or coming to China) to know whether they are legally or illegally contracted in my opinion. To know the ropes or aviod such disappointments/frustrations as the one above, one has to read on the rules and laws of China broadly before committing himself or herself to a Contract and that can be largely time consuming and still it might not help. This advisory is fairly valid and I am sure helpful for many.
I am sure that pro-athletes with their agents/lawyers (especially the high profile ones) do not have as many problems with their Contracts as the ESL teachers do in China.
Cheers and beers

englishman:
i read your post. good points you make, that it is time consuming if possible at all to get informed of the laws and regulations.did you know that only chinese lawyers are allowed to go to the courts in china. foreign lawyers know the china laws but cant go to court. how many times have you heard a foreigner getting help from a chinese national to win over a chinese person/company? NOT!

even if you did inform yourself, you probably won`t be allowed to excercise the laws. no doubt your familiar with the culture. telling lies to foreigners of just about everything or not doing what laws say to do. you cant really use the laws and regulations to protect yourself. the police lie to you as a foreigner, foreign affairs does the same, etc., etc.

your basically a victim/prisoner to a corrupt society with no practical rights! the only way out is to pay for the scams you are framed for, such as overdue visas (poplular one) or not getting your salary from your work.

in the case of this string, Aojing International had sent a letter regarding a teacher they had fired to the embassy of that teacher`s home country. this is a great example of the boldness of this business operating in China.they know they can do anything without question for the corruption.

IF ANYONE IS CONSIDERING WORKING FOR AOJING,KEEP THIS IN MIND. IF YOU MISS A CLASS FOR SICKNESS,BE PREPARED THAT YOUR EMBASSY MAY GET A LETTER ABOUT IT!!

you`ll be told you have to go to court to resolve any workplace problems if you are given the improper F visa, which no-one will contest. the improper F visa problem is widespread, especially in Beijing and no-one wants to touch it for all the money they make off the scams and shortcuts businesses can take with it.
