I have quit a job- a Canadian school /company here in China, and they have a vague contract. What they do is pay us over 12 months for teaching 10 months. Now that I have quit is it my right to collect the months they have withheld which they say is to pay us over the summer. This I think they will try to not pay me. So I am wondering if anyone has this similar circumstance.

I assume that you mean that you have quit your job prior to the completion of the contract term. If so then you would need to refer to the terms of your contract for the answer to your question.

My guess is that you will not be offered the money that you are seeking.

If it is termed as a bonus payable upon completion of the contract then you will likely need to forfeit this money.

If it is termed as a monthly credit towards some sort of contract completion deposit then you will likely need to forfeit this money.

If there seems to be a strong indication that this money was rightly earned during the term of your contract (for example, if it was written as being payment for the sunner holiday break for which you were working for the school, but to be paid later) then I think that you will find that you are entitled to this money.

What does your contract stipulate?

While teaching in America, we teachers had two choices. Get our salaries paid in 9-month increments (higher paycheck per month) or distributed in 12-month payments (lower paychecks, but made summertimes much easier). Is that what's happening with you? I mean, something akin to this?
