I've been suing Nova for unlawful termination and unlawful transfer. I
took them to the Human Rights Commission in Osaka re: socialization,
and won a ruling against them. Then they started in on me, and this
resulted in a campaign of harassment and finally terminatiOn. In
particular, the campaign got really bad after I had successfully
unionized my branch at Nova, in Kyoto. Response was to force a transfer
and initmidate newly unionized workers. Unfortunately, it worked well.
First injunction was against the transfer and I won. Nova's response to
that was to terminate me a few days later. Then I won an injunction
against the termination. Nova insisted on a full trial. Kyoto District
court upheld the injunction against termination, but said the transfer
was ok.
I am appealing the ruling holding the transfer was ok. Nova is
appealing the ruling holding the termination was unlawful. We are going
to the Osaka High Court. Whatever happens, my case will be an important
appellate precedent for future cases, and will affect the union effort
profoundly, for good or for ill.
I want letters from union people especially, but anyone ok. I've given
the parameters below. Can you help me?? Know any other people who can??
You can forward this email to anyone RELIABLE.
Letters should be not longer than 2 pages, except for special
circumstances.
Here is the info that will be useful for anyone writing the letters.
1. You have to give your name and address, and the date you are writing
it.
2. It should be addressed to: "The Osaka High Court"
3. It should include the dates and schools you and other worker
reporting these items worked for Nova
4. It should include the Nova branches worked at and dates
5. It should include the names of Nova supervisors, etc. who said and
did the items below.
6. It should cover your direct experience and or direct knowledge of
the following actions taken by Nova against you or union members,
especially where you feel this actions were at least in part motivated
by desire on the part of Nova to inhibit union growth, etc:
a. involuntary transfers, especially when there was a concentration of
more than 1 union member in a particular school
b. Generally tense relations between Japanese staff and teachers
c. sudden increases in alleged student complaints after Nova learned a
worker was a union member
d. tensions between instructors and staff
e, involuntary shift changes
f. warnings, informal and formal
g. reprimands, informal and formal
h. non-renewals
i. terminations
j. any other actions or communications by Nova that discouraged
effective union recruitment or singled out union workers.
Drafts must be EMAILED TO ME so that I can read them. When finalized
they should be both faxed and posted, to me.
Anyone writing such a letter will come under the protection of the
Court. Anyone still in Japan will come under the protection, also, of
my legal team. If you are harassed or terminated by Nova, my legal team
will represent you for a very modest legal fee!

I have never worked for Nova however I wish you the very best of luck. Don't give in to big companies - it's not worth it. I'm glad you are doing something... don't stop believing in yourself. All the best! |

Good luck and all that, but I can't believe you're fighting against Nova sacking you. I would have thrown a party.
Everyone with half a brain on this forum or anywhere knows Nova sucks. Give them the finger and go get a decent job. |

There was a discussion after the original post that was deleted by the moderator which would have made it clearer to readers that I am not the author. I thought it was rather clear already. I'm going to edit it into a quote to make it look even more like the e-mail that it is.
It won't be long until everyone and their brother sues Nova and wins.
