I am writing this on behalf of a friend who married a Chinese woman last year. They finally arrived back in the states last summer and they had an argument and she left.

She is now running around the US and calling my friend to taunt him about how the US can't touch her

Is that true?

He reported her working to ICE (Immigration and Customs Enforcement) and that she is refusing to leave. They told him there is nothing they can do...is that true for him?

I would feel bad for him if she can get away with this....
I know people might come on this thread and say "It was his fault for marrying her"- I met them several times during my stay in China and I can say there were no problems between them until they reached the states- obviously she used him to come here.

It sounds improbable that she is untouchable if they have been married only one year. Having jumped through the hoops myself (and happily married to a Russian for over 15 years), I know that the defenses against fictitious marriages are significant and follow you around for your first couple of years in the states. We had to continue to show up for interviews proving serious intent in our marriage. If she's really been in the states less than a year, I find it curious that the fictitious marriage charge supposedly can't be levered here.

Never mind the immigration issues: I would warn your friend that he needs to get a lawyer and protect himself ASAP - especially from any financial debts she may incur. If she were to get a credit card or bank loan, without some legal action taken he might well be responsible.

He won't be held liable for her,
he doesn't have a good job now, in fact he is still in school, so he can't show intent of supporting her (he must show that he earns at least 25% above the poverty line, which is currently $16,000) plus he wrote a letter that states that he relinguished all responsibility of sponsoring her- which CIS did reply by cancelling her tourist visa.

he told me her defense was that she is chinese and can mingle in the population without anyone noticing her.

but can she still get married?
He just wants her to go home.....point blank......

He needs to forget about her and move on. She's not his problem now; let INS worry about her.

I can appreciate all opinions and responses, including the negative ones and I will pass them on to him. He did move on, even to the point of joining the army reserves to pay for school and get a job near home, he just wants her to stop calling and gloating about the fact that she can roam around without fear of getting caught.

He contacted a JAG (judge advocate general- a fancy name for a military lawyer) lawyer about it and she said that because she was denied a green card and because he is a soldier, she doesn't have a chance, especially since her fingerprints are file with CIS.

Why doesn't he contact the phone company? I'm sure he could either get her number blocked or have her number disconnected if she's harassing him by phone.

that's terrible, this happened to a friend of mine.

he toured china for about a year, met this chinese girl & married her. well, they had a kid together & everything! he got completely screwed over!!

she completely used him to get to the states to live & he hasn't seen the child since!!!

it's been like five years already & the divorce papers just went through. she refused to divorce him when they didn't even live in the same country!!!

it messed my friend up though. he's still hurt from all it.
