Hi All,
I jacked my job in a few months ago, but the school didn't cancel any of the paperwork. I have been in Indonesia for three months larking around and am going to be returning to Shanghai in a couple of weeks (just for 3 months).
Can I still use my Shanghai Residence Pemit (the z visa in passport) to get into the country? It doesn't expire until December and I was hoping to get a couple of months part-time work organised.

| Yes, you can return to China on your residence permit, but you will need a work permit to legally work, even part-time. |

Yes and no and in between.
First, provided that your school did not actually go through the motions of attempting to cancel or revoke your residence permit (it can be done, it is rare, I admit, but it has been known to happen and under the current rules, more so than before). I beg to disagree with the previous poster but yes, I suppose, I suppose under the very, very fine letter of law, you will need to switch your resident permit to new your new employer. However, if your residence permit is valid in Shanghai, and that means that it was issued in Shanghai and the barcode-readable document in your passport says "to work in Shanghai" and if you return to Shanghai to work for the duration of your residence permit,then yes, you will truly have very few problems.
HOWEVER, if you decide to stay in China and find another job under the current rules, you will absolutely need to have a letter of release from your previous employer. There are provinces that still dispense with this but to the best of my knowledge Shanghai is not one of those parts of the country that does.
It's all so murky these days in any case. |

You may want to be careful about your visa / rp.
The reason I say that is on the surface your visa is fine - ie the visa appears valid, but... If your school told the government that you left then it MAY BE canceled in their computer system which means you show up at the gate of china and they tell you SORREE NO TICKIE NO SHIRTIEE...
Meaning your visa aint no good and you don't know and you travel to china and they don't let you in and then you need to go find a new visa somewhere else.
And the only way you may be able to find this information out is by going to the chinese consulate whereever you are and asking them and hoping they give you a correct answer, or by coming here.
If you come here you may want to enter via hongkong so as you can make a quick painless turnaround.
Fly in and it may cost you more money.
How do I know this...? Sometimes you learn from first hand experience not from a thread on a web site.

You should take Jeff's point quite seriously. It has happened, it can happen but it does not mean that it will always happen. I worked at one school that I left early due to not being paid and they tacked a note on my door, with the school's "chop" that I would never work again in China, that I would go to jail, etc., etc., and do you know what? My new residence permit, Foreign Expert's Certificate, etc., etc., were all processed quite legally in a near-record 10 days, beginning-to-end.
Just be aware of what could go wrong without being paranoid and have a Plan B, and C, and D in the works, especially from now until October.

So you did a runner, eh? I suppose it's fair enough. No pay, no work! But would you mind telling us where this was and why the school didn't pay you? Maybe this belongs in the "worst places to work in Guangdong" thread. |
