Well my absolute worst case scenario has emerged. Last night I was pulled over on my way home from the bar and blew over the legal limit. I am now facing an impaired driving charge.

I already have a job lined up for August and just submitted my final medical certificates to receive the papers to apply for a work visa. I have basically decided to plead guilty since it will be cheaper than the lawyer's fees (first offence) and it doesn't matter if my license is suspended for a year cuz I will be gone.

Will this DUI affect my visa application!? Do they ask about your record? If I put "YES" will that destroy my chances? Could I check "NO" under previous criminal record and trust that they won't actually run a full background check?

I am freaking out right now so any firsthand knowledge would be greatly appreciated!!

Just check "No". Criminal background checks are a plan for the future and even then I guess they would be looking for people that have served time rather than a DUI (which is all too common in China).

I agree with Vold..er..He Who Must Not Be Named...don't mention the DUI to your Chinese employer. I assume you are in Japan, so I wonder how that affects your retirement package, if you have one. A DUI can be detrimental to a public school teacher in Japan, especially with their retirement package.

Will you be required to attend AA or to checkin with the court.. could be difficult when you cross the big pond....

If you complete the visa application before pleading guilty to the crime, then you can check "NO" under previous criminal record. At the time you completed the application you were completing it truthfully and accurately. IF they run a full background check, things could go awry but I have a feeling it'll be fine. Just be prepared for a setback anyway, and have a plan B in place.

Anyway, in China D.U.I. stands for "Dumpling United Institution".

in any case, i didn't think it was a "criminal offence" until you injured or killed someone dumpling down the road with booze up your arse

OP, first you have to be charged and then it'll take time, doesn't it? come to china quickly..you can drink and drive here Smile

Any moron making jokes about drinking and driving and those of us with friends and/or family who were flat-out murdered by a pathetic loser too stupid to make other arrangements to get home should not only lose board membership but should not be allowed to walk whatsoever!

And, of course, as usual, someone who jumps into their 2+ ton deadly weapon, clearly with no concern for innocent lives around their uncontrolled, under the influence, death machine ... what's their first concern ? "oh, what about me" and "how will this affect MY life" and "can I still get a visa" ... TYPICAL. Where was such deep thought before risking the lives of innocent people out there ?

look i get your point but did our OP hurt/kill anyone? my point is that it may not be a criminal offence if you don't and so it may not go on a record except the driving one with demerit points. Wink

I don't know about other cities, but in BJ the alcohol limits for driver are VERY strict. As in, having half a pint can easily put you over the limit.

My friend was driving me home the other night and we found this out the hard way. She literally had half a pint, got pulled over and now has two months suspension of license plus a fine.

Oh, and as far as i know, a DUI is put on your criminal record

"Driving under the influence of alcohol (driving while intoxicated, drunk driving, drinking and driving, drink-driving) or other drugs, is the act of operating a vehicle (including bicycle, boat, airplane or horse) after consuming alcohol or using drugs. It is a criminal offense in most countries."

This made me think...something my father said..nothing good happens after 12 oclock...




Its 2am...drunks rollin out of the bars..each night .. hundreds..no thousands...all takin to the streets at last call; chewing the coctail straw and stuffing small napkins containing the results of a partnership with a wing man that yielded some young nubiles home digits....

after a brief research i've got to admit that you're right. it's amazing how many criminals are out there.

now, our OP has just been pulled over and's yet to wait for his trial. if he postpones his trial to some later date, he'll still have a clean record the day he applies for the visa. i'm not sure if he has to be at his actual trial, or if he can have a representative to fill in for him, but i guess that's up to him to find out.

Once at a check point in BJ every drivers were tested for alcohol, my turn, the old man noticed my suit, tie, bling bling watch, hesitated and couragiously handed me the device ...
A palastic cylinder with a little flexible pipe hanging at one extremity, to end with a mini funnel.
Eager to try a new toy, I politely smiled and gave it a try ... yes a try ... because the little flexible wouldn't stay straight as I was trying to blow into the mini fennel ...
Said police officer losing his patience asked me to simply cough into the funnel ... "haokool" I claimed, and to the disappointment of the officer which was losing face ... The liquid crystal digits prompted a - sign, and off when went!
(all this happening not without asking myself "why is this thing so similar to a water bong?!")
