Does anyone know if a teacher resigns before their contract is up, to end their term of employment by end of semester 2 in year 2, will they still get paid for the summer holiday? Or will HCT withhold that from them?
Also, does the teacher still get their gratuity, albeit a smaller amount?

If you leave your contract you will not be paid for the summer because you are leaving before your contract is up. AFAIK you have to give proper notice, and then you have to request the summer pay.
If you have not given proper notice (the six months in advance) they can, and have in the past with held the gratuity.
another issue you may want to pay attention to is the "housing allowance" is a 3 year "loan" which is forgiven 1/3 of the amount per year until you have completed your full 3 years. If you leave after 2 years, you will OWE 1/3 of the 30,000 AED they gave you for housing, and will take it from your gratuity. |

I'm not clear on exactly what you mean. If you have a 3 year contract and choose not to renew, at the end of the 2nd semester of your third year, you have completed the contractual teaching and should receive your summer pay and full gratuity. And the full furniture allowance will be yours.
But you have to be very careful about dates and notice and such. And rumor has it that managements at some branches try to make problems. Most people get out smoothly with all their money, but there have been tales of teachers who have not. We have had posters here at year ends the last couple years who say that they got it all... and some that said that they or a friend didn't.
And, it gets kind of unpredictable if you leave in the middle of the contract. That is really the point where any toes you have stepped on in HR or your branch management can bite you.

I meant that the teacher has not finished the contract yet because they are only in their second year and will leave at the end of that second year.

what does AIFAK mean?
Yes, I meant that the teacher would give the proper notice.
If a teacher leaves at the end of their first year (probationary year), do they get paid for the summer?

AFIAK you can leave at any time in the contract, but know that by leaving early you will have difficulties and issues.
If you give your proper 6 month notice, you should bet 2 months salary as a gratuity for 2 years service. But note, that you will owe 10,000 AED from the "decorating allowance" which was a loan.
The issue could be negotiated if you have personal issues or something else that HR is willing to take into account.
But in general leaving after a year or two in a three year contract here causes massive complications in your life.
again AFAIK if you leave before the contract is up, they will not pay you for the summer unless you request your time in advance.
Again, don't know specifically, I haven't come into that issue here.
In general the best thing to do is hang on for another year and finish the contract and then walk away after 3 years. But I do not know your situation. |

Thanks everyone for your responses.
One last question.
If giving notice (6 months) to leave in June (making it two years), must the teacher do this in December or is it OK to do so in January (contracts say that "notice periods involving teaching staff should coincide either with the end of semester or end of the academic year." and the academic year ends July 31).
Just want to know all options.

Generally, you have to say before the semester end that the following one will be your last - At HCT that means advising them before you go on the January break.
If you do not, you may have your EOS benefits withheld, even if you are only a "few days" late. Happened to a friend of mine in Sharjah. |
