I had to go to the hospital and was there for 2 months. Prior policy at my school was to pay the teachers if they were hospitalized the entire pay, and there were 2 such cases while I was there. They got paid for 3 months each while they were in the hospital.

However, they only want to pay me for 2 weeks instead of 2 months.

My contract says that I should be paid $X every month. Nothing is mentioned about sick pay, or how much should be paid.

Do you guys think I have a leg to stand on for mediating in Foreign Expert Board?

Do you think prior policy would indicate assumed sick pay benefits that a teacher can expect?

You ARE lucky to get anything.
Nothing is policy if it isn't in writing. And, to be honest, I have never heard of a teacher getting paid if they didn't work because they were sick(outside the 3 or 4 sick days allowed by most school)

BUT...two months is a long time and a lot of pay. If there were others given this treatment, then of course you should fight.

If it were me (and IF I WERE WILLING TO FIND ANOTHER JOB) I would make sure exactly what the contract says. Then, if nothing is mentioned, fight on the grounds that nothing is mentioned about cutting pay in case of sickness. Try your case with your manager, then his manager, then his manager, and so on. Threaten to hit the internet wherever new teachers look for jobs and write letters discouraging teachers to go to that school. Threaten to go to the newspaper (this may or may not be a hollow threat) threaten to go to the tv station (same case here)

BUT before you attack a schools livelihood, make sure you are right. If other teachers have received their money then you should too.

BTW Chinese bosses (and foreign) will usually take the approach that if it is not mentioned in the contract, it automatically favors them and the school.
You should take the opposite viewpoint.
It's kinda your fault, though, you should have asked about this before signing anything but hindsight and all that.

Be happy you're getting 2 weeks wages. I recently spent 2 weeks in hospital with pneumonia , another week and a bit recuperating ay home and all i got from the school i work at was when am i going to make up the classes i missed! Though they did offer to lend me money if i needed it at a really good interest rate! Laughing

the SAFEA contract itself is very generic and wont say anything about sick leave. but have you read the appendix to your contract? that's the document that contains the details more pertinent to your daily life/work. it should also state how much sick leave you're entitled to and how much you're paid during sick leave. here's the standard (been in every contract I've had, but it might vary between schools) appendix clause on sick leave:

In case of illness requiring absence from work, Party B may ask for leave, which will be duly considered by Party A. Sick-leave within 3 days granted by Dean of the Foreign Languages Department and sick leave over 3 days granted by Director of the FAO should be certified by a doctor. Party B will be paid if the accumulative sick leaves are less than 15 days during the contract period. The salary will be deducted 30% if the accumulative sick leave is 15 to 30 days. Party A has the right to finish the contract if the absence is more than 30 days.

sick leave with full pay for up to two weeks, 70% pay for sick leave from two weeks to 30 days, and after 30 days of sick leave, you may find yourself unemployed.

as for why other teachers were paid in full for lengthy periods of sick leave and you weren't, there could be plenty of reasons:

1. were they chinese? don't compare your benefits with theirs. even if they were FTs not all contract appendices are the same for all FTs.
2. circumstances of illness.
3. maybe the school doesn't like you (not a judgment on you, but a possible reason why you weren't paid in full).

TBH, I'm not surprised they are trying to cut back on the sickness benefits. They must be thinking.........WTF is it with these FTt's and long term sickness?

Obviously if it's not in your contract then you are not entitled to it legally but try to argue your case as civilly as possible. Good luck.

That's an extraordinary round of sickness for one school.

Were you downwind of a battery factory or something similar?
