I have worked in many countries and I am very paranoid
about scams and loopholes in contracts. Please advise me
on the following clauses from two job offers:
NON-COMPETITION
NON KOMPETISI
As you are receiving exposure to proprietary curriculum development and training from us you acknowledge the investment the school is providing to you. You shall therefore not work with any school in Indonesia for a period of 24 (twenty four) months after the termination or the completion of your contract unless otherwise agreed by the school.
So if I am fired/dismissed or just let go
I cannot work in Indonesia for two years?
competition means every school in the country..correct?
So even if I complete my contract successfully
I still cannot seek employment in another city?
..wow! I hope I am wrong about this clause
So even if I quit during my probation period
I still cannot seek employment elsewhere in
Indonesia? Please tell me that I am reading this wrong________________________________________________________
6. WORK PERMIT/ VISA AND TRAVEL
IJIN KERJA/VISA DAN PERJALANAN
The School shall pay, subject to your eligibility, for the expenses for obtaining your work permit/visa and any initial air-ticket (as per School guidelines) into Indonesia from the point of hire, for you only.
Does anyone know the requirements for eligibility?
Does this mean that since I was local recruited that they will not
provide a plane flight to my home country at the end of the contract?
Any chances that these clauses can be removed prior to my signing?
or are these clauses a norm for Indonesia employment? |

The non-competition clause seems very unreasonable but I doubt whether the employer could actually enforce it.
"subject to eligibility" is very vague and I suggest you find out what your eligibility is before you sign. |

That sounds a bit shifty to me. I'm not aware of any other schools that impose this kind of regulation. Have you had an interview with/spoken to anyone from the school? |

I'm probably way off here...but, I have heard a certain Indian named school try to enforce this one about 'not working for 2 years' anywhere else.
Apparently, strong ties with mafia types.
Again, just what I have heard and NOT experienced.
And yes, if a local hire, then I would assume that when the time came to pay your flight back to your home country, then this would be mentioned and they may just pay for your flight out. i.e. to Singapore.

Yes, it is bizarre...
Perhaps they have valuable company secrets which they don't want you to divulge to other schools. They might have to kill you at the end of the contract just to be safe  |

Extremely pretentious on their part. 'acknowledge the investment' indeed! Am I correct in assuming that their investment in terms of salary offered is way above anyone else, too? |

2 year contract 1250 usd without living arrangements
the other offer is
2 year contract 1500 free apartment |

If that is for an ordinary language mill job it is OK. If it is for a K12 schoolteacher job or specialist business English training it is crap, crap, crap. |

Obviously it's a private school. It's not alright. Unless this school is on the absolute cutting edge (no pun intended) of "curriculum development and training" (how likely is that?), then they are way out of line. We're talking about a language school here, not a pharma company or software development firm.
I wouldn't touch them with a very long stick...unless their offering a huge salary, of course. Are they? Thought not.
I would tell them to take a running jump. As long as teachers continue to accept nonsense from schools, they'll keep doling it out. |

It's got to be SIS again-can't be anyone else! Friend of mine with Phd went for interview at their PIK branch and was offered 6 mil a month 2 year ago! Absolute cowboys.....  |

The non competiton clause is illegal. I know that from an Indonesian lawyer. They cannot stop you working for somebody else. This is their responsibility to keep you in there if you are doing a good job.
Most of the school who hire locally will not give you a ticket to go home. You have to negociate this.

I also had a non compete clause in the agreement I signed with Wall Street Institute. They tried to tell me after they fired me that I couldn't work in Indonesia for two years as an English teacher. I fully advise any competent person not to join such a shady company. I had a terrible feeling before joining the organization especially when the owner stated he had a bunch of idiots running the program. I wish I had stayed with my previous company. They try to make their own law and do not pay the rest of the contract. Manpower stipulates that once you have passed the probationary period then the company must pay the rest of the contract if they terminate you. I did contact the owner about this and he refused my calls. He basically ran away from any legal obligation but yet try to enforce something illegal such as the no compete clause. He also terminated me without three written warnings. In Indonesia some companies try to make their own rules which do not follow Manpower. Manpower is the governing body the legal rights for all workers whether domestic or foreign. You should contact them if any problem arises. |
