I'm interested in getting citizenship, here's some info that I found. Has anyone gone through this process?

The citizenship is the capacity of the private person that evokes the permanent political, social, economical and juridical relationships between that private person and the state.

The Romanian citizenship proves that the private person belongs to the Romanian state and gives to that private person the possibility of being the titular of all the rights and the duties stipulated of the Constitution and the Romanian laws.

Principles of citizenship:

1. Only the Romanian citizens are the owners of all rights and duties stipulated of Constitution and laws.

Here we can talk about:

a) the right of elect and to be elected

b) the right of residing in Romanian territory

c) the right of being landowner in Romania

d) the right of not being expelled or extradited from Romania

And so on...

2. The Romanian citizens have to abide by the Romanian laws and Constitution.

3. Only the Romanian citizens have to carry out the duties stipulated of Romanian Constitution and laws.

Some of those duties are:

a) fidelity for Romania

b) fulfill the military service

4. The marriage has no legal effect on husband�s citizenship.

5. The changing one husband�s citizenship has no legal effect on the other husband citizenship.



How can one person get Romanian citizenship?

In Romania, we can talk about the system jus sanguinis and that means that the child becomes Romanian citizen if he has Romanian parents or a Romanian parent.

The citizenship law establishes four ways of granting the citizenship:

by birth
So, the child born by Romanian parents or by a Romanian citizen and a foreign/stateless parent is a Romanian citizen.

by repatriation
The person that was once Romanian citizen but lost the Romanian citizenship by residing abroad will obtain Romanian citizenship by repatriation.

In the matter of the repatriated person�s minor child the law stipulates the parents decide for the minor�s citizenship. The minor over 14 would express separately the consent.

In order to obtain the Romanian citizenship you can file a repatriation request to the Ministry of Justice.

by adoption
The child under 18 adopted by Romanian parents or one Romanian parent will get Romanian citizenship.

by request
This person will fulfill the following conditions:

a) He/she is born and resides in Romanian territory at the time of the request from at least 5 yrs or at least 3 yrs if he/she is married to a Romanian citizen.

b) He/she proves devotion to the Romanian state and the Romanian people.

c) He/she is over 18 yrs.

d) He/she has assured the means of existence.

e) He/she is known with a good conduct and wasn�t convicted in Romania or abroad for an offence which makes him/her unworthy of being Romanian citizen.

f) He/she knows the Romanian language so that he/she could integrate in the social life.

This request can be made personally or by a person with special and authentic mandate.

3.1. The authentication of powers of attorney, which Romanian citizens being in the US wish to give to individuals in Romania (powers of attorney for sales, purchases, pensions, judicial representation or general administration, accepting or refusing an estate), is made by appearing personally before the consul, at the consular office with identity papers (consular fee $ 45).

3.2. In case the Romanian citizen cannot appear personally before the consul, a US notary public may be contacted. The US notary public that authenticated the power of attorney must be confirmed by the Secretary of State in the respective state. The documents must be sent afterwards to the Authentication Office of the Department of State 518 23rd. street N.W., SA-1, Washington D.C. 20520 , phone 202 647 5002 website http://www.state.gov ( consular fee $5) and finally, to the Consular Office that legalizes the signature and the seal of the Department of State (consular fee $ 30).

3.3. Obtaining papers from Romania: birth certificate, marriage certificate, police record. In order to receive the necessary application forms, the consular office must receive a request together with a self-addressed, stamped envelope (consular fee $ 30)

3.4. Certification of translations of papers: birth certificate, marriage certificate, diploma, etc. (Consular fee $30 per page)

3.5. Regaining the Romanian citizenship: the individual wishing to regain his/her Romanian citizenship, must appear personally before the consul, at the consular office in order to make this request, with US identity papers in original and photocopy.

3.6. Regaining the Romanian citizenship, in case the Romanian citizenship was lost after 1990, may be also done by a declaration given personally at the consular office of the Embassy. It is also necessary to present identity papers and US criminal records. Consular fee $ 185.

3.7. Repatriation of Romanian citizens residing in the USA. The request for the repatriation should be made, in person, in Romania, at the Division for Foreigners, Migration Issues and Passports of the county where the Romanian citizen wants to reside.

3.8. Clarification of the Romanian citizenship. Individuals, who have doubts regarding their Romanian citizenship, may request, in writing, the specific application forms from the consular office, enclosing a self-addressed, stamped envelope (consular fee $ 35).

3.9. Legalization of the seal and signature of the Department of State. In case of papers needed for the adoption of a Romanian child or other papers , such as powers of attorney, which are to be used in Romania, the consular office legalizes the seal and signature of the Department of State (consular fee $ 30).

CONSULAR FEES (SUMMARY)

PASSPORTS
a. Issuance of a passport $60 plus $30 for each child included in the passport.
b. Issuance of a consular passport $70
c. Extension of the validity of the passport :$50 plus $20 for each child included in the passport.

VISA
a. One entry $ 35 (=$25 per visa plus $6 emergency tax plus $4 operational costs)
b. Multiple entries $ 70 (=$60 per visa plus $6 emergency tax plus $4 operational costs)
c. Transit Visa $35
d. Visa for citizens of the states whose citizens must submit an invitation $ 55.

NOTARY

a. Powers of attorney $45 ( add $7 for each additional copy)
b. Legalization of the seal and signature of the Department of State $30
c. Certification of the accuracy of the translation for each page $30
d. Translation for each page $50

OTHER CONSULAR SERVICES

a. Obtaining vital records and other papers from Romania $ 30
b. Regaining the Romanian citizenship under art.11 $185
c. Regaining Romanian citizenship under art. 37 no fee
d. Clarification of the Romanian citizenship $35
e. Renouncing the Romanian citizenship $375
f. other consular services $30

Visa fees vary according to nationality. Contact the embassy for more info.
