I've completed my year plus a week.....and since the school is not doing well...1/2 the students than when I started....he is saying that he can't pay the severence. I said I would go to the Labor Board, but I'm not sure what to do other than that. I have even said that he doesn't need to pay it until I return from my trip back home...I am back in Seoul on the 19th of September.
How does one go to the labor board? What paperwork do I need? |

Ring them up, IF they decide to take up your case they will tell you what to do.
For a list of telephone numbers for regional Ministry of Labor offices click on legal info at:

Labor Standards Act
=============
Article 34 (Severance Pay System)
(1) An employer shall establish a severance pay system whereby an average wage of more than 30 days shall be paid for each year of consecutive years employed as a severance pay to a retired worker; however, if the worker was employed for less than one year, this shall not apply.

Berlitz never pays severance pay.
In fact, a few years ago, the teachers there at the time took them to the Labour Board and the Labour Board decided in the Instructors favour.
Berlitz was ordered to pay severance to its instructors.
Berlitz still refused to pay severance pay and the Labour Board never enforced the judgement.
There was some talk of Berlitz paying-off certain government people etc to take the heat off.
This was back in the late 90's.
To this day, I don't beleive they pay severance pay to their instructors.
Does anyone know if Berlitz has started to pay severance to its instructors?
Berlitz would do shitty stuff too like fire people before their contracts were finished so that they didn't have to pay airfare, etc.
A real crooked organization. |

There's the problem right there.
Show your director some latitude. Make some sort of agreement with him on when he thinks he would be able to pay and how much. Installments would probably help him.
Cut him some slack.
If he prolongs paying you, say 6 months, go to the Labour Board.
I doubt if the Labour Board has a statute of limitations on how long you have to go to them.

Don't cut him some slack! That is the oldest, lamest excuse in the book. Go to the labour board, but don't expect much help.
If that doesn't work, (which is likely) then send your employer a polite letter stating that you enjoyed working for him... blah blah blah. You don't want to, but ..........if he doesn't decide to pay your severance money, you will have no choice but to send his name and the name of his school to every black list, grey list in sight, as well as to the embassies of every English speaking country you can think of.
I've heard that other people have gotten results with this approach.
Good luck |

Yeah, I thought that response was odd, aslo.
DO NOT CUT him slack!
DO NOT TEACH if you did not receive your pay.
DO NOT WAIT 6 months.
REPORT HIM now.
MAKE SURE WE know the name of the school and location so that we and future instructors can AVOID this school.
Good Luck! |

Man you guys are cuthroat.
Would it not be better to work out at least some sort of deal where you get your money in incriments. Many a teacher have been nice to suggest that.
If you have not seen your money, after a period of time, contact the Labour Board. |

The Labour Boad can decide in your favour.
However, the problem is that they DO NOT ENFORCE DECISIONS.
Bro, you're hooped if your boss/school decides to bend you over here.
You have very little recourse that makes a difference.
Teaching in Korea can be quite risky from this perspective. |

Certainly suggesting to the boss that you will go directly to the Labour Board will possibly scare them.
As per TECO's statement, there is a good chance you won't see your money.
In any case, make a deal.
