Anyone ever deal with insurance company for vehicle accident ?
My friend has the motorcycle accident, his scooter was hit by a truck, and the man who own the truck sent his insurance guy to pay for the hospital bill ... and repair the scooter. Then today he check with insurance company and they told him that they will pay only 90% of hospital bill,10% will be bear by himshelf as they said the accident happened because my friend was riding the scooter at the side walk ( infact he did ride the scooter in the main road not side walk )... and the insurance guy did not request the police report for the accident ( he did not know why ? ). Fyi, my friend has no driving licence nor issue korean licence , and the scooter has no plate on it . He was foreigner.( so i guess he was in the lost situation ???).
and for the outpatient fee, they will bear 8000 won only for each visit , not going to pay/compensate for the time spend on the hospital's threatment .And the injury had made my friend's leg numb at the foot back/bottom, and he has to walk in the smooth surface otherwise he leg will crack/bend if he accidently step in the small hole/unsmooth surface.He said he feel like using other people leg to walk ....Did the insurance company will pay for the lost of foot sensational due to this vehicle accident ? In Canada, the insurance company will pay a lump sum due to this. Any feed back and info will be very much appreaciate. |

I'm sorry to hear about your friend's misfortunes. I'm no expert in Korean law, but considering your friend was driving with no license and insurance maybe he (or she) should consider him/herself lucky that s/he managed to get 90% of their costs covered.
In Canada s/he most likely wouldn't have got a cent and would probably have got ticketed and/or fined if they were riding illegally. Canadian insurance companies are adept at wriggling out of claims and have a high deductable.

well, we do not know the korean law either. but isn't that for vehicle below 100cc can drive without having driving licence in korea ?, he has the scooter document paper,when he bought the scooter , its already came without plate on the scooter from the owner( used one ) on it. |

no, it's that you don't need a special motorcycle license for anything below 125 cc. You still need a Korean driver's license though. A simple call to your local ministry of transportation/search on the internet could have cured that. Like a previous poster said, your friend should be happy he got even a cent out of the insurance company.
I do hope he gets better though, that's a really shitty thing to happen... especially in a foreign country. |

You still have to have a Korean driver's license to operate a 125cc-or-below vehicle. However, you don't have to have the special motorcycle endorsement.
Your friend's lucky he didn't get hit with a fine. Last year I had a taxi crash into me on one of my 125cc bikes. I refused hospital treatment as I only had a concussion; the taxi's insurance company paid for the repair of the motorcycle, but I was hit with 700,000KRW in fines.
Now I have a Korean DL, Korean motorcycle DL, and International class-M DL. |

Thank you for all the info given to me... yes, My friend consider lucky... so I guess the insurance company didn't know he don't hv the licence... well, he trying to be accepting anything... and close the case with them at soonest. Anyway thank you for all of your info .I appreciate. |

Whether he had a license or not is irrelevant. It's a different matter.
He's owed more than just a few thousands won a day. Tell your friend not to agree to anything until he gets what he wants. He still has the upperhand. |

I dont know the word in korean, but there are guys called 'negotiators' who act as go-betweens in situations like these.
Your boss would probably know of them.
They are tough, and will get a good deal for you. They charge a commission if they get a deal that you accept, but you are under no pressure to accept their deal.
even though your friend was in the wrong driving without a license, it's still a cr@ppy situation and I hope he recovers fully. |

Yes, follow wuzzas advice, or tell your friend to get insurance. Eventhough the accident has already occured, the insurance company will help....might cost more than the option wuzza has suggested, but he'll be covered if something like this happens again. |

First of all, he is consideration :
- driving w/o licence ( driving licence and scooter licence ) this will occur a fine from police +/- 700.000 won
- Insurance company will tell him, that he was in the fault position , as he shouldn't drive w/o any licence .This means Insurance company could say , we can just not cover you at all, as they know he could not charge the insurance company with law.
- so far the guy who hit my friend , has been very nice to sent his insurance guy to pay the hospital bill, actually my friend never think to charge the guy who hit him,as my friend knew pretty well that he was at fault.
My friend just feel upset with his leg, that the foot has become numb, damage. he just want to know any compensation on this damage.and He hope he do not have to pay any portion of bill. |

Not true. Like I was saying, those are two seperate issues. |

This may be a bit off topic but i'm rather new to korean and see lots of people posting about motorcycles. I recently came from teaching in Thailand and before that Taiwan, and I Had a bike in both places, but I'm not really clear about the licenses here. And is there a driving test?
If any of you know anything about this please let me know...really anything'll help. Oh and I'm really far from soeul (in Hayeng outside Daegu) so i can't really get there with my schedual. Thanks again |

I don't wanna hijack this thread, but for me I showed my US license and took a short computerized test in English and eye test for my drivers license which includes bikes up to 125cc. For my 250cc and over I took a road test with a 250cc Honda and a longer written test. As this thread shows, it's best that if you wanna ride in Korea then ride legal. It's a weight off your back at the very least. I, too, rode a scooter and motorcyle in Taiwan so if you can survive Taiwan then Korea isn't a problem. Just get the license, plate, helmet and insurance. It's not that hard (except the road test!) |
