So on the one hand in America, we have a case like this:

"It hears from a Canadian man called Maher Arar, who was stopped by US officials when travelling through New York's JFK airport in September 2002 and sent to Syria where he was held for a year. He says he was brutally tortured.
The reason for his arrest was information passed to the US by Canada, linking him to a terrorist suspect in Ottawa.
.... No legal charges have ever been brought against him in either country. In Canada, where his case has caused a political outcry, a public inquiry is under way."
On the other hand, we have the Posada Carilles case. According to http://www.iht.com/articles/2007/04/22/opinion/edherrera.php "declassified Central Intelligence Agency documents indicate that his role has long been accepted as fact. Instead, he faces charges of immigration fraud, a travesty that could be equaled only by charging Osama bin Laden with entering and leaving Pakistan without a visa." So people could be forgiven for accusing the US of being severely selective of when they choose to respect the letter of the law. What makes the IHT piece so misleading, though, is that this is never mentioned:

The US messed up in is case. From what I hear he will be compensated by the Canadian govt as he should be. I hope the US govt compensates him too.
But I will put it this way.
Al Qaeda are military targets, they are not just a matter for the justice department.
The US is in a war.
The Poseda case is a matter from the justice department.
But Al Qaeda is national security issue.
They are two different situations from the US view anyway. |
