It is not like it is at home...here you pay before you get the lawyer. Friend better not bother...move on with life or get a new job...whatever.
A lawyer costs a lot of money. |

My friend paid a lawyer W3,000,000 to get a W30,000,000 settlement that involved several court appearances. I would think that a 10% cut is a lot cheaper than what most lawyers in the US would charge. |

What do you mean? In the U.S. lawyers make you give them a container fee. That's upfront money for doing work for you. |

I believe it's called a retainer fee. |

I have hired a lawyer in Korea a few times for serious problems that involved a lot of money. Unless it is for something serious enough, it is not worth the effort. Did you read why he wanted the lawyer? He said it was for a libel case....very very very hard to actually get action on this unless you can show true monetary loss.
This is not America where any idiot can sue for no real reason...it does depend on the police and prosecutor's office deciding a crime has occured and there was a monetary loss. Without them doing the proper paperwork ...it gets hard.
It is a pay as you go sysyem...you often don't get an actual dollar amount when you start. They just give you bills as you go along for every little thing they do. It is not a retainer system like Canada or America. Each step of the suing process requires you pay money and the amount is whatever they say it is.
---Giving a large retainer to a Korean lawyer to hold is like throwing your money in the toilet. You have to pay for each and every thing individually so that you can argue over the individual price. If you don't they just charge whatever and screw you. |

You're right. I just wonder why no one but me broached the fact that there is indeed upfront fee. |

Unless said reason is libel. Far as I can tell, it's actually EASIER to sue for libel here than in the West. |

The law is not clear. They look at who lost and what kind of damage was done and they award based upon that. If you can't show that you lost because of it then they award nothing. It is not white and black.
PS: The upfront money is for the initial action...it is not for the total case. READ MY POST. You can choose to pay the total upfront money and you can choose to take it up the backend...I don't recommend either. |
