What if you have no sponsor??

Hi
My friend is getting a divorce and apparently the divorce will happen near the time when he has to renew his F-2 visa. However, since he'll be divorced, he obviously wont be able to get an F-2. So he's wondering, what happens in that case since his wife wont be signing his F-2 forms as the sponsor? Does he automatically go back to a tourist visa? He wants to still remain in Korea

Divorced? What for? Tell us everything, or no soup for you.


I would imagine that he'd have to leave the country and re-enter on a tourist visa, unless he has the quals/a diploma to apply for a job before he has to leave. If that's a possibility for him, then he could just go on a visa run for an E-2.

Too bad he couldn't have held on for another year, I hear that after you get the F5 - they don't take it away from you over divorce. I could be wrong on this....very wrong. Since I read it here on Daves...

No wife, no sponsor, no F2. Thats pretty easy. Either back on a tourist visa or an E2. THIS is why people need to get the F5.

ok. so i assume you got to leave BEFORE or ON THE date the F-2 expires and come back in on a tourist visa IF you dont apply for an E-2 ????

so just a follow-up question...

if they split up say months before his current F-2/ date on ARC card expires, can he still stay until the last day even if his wife or they file papers or whatever beforehand??

Until the judge grants the divorce he's still married. Another thing if your friend doesn't want the divorce he shoud stand up now and let the court know. It is still a mans world here for now in South Korea. Otherwise when the gavel hits the table so to speak it is over with in 5 minutes. Then he will have to leave the country. And get a new type of visa.

I see a solution. He should make a deal with his wife. If he is close to being eligible for the F5 he should ask her to hold off on the divorce until he gets his f5. Say this to her" Honey, if you dont agree to wait till I can get my F5 then I will drag out the divorce as long as possible, but if you agree to wait then once I have my F5 I will agree to it the very same day". Provided ofcourse he is close to being eligible or if he is eligible now. If he has a year to wait or more I doubt she would agree. Anyway, without an F5 is is SOL.

so you mean, IF he refuses to sign the divorce papers, there is nothing the courts/gov't can do until his "current valid" visa runs out??

also..

once the judge decides, you have to leave asap, even if you have months left on your exisiting current visa?
